The County Treasurer-Tax Collector has advised the City that four
parcels within the City were deeded to the State for non-payment of
property taxes. These parcels are now available for purchase by the
City subject to redemption by the respective property owners. It is my
ITEM TITLE:
RECOMMENDATION: That Council authorize the purchase of Assessor's
Parcel No. 575-060-07-00 and appropriate funds therefor.
BOARD/COMMISSIONS RECOMMENDATION: Not applicable.
DISCUSSION:
The parcels involved include three very small pieces of land which have
no value to the City and a 1.42 acre parcel which straddles Telegraph
Canyon Road and the Telegraph Canyon drainage course adjacent to 66
Telegraph Canyon Road. Because of the relatively rough topography of
this land and the extent of improvements needed, it is unlikely that
development will occur under the present R-I zoning.
Telegraph Canyon Road is presently being considered for widening in
this area. If this property is under City ownership, acquisition of
additional right-of-way for widening will not be necessary. If the
parcel comes under private ownership, acquisition of right-of-way could
be more expensive to the City than purchasing the parcel outright at
this time.
The City most likely could establish prescriptive rights over the
property which is presently being used for the street. If the road is
widened however, additional rights of way would be required. In the
long run, legal costs associated with such an undertaking could exceed
the cost of an outright purchase at this time. Should we not buy it
now, a private party could obtain the land in January 1981 when the tax
collector will hold a sale of tax delinquent lands.
According to the Treasurer-Tax Collector's office, the approximate
price for purchase of this parcel by the City would be $1,900 plus
certain costs of advertising. The price is calculated on the basis of
75% of the latest market value appraisal by the County. Before title
could be transferred, the County must advertise the pending sale in the
local newspaper for three consecutive weeks. This advertising is
intended. to giv.e fu11. notice of the .situation to any interested
parties. Its cost must be paid by the City.

I recommend that $2,500 be appropriated from the unapprop:ri,ated balance
of the General Fund to "Purchase of Assessor Parcel NB. 575-060-07-00
for future Telegraph Canyon Road and Channel right-of-way", Project No.
600-6000-GF26. If after needed rights-of-way have been reserved, the
City wishes to sell the remainder, some portion of the purchase price
may be recovered.
FISCAL IMPACT: The recommended actions will result in an immediate
reduction of $2,500 from the General Fund. A possible future sale of
the unneeded portion could offset all or a portion of this reduction.
