SUMMARY
On November 18, 2009, the Director of Public Works received seven (7) sealed bids for the "Traffic
Signal Modification at the intersections of Fourth Avenue/Main Street and Fourth AvenueBeyer
Way in the City of Chula Vista, California (TF-330)" project. The project is included in the
FY2009/FY2010 Capital Improvement Program budget to upgrade and repair existing traffic signal
equipment at these two intersections in order to assure optimal signal operations, to update the
signal systems to current City standards, to lengthen the service life of the traffic signals, and to
reduce operation and maintenance costs.
ENVIRONMENTAL REVIEW
The Environmental Review Coordinator has reviewed the proposed project for compliance with
the California Environmental Quality Act (CEQA) and has determined that the project qualifies
for a Class 1 Categorical Exemption pursuant to Section 15302 (Existing Facilities) of the State
CEQA Guidelines because the proposed traffic signal modification work and pedestrian ramp
construction involves negligible or no expansion of an existing use. Thus, no further
environmental review is necessary.
RECOMMENDATION
Council adopt the resolution.

DISCUSSION
On November 18, 2009, the Director of Public Works received seven (7) sealed bids for the
"Traffic Signal Modification at the Intersections of Fourth Avenue/Main Street and Fourth
Avenue/Beyer Way in the City of Chula Vista, California (TF-330)" project. In addition to the
signal work identified above, the project includes pedestrian ramps, sidewalk, curb, gutter,
pavement, striping and removal of an existing and obsolete advance warning standard, mast arm,
and beacon on Fourth Avenue approximately 550 north of Beyer Way.
City staff first advertised the project on February 6, 2009. The advertisement was subsequently
canceled when it was determined that the project was a "shovel ready" project eligible for
funding under the American Recovery and Reinvestment Act (ARRA).
Under the American Recovery and Reinvestment Act (ARRA) of 2009, administered by the
Federal Government, a portion of the overall funding was allotted to highway infrastructure
improvements and maintenance. A percentage of the State of California's share was distributed
through regional planning agencies, such as the San Diego Association of Governments
(SANDAG); SANDAG, in turn, set aside and distributed 40% of the monies to local agencies.
In order to avoid having to implement federal requirements on local projects and to simplify and
expedite the use and expenditure of ARRA funds to achieve economic stimulus, SANDAG chose
to use all received ARRA funds on a few large regional projects already subject to federal
requirements and to reallocate previously-appropriated TransNet funds in those projects to local
agencies.
The City of Chula Vista received $3.36 million of these reallocated TransNet funds (TransNet
ARRA) for use on highway infrastructure projects within the city. The funds received may only
be used on projects and programs previously approved under the Regional Transportation
Program (RTIP); Chula Vista's RTIP was amended by the City Council in May 2009. The
traffic signal repair and upgrade project and contract, which are the subjects of the proposed
action, are fully funded using these TransNet ARRA funds.
City staff re-advertised the project on October 30, 2009 and received seven (7) bids on
November 18, 2009. The following table summarizes the bids received:

The low bid by T & M Electric, Inc, dba Perry Electric is below the Engineer's estimate of
$382,251 by $120,332, or approximately 32%. T & M Electric has installed traffic signal
projects in the City with satisfactory performance. Staff has reviewed the contractor's bid
package and recommends awarding the contract to T & M Electric, Inc, dba Perry Electric of
Santee, CA, for $261,919.
Also for consideration is the authority of the Director of Public Works to approve change orders
over and above existing policy limits. Under City Council Policy No. 574-01, if an individual
change order causes the cumulative increase in change orders to exceed the Director's authority
("Maximum Aggregate Increase in Change Orders"), then City Council approval is required.
The corresponding maximum aggregate contract increase that may be approved by the Director
of Public Works under Policy No. 574-01 is $21,334.33. Approval of the proposed resolution
would increase the Director of Public Works' authority to approve change orders, as necessary,
up to the contingency amount of $52,384, an increase of $31,049.67 over Policy No. 574-O1.
Increasing the contingency funds will allow staff to continue the project without delay should
unforeseen circumstances resulting in increased project costs arise during the course of
construction, as well as make adjustments to bid item quantities.

DECISION MAKER CONFLICT
Staff has reviewed the property holdings of the City Council and has found no property holdings
within 500 feet of the boundaries of the property, which is the subject of this action.
CURRENT FISCAL IMPACT
A breakdown of the project costs is as follows:

Sufficient funds are available in the TF330 project account to complete construction. The
construction expenditure will be funded from the Traffic Signal Funds and the Transnet ARRA
Exchange. Any remaining balance after Project completion shall be returned to the fund balance
for re-programming toward future Capital Improvement Projects.

ON-GOING FISCAL IMPACT
Upon completion of the project, the improvements will require only routine City street and
traffic signal maintenance.

WHEREAS, the low bid by T & M Electric, Inc, dba Perry Electric is below the
Engineer's estimate of $382,251 by $120,332, or approximately 32%. T & M Electric has
installed traffic signal projects in the City with satisfactory performance.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula
Vista does hereby accept bids and award the contract for the "Traffic Signal Modification at the
intersections of Fourth Avenue/Main Street and Fourth Avenue/Beyer Way in the City of Chula
Vista, California (TF-330)" project to T & M Electric, Inc. dba Perry Electric in the amount of
$261,919.00.
BE IT FURTHER RESOLVED, that the City Council of the City Of Chula does hereby
waive Council Policy 574-01 and authorize the Director of Public Works Operations to approve
change orders as necessary and expend all available funds in the project.
