HomeMy WebLinkAboutOrd 1984-2096 ORDINANCE NO. 2096 AN ORDINANCE OF THE CITY OF CHULA VISTA AMENDING SECTION 15.04.010 AND ADDING SECTION 15.04.092 RELATING TO MASS GRADING ON LARGE PROJECTS, TO TITLE 15 OF THE CHULA VISTA MUNICIPAL CODE The City Council of the City of Chula Vista does ordain as follows: SECTION I: That Section 15.04.010 is hereby amended to read as follows: 32. Mass Grading: The movement of earth in such a manner as to modify the general land form of an area so as to render it easily susceptible to rough grading of pads and streets. The creation of pads for building or streets shall not be included within this definition. SECTION II: That Chapter 15.04 of the Chula Vista Municipal Code be, and the same is hereby amended to add a new Section 15.04.092 to read as follows: Section 15.04.092 Mass Grading on Large Projects Prior to Approval of Tentative Map A. A developer may apply for a land development permit for mass grading of land which has an approved specific planning area plan and said project is in excess of 250 acres. This application shall be accompanied by detailed plans and specifications in conformity with the provisions of Section 15.04.040 through 15.04.075 of this chapter. Said mass grading land development permit shall be reviewed by the City Engineer who shall make a recommendation as to the appropriateness of said permit to the City Council. The decision by the City Council to either issue the permit or not issue the permit shall be final. B. The issuance of a mass grading land development permit requires compliance with the California Environmental Quality Act. In addition, said permit shall comply with the provisions of Section 15.04.095~_of this chapter.
