A. BACKGROUND
1. The Planning Commission and City Council recently approved a 109 unit subdivision
map for Chula Vista Tract 80-21, Bonita Centre East, requiring the developer to devote a
ml nlmum of 11 uni ts on or off site to se 11 a t a pri ce affordable by modera te income
families. As an alternative the' City'Council provided that the payment of fees in lieu
of construction would also be acceptable.
2. On September 23, 1980 the City Council considered the Gateway Townhouses tenta-
tive map at 1-805 and Bonita Road and the Gersten rezoning at Telegraph Canyon Road and
Nacion. Council voted 4:1 to delete any inclusionary housing requirement until such
time as Council has studied the matter further and officially adopted a provision for
such housing. Council also implied that earlier approvals which were subject to inclu-
sionary housing conditions could seek relief from same.
3. As a result of Council's latest action, the developer of Bonita Centre East is
requesting that the previously imposed condition requiring 11 moderate income units be
deleted.
B. RECOMMENDATION:
Concur with Planning Commission recommendation.
C. PLANNINGCOMMISS ION RECOMMENDA nON:
On October 22, 1980 the Planning Commission, by a vote of 6-1,:Tecommended that
the City Council delete the condition for moderate income units in accordance with the
Addendum to Resolution PCS-80-21.
D. ANALYSIS
1. The requirement to make l'l units available for moderate income families or to
pay a fee was based on previous Counci'l interest in inclusionary housing programs. How-
ever, Council's action of September 23rd to delete the requirement for inclusionary units
in two separate cases clarifies the policy in this area. Therefore, I am recommending
that the requirement previously imposed on this subdivision be deleted and the finding
of conformance with the Housing Element be modified to reflect present Council policy.
2. The presently adopted Housing Element of the General Plan does not require a
developer to provide affordable housing units. It simply requires him to "address the
need" to do so. The applicant's letter of May 15, 1980 (copy enclosed) indicates that
he has "addressed the need" so that a finding of co~formaQce with the. Housing Element
can be made.
