HomeMy WebLinkAboutOrd 1983-2031 ORDINANCE NO. 2031 AN ORDINANCE OF THE CITY OF CHULA VISTA AMENDING SECTIONS 19.44.040 M AND 19.46.040 G OF THE CHULA VISTA MUNICIPAL CODE EXPANDING THE CATEGORY OF COMMERCIAL ACTIVITIES IN THE INDUSTRIAL ZONES The City Council of the City of Chula Vista does ordain as follows: SECTION I: That Section 19.44.040 M and 19.46.040 G of the Chula Vista Municipal Code be, and the same are hereby amended to read as follows: Sec. 19.44.040 Conditional Uses. M. Retail distribution centers and manufacturers' outlets which require extensive floor areas for the storage and display of merchandise, and the high- volume, warehouse-type sale of goods and, retail uses which are related to, and supportive of existing, on-site retail distribution centers or manufacturers' outlets. Conditional use permit applications for the establishment of retail commer- cial uses, covered by the provisions of this subsec- tion, shall be considered by the City Council subsequent to its receipt of recommendations thereon from the Planning Commission. Sec. 19.46.040 Conditional Uses. G. Retail distribution centers and manufacturers' outlets which require extensive floor areas for the storage and display of merchandise, and the high- volume, warehouse-type sale of goods and, retail uses which are related to, and supportive of existing, on-site retail distribution centers or manufacturers' outlets. PCA-83-3 RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE CITY COUNCIL THE ADOPTION OF AMENDMENTS TO SECTIONS 19.44.040 M AND 19.46.040 G OF THE MUNICIPAL CODE RELATED TO PERMITTED RETAIL USES WITHIN THE I AND I-L ZONES WHEREAS, in 1980, the I and I-L zoning regulations were amended by the inclusion of provisions which authorized the establishment of retail distribution centers and manufacturers' outlets by conditional use permit, and WHEREAS, the proposed amendmen~ would expand the category of commercial activities allowed in the industrial zones to those uses related to, and supportive of existing, on-site retail distribution centers or manufacturers' outlets, and provided that a conditional use permit was obtained in each case; and, WHEREAS, the Environmental Review Coordinator performed an Initial Study, IS-83-16, of possible adverse environmental impacts of the proposed amendments on February 3, 1983; concluded the said proposed amendments would not produce significant environmental effects; and, recommended the adoption of a Negative Declaration; and, WHEREAS, the City Planning Commission set the time and place for a public hearing to consider the proposed amendments; and, WHEREAS, a hearing was held at the set time and place, namely 7:00 p.m., March 9, 1983 in the Council Chambers, 276 Fourth Avenue, before the Planning Commission, and was thereafter closed; and, WHEREAS, the Planning Commission found that the proposed amendments will have no significant environmental impact and adopted the Negative Declaration on IS-83-16. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. From facts presented to the Planning Commission, the Commission finds that public necessity, convenience, general welfare, and good zoning practice support the following amendments to the zoning ordinance: a. 19.44.040 Conditional uses. M. Retail distribution centers and manufacturers' outlets which require extensive floor areas for the storage and display of merchandise, and the high-volume, warehouse-type sale of goods; and, retail uses which are related to, and supportive of existing, on-site retail distribution centers or manufacturers' outlets. Conditional use permit applications for the establish- ment of retail commercial sales uses, covered by the provisions of this subsection, shall be considered by the city council subsequent to its receipt of recommendations thereon from the planning commission. b. 19.46.040 Conditional uses. G. Retail distribution centers and manufactuers' outlets which require extensive floor areas for the storage and display of merchandise, and the high-volume, warehouse-type sale of goods; and, retail uses which are related to, and supportive of existing, on-site retail distribution centers or manufacturers' outlets. Conditional use permit applications for the establishment of retail commercial sales uses, covered by the provision of this subsection, shall be considered by the city council subsequent to its receipt of recommendations thereon from the planning commission. NOW, THEREFORE, BE IT FURTHER RESOLVED THAT: The Planning Commission recommends to the City Council that said amendments be adopted, and that this resolution be transmitted to the City Council. Under this amendment, retail stores and shops would be permitted within the I and I-L Zones provided: (1) such uses were related to and supportive of existing, onsite retail distribution centers or manufacturers' outlets, and (2) a conditional use permit was obtained in each case.
