SUMMARY
California voters passed Proposition 84 (Safe Drinking Water, Water Quality and Supply, Flood
Control, River and Coastal Protection Bond Act of2006) on November 7, 2006. Funding for this
$368 million grant program was made available through the Sustainable Communities and
Climate Change Reduction chapter within Proposition 84 (Public Resources Code Division 43,
Chapter 9, Section 75065 (b) (1-5)). This program awards grants on a competitive basis for the
creation of new parks and new recreation opportunities in proximity to the most critically
underserved communities across California.
The State Department of Parks and Recreation has been delegated the responsibility by the
Legislature of the State of California for the administration of the Statewide Park Program,
establishing the necessary procedures governing the Application. Said procedures established by
the State Department of Parks and Recreation require the applicant to certify by resolution the
approval of application before submission of said application to the State. The City proposes to
apply for State Park Program grant funding and has identified one location, Orange A venue
Library Park site. If approved, the City will enter into a contract with the State of California to
complete the grant scope project at which time staff will return to Council for approval of
contract and appropriation of funds to the project. Staff requests approval to file an application
for the Orange Avenue Library Park site and requests authority to Director of Public Works to
conduct all negotiations, sign and submit all documents, including, but not limited to
applications, agreements, amendments, and payment requests, which may be necessary for the
completion of the grant scope.

ENVIRONMENTAL REVIEW
The Environmental Review Coordinator has reviewed the proposed project for compliance with
the California Environmental Quality Act (CEQA) and has determined that the project qualifies
for a Class 25 (I) categorical exemption [Acquisition, sale, or other transfer to preserve open
space or lands for park purposes] pursuant to Section 15325 (Transfers of Ownership of Interest
in Land to Preserve Natural Conditions) and a Class 4 (b) categorical exemption [New gardening
or landscaping] pursuant to Section 15304 (Minor Alterations to Land) of the Sate CEQA
Guidelines. Thus, no further environmental review is necessary.
RECOMMENDA nON
Council adopt the resolution.

DISCUSSION
Proposition 84 - Statewide Park Development and Community Revitalization Act of 2008
(Statewide Park Program) provides grant funding for the creation of new parks and recreation
opportunities in underserved communities in California.
This competitive program was created by Assembly Bill 31 Chapter 623, Statues of 2008. There
will be two rounds awarding $368 million to critically underserved communities across
California. As of July 1,2009, the 2009/10 Budget Act appropriated $184 million for the first
competitive round. The applications for the first round must be postmarked or hand delivered to
the State of California Department of Parks and Recreation Office of Grants and Local Services
(OGALS).
The release of the final application guide and letter of application deadline was received by the
City of Chula Vista on September I, 2009. Eligible applicants include cities, counties, districts,
joint powers authorities and non-profits. Partnerships are encouraged between two or more
agencies. The minimum grant request is $100,000 and the maximum grant request is $5,000,000
with no match required.
The Statewide Park Program requires projects to meet six eligibility requirements. Projects
calUlot be funded unless all six requirements are met. A point system is has been established
which awards points for meeting each of the eligibility requirements. Public Works Engineering
staff has been working diligently with other City departments to determine potential candidate
projects to submit that meets the six project eligibility requirements. The project requirements

Staff attended a Technical Assistance Warkshap an Thursday, Navember 19,2009 to. get a better
understanding afthc eligibility requirements and gain insight an haw best to. maximizc paints.
The Project Develapment Team (PDT), which cansists 0.1' staff from Develapment Services,
Public Warks Engineering/Operatians and Recreatian, met several times to. discuss patential park
sites. After entering the project data into. the criteria matrix, the Orange Avcnue Library Park
sitc met all the eligibility requiremcnts and had the mast patential far the highest paints. Staff is
also. warking with the Canservatian scctian to. ensure the Land Tenure agreements (with
SDG&E) are met.

Pubhc Works Engineering/Operations and Recreation, met several times to discuss potential park
sites. After entering the project data into the criteria matrix, the Orange Avenue Library Park
site met all the eligibility requirements and had the most potential for the highest points. Staff is
also working with the Conservation section to ensure the Land Tenure agreements (with
SDG&E) are met.
It is staffs intent to submit an application for the Orange Avenue Library Park site. Several
community workshops/outreach efforts have been held and facilitated by city staff for the
purpose of educating the community of tlm park project and for gathering community input into
the design of the parle The workshops with the Southwest Civic Association community group
have resulted in dynamic and interactive group participation. Park programming has been
discussed and opportunities and constraints of the park site identitled for the residents and
community leaders. In addition to community workshops, staff has made a presentation to the
Parks and Recreation Commission. The Commission provided favorable comments on the park
design and expressed their pleasure that a new park was being planned for western Chula Vista.
Due to limited resources and time constraints, other possible locations are currently being
considered and evaluated by the PDT for round two, which will award the remaining
$184,000,000. The deadline for round two has not yet been determined but it is anticipated to be
some time in 2011.
DECISION MAKER CONFLICT
Staff has reviewed the property holdings of the City Council and has found no property holdings
within 500 feet of the boundaries of the properties, which is the subject of this action.
FISCAL IMPACT
There is no impact to the General Fund. If the resolution is approved, the City will apply for
Statewide Park Program grant funds. If a grant is awarded, staff will retum to Council to
approve a contract with the State of Califomia and recommend accepting and appropriate the
grant funds into the Capital Improvement Program.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA APPROVING THE APPLICATION FOR
STATEWIDE PARK PROGRAM GRANT FUNDS
WHEREAS, the State Department of Parks and Recreation has been delegated the
responsibility by the Legislature of the State of California for the administration of the Statewide
Park Program, setting up necessary procedures governing the Application; and
WHEREAS, said procedures established by the State Department of Parks and
Recreation require the applicant to certify by resolution the approval of application(s) before
submission of said application(s) to the State; and
HEREAS, the applicant will enter into a contract with the State of California to complete
the grant scope project; and
WHEREAS, it is staffs intent to submit an application for the Orange Avenue Library
Park site; and
NOW, THEREFORE, BE IT RESOLVED that the City of Chula Vista does hereby:
1. Approve the filing of an application for the Orange A venue Library Park Site, and
2 Certifiy that said applicant has or will have available, prior to commencement of any
work on the project included in this application, the sufficient funds to complete the project; and
Certifies that the applicant has or will have sufficient funds to operate and maintain the
project(s), and
3, Certifiy that the applicant has reviewed, understands, and agrees to the General
Provisions contained in the contract shown in the Grant Administration Guide; and
4. Delegate the authority to Director of Public Works to conduct all negotiations, sign
and submit all documents, including, but not limited to applications, agreements, amendments,
and payment requests, which may be necessary for the completion of the grant scope; and
5. Agree to comply with all applicable federal, state and local laws, ordinances, rules,
regulations and guidelines.
