(4/5ths Vote: Yes___ No~) SUBMITTED BY: City Engineer Morgan-Gardner has completed the public improvements for Morgan-Gardner subdivision except for driveway approaches and service roads for Lot 58. An agreement has been prepared deferring certain improvements not constructed and guaranteeing the construction of them pending approval of a proposed condominium subdivision map. It is my RECOMMENDATION: That Council adopt resolution accepting the public improvements for Morgan-Gardner Subdivision and approving the agreement for completion of certain improvements on Lot 58. BOARD/COMMISSION RECOMMENDATION: Not applicable. DISCUSSION: On July 31, 1980, City Engineering staff made a final inspection of the public improvements in Morgan-Gardner Subdivision. On August 8, 1980, a letter was prepared outlining deficiencies to be corrected prior to our recommending acceptance of the improvements by the City Council. All requirements except for certain improvements on Lot 58 have been completed to the satisfaction of the City Engineer. A maintenance bond in the amount of $48,300.00 has been posted with the City to guarantee the public improvements, as to material and workmanship, for one year after acceptance by the Council. At the time of construction of the curbs and sidewalk adjacent to Lot 58 on-Flower Street, the developer chose not to install driveway approaches to City sewer and drainage easements crossing Lot 58, and the paved service roads within the easements as required on the improvement plans. The reason for not installing the improvements in Lot 58 is that Morgan-Gardner is proposing a resubdivision of Lot 57 and 58 for condominiums and the developer' does not want to install improvements that will be removed if the condominium project is approved. On September 23, 1980, City Council approved the tentati~e.map for Gateway Townhouses consisting of two lots and 2?9.condomlnlums. The final map is presently being processed. A condltlon of approval of the final subdivision map will be for the developer to provide an all weather access to the sewer and drainage facility in Lot 58. The attached agreement provides that in the event the Gateway Townhouses are not constructed, Morgan-Gardner .will construct the driveways as required and pave service roads to the sewer and drainage facilities.. A faithful performance bond in the amount of $11,500 and a material and labor bond in the amount of $5,750.00 has been posted as surety as a guarantee of construction. I believe that the City's interest is protected by the agreement. Also, by requiring a developer to install improvements that will be removed soon, is an unnecessary hardship.
