The work to be done consists of the installation of ADA pedestrian ramps and other concrete improvements at various locations within the southwest region of the City. The proposed actions would award the contract to ASAP General Engineering and authorize the Director of Public Works to expend all available funds in order to maximize the number of pedestrian ramps to be installed. ENVIRONMENTAL REVIEW The Environmental Review Coordinator has reviewed the proposed project for compliance with the National Environmental Policy Act (NEPA) and has determined that the project qualifies for a Categorical Exclusion (subject to 58.5) pursuant to Section 24 of the Code of Federal Regulations 58.35(a), subsection I [Acquisition, repair, improvement, reconstruction, or rehabilitation of public facilities & improvements; e.g. curbs, sidewalks, repaving streets] pursuant to Implementation Guidelines established by the U.S. Department of Housing and Urban Development (HUD). Additionally, the Environmental Review Coordinator has also reviewed the proposed project for compliance with the California Environmental Quahty Act (CEQA) and has determined that the project qualifies for a Class 1 categorical exemption pursuant to Section 15301 (c) [Existing Facilities] of the State CEQA Guidelines. Thus, no further environmental review is necessary. RECOMMEND A TlON COLlI1cd adopt the resolution. BOARDS/COMMISSION RECOMMENDA nON Not applicable. 8-1 12/15/09, ItemL Page 2 of 4 DISCUSSION The "ADA Curb Ramps FY 2008/2009 project" consists of the installation of ADA pedestrian ramps and associated improvements at various intersections in the City. The work will generally include some removal and replacement of displaced curbs, gutters, sidewalks and portions of cross gutters in order to assure compliance with current ADA standards for pedestrian ramp construction. The pedestrian ramp locations selected for this project were based on a comprehensive priority list that is maintainetl by the Public Works Department. Project Design staff prepared specifications and advertised the project. A map and list of each project location is shown in Attachment "I". On November 25, 2009, the Director of Public Works received twelve (12) bids for the "ADA Curb Ramps FY 2008/2009 (STL348)" eIP Project. The following bids were received (in order of lowest to highest bid amount): CONTRACTOR BID AMOUNT 1. ASAP General Engineering - Perris, CA $150,585.00 2. New Century Construction - Lakeside, CA $181,150.00 6. Pave Pros Construction - Chula Vista, CA $185,890.00 7. HT A Engineering & Construction - Poway, CA $187,700.00 8. Crest Equipment, Inc. - EI Cajon, CA $194,300.00 9. Heffler Company - National City, CA $195,000.00 10. HAR Construction - Chula Vista, CA $208,899.50 II. Scheidel Contracting & Engineering - La Mesa, CA $220,752.50 12. MJC Construction - National City, CA $280,900.00 The low bid submitted by ASAP General Engineering is below the Engineer's estimate of $210,000.00 by $59,415.00 (28% below the Engineer's estimate). The contractor has not worked on any projects for the City. Staff has contacted the Project Engineer for the last three construction projects that this contractor has performed for local agencies and has found that ASAP General Engineering has performed the work satisfactorily. The Contractor's License No. 903350 is current and active. Also for consideration is the authority of the Director of Public Works to approve change orders over and above existing policy limits. Under City Council Policy No. 574-01, if an individual change order causes the cumulative increase in change orders to exceed the Director's authority ("Maximum Aggregate Increase in Change Orders"), then City Council approval is required. The contract amount for the subject project is $150,585.00. The corresponding maximum aggregate contract increase that may be approved by the Director of Public Works under Policy No. 574-01 is $13,540.95. Approval of the proposed resolution would increase the Director of Public Works' authority to approve change orders, as necessary, up to the contingency amount of $93,415.00, an increase of $79,874.05 over Policy No. 574-01, in order to construct the maximum number of pedestrian ramps with available project funds (approximately 46 pedestrian ramps in addition to the scope of contract) and to address unforeseeable conditions that might arise during the course 0 t' construction, as well adj ustments to bid item quantities. Unforeseen 8-2 12/15/09, ItemL Page 3 of 4 conditions include such items as utility cont1icts, hazardous materials, unexpected underground cont1icts, etc. Locations of additional pedestrian ramps that wonld be constmcted with remaining available project funds are listed in Attachment 1. Minoritv Business Enterprise/Women Business Enterprise Goal The bill documents set forth participation requirements per Council Resolution 12113 and Federal Law for meeting the minority and women-owned goals. The low billller, ASAP General Engll1eering is listell in the State of Califomia's Disadvantaged Business Enterprise (DBE) database as a certified DBE firm. The City Attorney's Office has reviewed the bid documents and have concluded that the lowest bidder, ASAP General Engineering, meets the City's Minority and Women Business Enterprise (MBE/WBE) goals anll Federal Law. Staff also reviewed ASAP General Engineering eligibility status with regard to federal procurement programs and the status of the State Contractor's licenses. ASAP General Engineering - Perris, CA is not listed as excluded from Federal Procurement Programs (list of parties excluded from Federal procurement or non-procurement programs as of February 2007). Disclosure Statement Attachment 2 is a copy of the Contractor's Disclosure Statement. Wage Statement The source of funding for this project is Community Development Block Grant Funds. This project is coverell by the Davis-Bacon and related acts. The Davis-Bacon Act requires the payment of prevailing wage rates to all1aborers and mechanics employed for the work under this project. Prevailing wage rates are those detemlined by the U.S. Department of Labor or the U.S. Department of Housing and Urban Development. DECISION MAKER CONFLICT Staff has reviewed the property holdings of the City Council and has founll a cont1ict exists, in that Councilmember Bensoussan has property holdings within 500 feet of intersections that are the subject of this action. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby accept bids and award a contract for the "ADA Curb Ramps FY 2008/2009 (STL348)" to ASAP General Engineering in the amount of $150,585.00 and authorize the expenditure of all available funds in the project.
