HomeMy WebLinkAboutOrd 1983-2036 ORDINANCE NO. 2036 AN ORDINANCE OF THE CITY OF CHULA VISTA AMENDING SECTIONS 19.14.582 AND 19.14.583, REPEALING SECTION 19.14.585 OF CHAPTER 19.14 OF THE CHULA VISTA MUNICIPAL CODE TO PROVIDE FOR CONSOLIDATION OF THE DESIGN REVIEW COMMITTEE AND THE DESIGN REVIEW BOARD AND APPOINTMENT OF A NEW MEMBER The City Council of the City of Chula Vista does ordain as follows: SECTION I: That Sections 19.14.582 and 19.14.583 of Chapter 19.14 of the Chula Vista Municipal Code be, and the same are hereby amended to read as follows: Sec. 19.14.582 Design Review Committee - Duties and Responsibilities. A. The Design Review Committee shall review plans for the establishment, location, expansion or alteration of residential uses or structures in the R-3 zone, all development and redevelopment within the Rede- velopment Project boundaries, and multiple-family dwelling uses, commercial or industrial projects or structures governed by the P precise modifying district; and shall approve, conditionally approve or deny such plans except when projects are within the boundaries of a Redevelopment Project, the Committee shall recommend approval, conditional approval or denial to the Redevelopment Agency of the City of Chula Vista. The Committee shall render decisions on minor proposals as defined in Agency Resolution NO. 71. B. The Design Review Committee shall base its findings and action upon the provisions of the effected design manuals of the city. C. The DeSign Review Committee shall prepare and adopt operational procedures, bylaws and business forms. D. The Design Review Committee shall submit annual reports on its operations to the city planning commission and Redevelopment Agency. E. The fee for a hearing before the Design Review Committee is as presently designated, or as may in the future be amended, in the master fee schedule. -1- Sec. 19.14.583 Design Review Committee - Appeal Procedure. A. Except on decisions involving the Redevelopment Projects, the applicant or other interested persons may file an appeal from the decision of the Design Review Committee to the Planning Commission within ten working days after the decision is filed with the city clerk. Said appeal shalll be in writing and filed in triplicate with the Planning Department on forms prescribed for said appeal, and shall specify therein the argument against the decision of the Design Review Committee. If an appeal is filed within the time limit specified, it automaticaly stays proceedings in the matter until a determina- tion is made by the Planning Commission. All appeals regarding projects within Redevelopment Projects shall be filed with the Director of Community Development and forwarded to the Agency. B. Upon the hearing of such appeal, the Planning Commission may, by resolution, affirm, reverse or modify, in whole or in part, any determination of the Design Review Committee. The resolution must contain a finding of facts showing wherein the project meets or fails to meet the requirements of this chapter and the provisions of the Design Review Manual. C. The decision of the Planning Commission may be appealed to the City Council in the same manner as set forth in this section for appeals to the Planning Commission. SECTION II: That Section 19.14.584 of Chapter 19.14 of the Chula Vista Municipal Code shall be amended in the following manner to provide for a sixth member of the Design Review Committee for an interim period until the next vacancy occurs: A sixth member may be appointed to the Design Review Committee by a majority vote of the Council to serve from the time the Design Review Committee has merged with the Design Review Board until the first vacancy occurs at which time the membership shall revert to five. THIS SECTION SHALL BE UNCODIFIED AND THE TEXT OF THE PRESENT SECTION SHALL REMAIN UNCHANGED. SECTION III: That Section 19.14.585 of Chapter 19.14 be and the same is hereby repealed. DATED (seol) City Clerk CC-660 ORDINANCE 2036 AN ORDINANCE OF THE CITY OF CHULA VISTA A~ENDING SECTIONS 19.14.382 AND 19.14.383, REPEALING SECTION 19.14.383 OF CHAPTER 19.14 OF THE CHULA VISTA MUNICIPAL CODE TO PROVIDE FOR CONSOLIDATION OF THE DESIGN REVIEW COB~IITrEE AND THE DESIGN REVIEW BOARD AND APPOINTMENT OF A NEW MEMBER By a unanimous vote on June 21, 1983, the City Council placed the ordinance on second reading and adoption. The ordinance consolidates the Town Centre Design Review Board with the Chula Vista Design Review Committee. The Committee consists of six members, five of which currently serve on either committee and the sixth member now appointed by the City Council is Mr. Pat Judd. The implementation of the Committee would be to (1) designate the Design Review Committee as the official Design Review body for Redevelopmerit projects and (2) Clarify the appeals procedure for items involving Agency jurisdiction.
