CITY OF . ~~ CHULA VISTA 01/26/2010 Item~ ITEM TITLE: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ACCEPTING $7,000 FROM THE UNITED STATES MARSHALS SERVICE AND APPROPRIATING SAID FUNDS TO THE FISCAL YEAR 2010 POLICE DEPARTMENT BUDGET FOR THE FUGITIVE TASK FORCE (l.,./ CHIEF OF POL~~d:~ 0 CITY MANAG 4/5THS VOTE: YES X NO SUBMITTED BY: REVIEWED BY: SUMMARY As a participating agency of the San Diego Fugitive Task Force, the United States Marshals Service (USMS) has allocated $7,000 to the Police Department for approved equipment services, training or supplies directly related to the task force. ENVIRONMENTAL REVIEW This proposed activity has been reviewed for compliance with the California Environmental Quality Act (CEQA) and it has been determined that the activity is not a "Project" as defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is necessary. RECOMMENDATION Council adopt the resolution. BOARDS/COMI\HSSION RECOMMENDATION Not Applicable. 8-1 01/26/2010, !tem1 Page 2 of2 DISCUSSION-----:--~.. Since 2003, the Police Department has assigned one detective to the San Diego Regional Fugitive Task Force, which is coordinated by the U.S. Marshals Service (USMS). The Asset Forfeiture-Fund 'of the U.S. Department of-Justice reimburses state and local agencies for costs relating to USMS sponsored fugitive task forces. The primary mission of the task force is to investigate and arrest, as part of joint law enforcement operations, persons who have active state and federal warrants for their arrest. The intent of the joint effort is to investigate and apprehend local, state and federal fugitives, thereby improving public safety and reducing violent crime. The Police Department has been allocated $7,000 of funding to be used for approved equipment, services, training and supplies directly related to the support of the San Diego Fugitive Task Force. Expenditures will be pre-approved by the Task Force Coordinator. This funding is separate and apart from any previously agreed funding for overtime, vehicles, fuel or vehicle expenses. DECISION MAKER CONFLICT Staff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently the 500 foot rule found in California Code of Regulations section 18704.2(a)(l) is not applicable to this decision. CURRENT YEAR FISCAL IMP ACT Approval of this resolution will result in the one-time appropriation of $7,000 to the supplies and services budget of the Police Department. The funding from the United States Marshals Service will completely offset these costs, resulting in no net fiscal impact to the General Fund. NOW, THEREFORE, BE IT RESOLVED the City Council of the City of Chula Vista does hereby accept $7,000 from the United States Marshals Service and appropriate said funds to the fiscal year 2010 Police Department supplies and services budget.
