The owners of certain properties along the portion of Las Flores Drive
north of "D" Street have applied for an uncontrolled embankment permit
to place fill material upon their property so that they may develop the
area for residential use. It is my
RECOMMENDATION: That the City Council approve the subject agreements
and authorize the Mayor to execute said agreements on behalf of the
City of Chula Vista.

In May of this year a plan was submitted to this department to place
uncontrolled fill on three separate properties along the proposed
extension of Las Flores Drive north of "D" Street. The intention of
the applicants is to acquire enough fill material to create developable
lots. As a joint venture, several of the property owners along the
subject portion of Las Flores Drive have submitted a tentative map to
the City for processing to provide for subdivision and development of
the properties. The level of the land must be raised. It is proposed
to stockpile approximately 10,000 cubic yards of fill on three separate
properties in the area. The fill will then be graded in accordance
with a separate final grading plan at a future date.

Not applicable.
DISCUSSION:
The City recently completed installation of an 8-inch sewer main in the
subject portion of Las Flores Drive. There are no other utilities at
this time.
periodic inspections by the Engineering Department will be made to
ensure that the fill is in compliance with the approved plan.
Section 15.04.335 of the Municipal Code provides for the placing of
uncompacted soil on private property. However, the owner must enter
into an agreement with the City. The proposed agreement includes the
following conditions:
1. A land development permit must be obtained by the owner from the
Engineering Department. Such permit will be accompanied by a
~rading plan approved by the Ci~y Engineer.
2. The owner 'acknowledges that he is not' eligible to obtain a
building permit to construct upon the uncontrolled fill site.

3. The site shall be maintained in a safe and sanitary manner at the
sole cost and risk of the owner and his successors in interest,
who shall hold the City harmless with respect thereto.
4. The applicants must provide the City with a bond in the amount of
$3,100.00 and the bond shall be maintained on file throughout the
life of the permit. This bond is to guarantee the installation
and maintenance of the siltation basins and to ensure maintenance
of the City's access to the sewer facilities.
The owners of the properties on which the fill is to be placed have
executed the appropriate agreements, which are now ready for approval
on behalf of the City.
I propose to limit the permit life to one year. After that time, if
necessary, the permittee may request extension of the permit.
According to Section 15.04.035, the permit may be extended for a period
not to exceed the original length of time designated on the permit.
Approval of the extension of time will depend upon how the job site is
being maintained.
The applicants have processed an Initial Study (I.S. 81-5) through the
Environmental Review Section of the Planning Department. A Negative
Declaration was issued on August 25, 1980.
