HomeMy WebLinkAboutOrd 1985-2115 ORDINANCE NO.2115 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AMENDING CHULA VISTA MUNICIPAL CODE SECTION 2.05.020 REQUIRING FINGERPRINTING OF DRIVERS OF PUBLIC TRANSPORTATION SYSTEMS OPERATED FOR THE CITY OF CHULA VISTA The City Council of the City of Chula Vista hereby finds and determines as follows: WHEREAS, the City of Chula Vista provides local public transportation services through Chula Vista Transit and HandYtrans, and WHEREAS, the operation of Chula Vista Transit is provided pursuant to a contract between the City of Chula Vista and the South Coast Organization Operating Transit, and WHEREAS, South Coast Organization Operating Transit has contracted with a private company for the operation of Chula Vista Transit, and WHEREAS, the City of Chula Vista has contracted with a private company for the operation of HandYtrans, and WHEREAS, the City Council of the City of Chula Vista desires to ensure that the drivers of the local public transportation system will provide safe and competent service to the citizens of Chula Vista, and WHEREAS, City of Chula Vista employees are required to be fingerprinted to determine if the applicant has a prior criminal history, and WHEREAS, the City Council of the City of Chula Vista has determined that transit drivers providing local public transportation service for the City should also be fingerprinted and "screened", and WHEREAS, Section 11105 of the Penal Code requires that the local legislative body adopt by ordinance any requirement for the fingerprinting of prospective applicants, and WHEREAS, the South Coast Organization Operating Transit has awarded a contract to Community Transit Services, Inc. who is in the process of hiring drivers for the Chula Vista Transit System. -1- NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CHULA VISTA ORDAINS AS FOLLOWS: SECTION I: That Section 2.05.020 of the Chula Vista Municipal Code be, and the same is hereby amended to add a new subsection F to read as follows: F. Pursuant to Section 11105 of the Penal Code of the State of California, the City Council of the City of Chula Vista hereby authorizes the City Manager to have access and to utilize state summary criminal history information as a requirement for driving in the local public transportation service of Chula Vista Transit and HandYtrans. SECTION II: This ordinance is hereby declared to be an urgency ordinance to protect the public health, safety and welfare and shall take effect immediately upon its adoption. The facts constituting said urgency are set forth hereinabove and represent a concern of the City Council that drivers in the local transit system of the City be required to undergo the same screening process as City employees. The drivers of the Chula Vista Transit system provide a service to the citizens of Chula Vista which must not be compromised by the hiring of inappropriate personnel. This ordinance shall become effective upon its first reading and adoption if passed by at least four (4) affirmative votes of the City Council as an emergency measure.
