AN ORDINANCE OF THE CITY OF CHULA VISTA AMENDING
ZONING MAP OR MAPS ESTABLISHED BY SECTION 19.18.010
OF THE CHULA VISTA CODE REZONING 19 ACRES ON BOTH
SIDE OF BRANDYWINE AVENUE, NORTH OF OTAY VALLEY
ROAD, FROM R-1-H TO I-L-P
WHEREAS, the Environmental Impact Report, EIR-80-7, on
this project has heretofore been certified by the City Council on
February 3, 1981.
The City Council of the City of Chula Vista does ordain
as follows:
SECTION I: That the Zoning Map or Maps established by
Section 19.18,010 of the Chula Vista Municipal Code be, hereby
amended by adding thereto the following zoning changes:
That that certain proeperty consisting of approximately
19 acres located on the east and west side of Brandywine
Avenue north of Otay Valley Road be, and the same is
hereby rezoned from R-1-H to I-L-P in accordance with
Planning Commission Resolution No. PCZ-80-F, adopted on
the 25th day of February, 1981
pursuant to the provisions set forth in Section 19.12,020 govern-
ing the rezoning of property.
SECTION II: That any and all ordinances heretofore
adopted by the City Council of the City of Chula Vista concerning
zoning of said property be, and the same are hereby rescinded
insofar as the provisions therein conflict with this ordinance.
SECTION III: This ordinance shall take effect and be in
full force and effect on the thirty-first day from and after its
adoption.

RESOLUTION NO. PCZ-80-F
RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE
CITY COUNCIL THE CHANGE OF ZONE FOR 19 ACRES ON BOTH SIDES OF
BRANDYWINE AVENUE, NORTH OF OTAY VALLEY ROAD, FROM R-1-H TO I-L-P
WHEREAS, a duly verified application for rezoning approximately 19 acres
of property located on the east and west sides of Brandywine Avenue, north of
Otay Valley Road, was filed with the Planning Department by Jimmie Shinohara and
Helen H. Cushman on April 7, 1980, and
WHEREAS, said application requested that the property be rezoned from R-1-H
to I-L, and
WHEREAS, Resolution No. 10387, adopted by the City Council on February 3,
1981, amended the Chula V$~ta General Plan to change the designation of the 19
acres from Medium Density Residential to Research and Limited Industrial, and
WHEREAS, an environmental impact report, EIR-80-7, on the proposed project
was certified by the City Planning Commission and the City Council, and
WItEREAS, the City Planning Commission set the time and place for a public
hearing on said rezoning application and notice of said hearing, together with
its purpose, was given by publication in a newspaper of general circulation in
the city at least lO days prior to the date of said hearing, and
WHEREAS, a hearing was held at the time and place as advertised, namely
7:00 p.m., on February 25, 1981, in the Council Chambers, 276 Fourth Avenue, before
the Planning Commission and said hearing was thereafter closed.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. From facts presented to the Commission, the Commission finds that public
necessity, convenience, general welfare and good zoning practice require the
change of zone of approximately 19 acres located on the east and west sides of
Brandywine Avenue, north of Otay Valley Road, from R-1-H to I-L-P, subject to the
following precise plan guidelines:
a. Unless jointly subdivided, the two parcels on the west side of
Brandywine Avenue shall be either consolidated or the common
property line between the two parcels adjusted to provide adequate
access to the westerly lot. The adequacy of said access shall be
determined by the Director of Planning and the Traffic Engineer.
O"~ b. A 125 foot wide building setback shall be maintained on each side
r~ of the center line of the La Nacion fault unless evidence is
~ presented which would indicate that said width may be reduced.
c. Contour grading shall be utilized dn concert with landscaping and
berming to buffer the adjacent residential areas from the industrial
uses. Industrial building heights shall be limited and set back
from the residential area to insure compatibility.
d. Timber Street, east of Oleander Avenue, shall be completed with
permanent improvements subject to the approval of the City
Engineer.
2. Findings in support of the application of the "P" Modifying District
are as follows:
a. The property or area to which the "P" Modifying District is applied
is an area adjacent and continguous to a .zone allowing different
land uses, and the development of a precise plan will allow the
area so designated to co-exist between land usages which might
otherwise prove incompatible:
The subject properties are contiguous to single family areas
on the north and west. The attachment of the "P" Modifying
District will permit the development of guidelines to insure
compatibility between the uses.
b. The area to which the "P" Modifying District is applied consists
of two or more properties under separate ownership wherein coordin-
ation regarding access, onsite circulation, site planning, building
design and identification is necessary to enhance the public conven-
ience, health, safety and general welfare:
The area under consideration is held under multiple ownership
and one lot is a panhandle parcel with only 13 feet of street
frontage. The attachment of the "P" District will require that
these properties be consolidated or adequate access provided
to the major portion of the panhandle lot.
3. The Planning Commission recommends to the City Council that said change
of zone to I-L-P be approved.
4. That this resolution be transmitted to the City Council and a copy be
sent to the applicant.

By a unanimous vote on April 7, 1981, the City
Council placed the ordinance on its second
reading and adoption rezoning the 19 acres to
I-L-P in accordance with Planning Commission
Resolution PCZ-80-F.
Copies of the ordinance are available at the office
of the City Clerk, City Hall, 276 Fourth Avenue,
Chula Vista.
