HomeMy WebLinkAboutOrd 1981-1943 Form No.'38i Rev. 2-79 ORDINANCE NO. 1943 AN ORDINANCE OF THE CITY OF CHULA VISTA A~NDING THE ZONING MAP OR ~PS ESTABLISHED BY SECTION 19.18.010 OF THE CHULA VISTA MUNICIPAL CODE PREZONING APPROXIMATELY 18 ACRES LOCATED EAST OF INDUSTRIAL BLVD., BETWEEN OXFORD AND PALOMAR STREETS, TO C-C-P The City Council of the City of Chula Vista finds as follows: That in accordance with the attached Negative Declaration, IS--81-21 and the findings therein, the proposed prezoning will not h~e a significant impact upon the environment, and the City Council hereby certifies that the Negative Declaration was prepared in accordance with the California Environmental Quality Act of 1970, as ~mended. The City Council of the City of Chula Vista does hereby ordain as follows: SECTION I: That the Zoning Map or Maps established by Section ]9.18.010 of the Chula Vista Municipal Code be hereby amended by adding thereto the following prezoning of property: That that certain property consisting of approximately 18 acres located east of Industrial Blvd., between Oxford and Palomar Streets be, and the same is hereby prezoned to C-C-P, in accordance with Planning Commission Resolution No. PCZ-81-G, adopted on the 13th day of May, 1981 pursuant to the provisions of Section 19.12.020 of said Code autho- rizing the prezoning of unincorporated territory adjoining the City, and said zoning shall become effective at and upon the date the subject property shall be annexed to the City of Chula Vista. SECTION II: This ordinance shall take effect and be in force on the thirty-first day from and after its passage and approval. IS-81-21 DATE: December 23, 1980 A. Project Setting The project site consists of 16.2 acres of property located east of Industrial Blvd. between Oxford St. and Palomar St. The present use of the property is truck crop farming. The property is void of any natural or man made resources and there are no geological hazards present in the immediate vicinity. Expansive soils may be located on the project site. B. Project Description The applicant proposes to subdivide 16.2 acres of property into two lots (3.8 acres and 12.4 acres), prezone and annex the property to the City of Chula Vista and detach the area from the Montgomery Fire Protection District. Development of the property would consist of a 3.8 parcel with 38,320 sq. ft of retail floor space and the 12.4 acre parcel with 129,280 sq. ft. of industrial floor space and 12,500 sq. ft. of office floor space. Related offstreet parking spaces, street improvements and landscaping are also proposed. C. Compatibility with zonin~ and plans The proposed project will be required to meet the zoning ordinance standards and comply with the General Plan. The zoning ordinance was recently amended to provide for the retail distribution of merchandise which requires extensive floor area in the I and I-L zone subject to a Conditional Use Permit. The proposed project provides a mix of commercial and industrial uses. The inclusion of these uses will assure substantial compatibility with the retail use designation of the General Plan. D. Identification of environmental effects 1. Traffic Circulation Preliminary traffic estimates indicate that the project will Generate approximately 5500 one-way auto trips per day city of chula vista planning department environmental review section (2) which has the potential to reduce the service level of the two lane portion of Palemar St. (west of the project site) from a level of service (LOS) C to (LOS) E which indicates a potentially significant traffic impact. E. Mitication necessary to avoid sicnificant effects The following are Engineering Dept. requirements necessary to mitigate adverse traffic circulation impacts: 1. Oxford Ave. should be constructed to accommodate two moving lanes of traffic between this project and Broadway. 2. Palemar Street must be widened to provide for four l~nes and a turn lane between Broadway and I-5. This will require some offsite improvements - the replacement or relocation of the existing railroad crossing on the north side of Palemar east of Industrial Blvd. and other minor widening. Staff will recommend to the City Council that the wideninq of Palemar Street between Industrial Blvd. and I-5 be included as a CIP project for FY81-82. 3. The engineer should be encouraged to line up a major driveway to the development from Palemar St. opposite the signalized entrace to the MTDB Trolley Station on the south side of the street. The number of driveways should on Palemar St. (4) should be reduced to 3 to minimize conflict points along this heavily used arterial street. F. FindinGs of insignificant effect 1. There are no significant natural or man-made resources within the project area which could be adversely effected by project implementation. 2. The proposed prezoning, annexation, detachment and development is in conformance with the General Plan and will not achieve short term to the disadvantage of long term environmental goals. 3. All potential impacts can be mitigated and none are anticipated to interact and cause any cumulative effect on the environment. 4. PCZ-81~G RESOLUTION OF THE CITY PLANNING COMMISSION RECONMENDING TO THE CITY COUNCIL THE PREZONING OF APPROXIMATELY 18 ACRES LOCATED NORTH OF INDUSTRIAL BOULEVARD BETWEEN OXFORD AND PALOMAR STREETS TO C-C-P WHEREAS, annexation proceedings and development plans involving approximately 18 acres located north of Industrial Boulevard between Oxford and Palomar Streets necessitated prezoning the property, and WHEREAS, the City Planning Commission initiated action to prezone the property C-C, and set the time and place for a public hearing to consider said prezoning, and notice of said hearing, together with its purpose, was given by the publication in a newspaper of general circulation in the City at least lO days prior to the date of said hearing, and WHEREAS, a hearing was held at the time and place as advertised, namely 7:00 p.m., May 13, 1981, before the Planning Commission and said hearing was thereafter closed, and WHEREAS, the Planning Commission found that this action will have no signif- icant environmental impact and adopted the Negative Declaration on IS-81-21. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. From facts presented to the Commission, the Commission finds that public necessity, convenience, general welfare and good zoning practice support prezoning the property C-C-P (Central Commercial with Precise Plan Modifying District), sub- ject to the following precise plan guidelines: a. The westerly driveway shall be located in line with the driveway leading to the MTDB station. b. A coordinated sign program shall be submitted and will be subject to Planning Department approval. 2. Findings in support of applying the "P" Modifying District are as follows: a. The subject property, or the neighborhood area in which the property is located, is unique by virtue of topography, geological characteristics, access, configuration, traffic circulation, or some social or historic situation requiring special handling of the development on a precise plan basis: 0.~ The subject property is located on a "gateway" into the City of Chula Vista; the attachment of the "P" District will help insure that the development is in keeping with the goals and objectives of the Scenic Highway Element of the General Plan of the City of Chula Vista. b. The property or area to which the "P" Modifying District is applied is an area adjacent and contiguous to a zone allowing different land uses, and the development of a precise plan will allow the area so designated to coexist between land usages which might otherwise prove incompatible: The proximity of the property to the railroad tracks, the MTDB station on the south side of Palomar, and the future light industrial area to the east of the MTDB station, together with the projected increase in traffic on Palomar, require careful control of access points on Palomar Street; this can best be accomplished by the attachment of the "P" Modi~Hng District. 3. The Planning Commission recommends to the City Council that said prezoning to C-C-P be approved. 4. That this resolution be transmitted to the City Council and a copy transmitted to the owner of the property. The Council certified that the Negative Declaration (IS-81-21) was prepared in accord- ance with the California Environmental Quality Act of 1970 and prezoned the property to C-C-P in accordance with Planning Commission Resolution No. PCZ-81-G. Copies of the ordinance are available at the office of the City Clerk, City Hall, 276 Fourth Avenue, Chula Vista.
