HomeMy WebLinkAboutOrd 1983-2028 ORDINANCE NO. 2028 AN ORDINANCE OF THE CITY OF CHULA VISTA REPEALING ORDINANCE NO. 1902, AND ADOPTING SECTIONS 15.36.010 THROUGH 15.36.080 OF THE CHULA VISTA MUNICIPAL CODE, ALL RELATING TO THE UNIFORM FIRE CODE The City Council of the City of Chula Vista does hereby ordain as fo 11 ows: SECTION I: That Ordinance No. 1902 be, and is hereby repealed. SECTION II: That Sections 15,36.010 through 15.36.080 of Chapter 15.36 of the Chula Vista Municipal Code shall be amended to read as follows: Sec. 15.36.010 Uniform Fire Code, 1982 Edition; Adopted by Reference. There is hereby adopted by reference that certain document known and designated as the Uniform Fire Code and the Appendix thereto, 1982 Edition, as compiled and published by the International Conference of Building Officials and the Western Fire Chiefs' Association, three (3) copies of which are on file in the office of the City Clerk. Said document is hereby adopted prescribing regulations governing conditions hazardous to life and property from fire or explosion, and each and all such regulations, pro- visions, penalties, conditions and terms of said Uniform Fire Code are hereby referred to, adopted and made a part hereof as though fully set forth herein, excepting such portions as are hereinafter deleted, modified or amended. Sec. 15.36.020. Definitions. Administrator. Whenever the word "administrator" is used in the Uniform Fire Code, it shall be held to mean City Manager. Sec. 15,36.030. Additions and/or Deletions. There is hereby added to the Uniform Fire Code, 1982 Edition, the following amendments to read as set forth in Sections 15.36.040 through 15.36.080. Sec. 15.36.040. Section 2.105 amended - Authority. ARTICLE 2, SECTION 2.105 IS AMENDED TO READ AS FOLLOWS: Sec. 2.105 Authority. The Chief and all members of the department shall have the powers of a police officer while performing their duties under this ordinance. Sec. 15.36.050. Section 10.307(a) amended - Fire Alarm Systems. ARTICLE 10, SECTION 10.301, SUBSECTIONS (f) AND (g) BE AND THE SAME IS HEREBY AMENDED AS FOLLOWS: Sec. 10.301 (f). Installation of Fire Hydrants. Fire hydrants, where required in all subdivisions, apartment complexes, commercial developments, etc., shall be installed in an operable condition prior to any combustible construction material being placed on the site. Sec. lO.301(g). Stop Orders. Whenever a~ combustible ~terial is placed on the site or any work is being done contrary to the provisions of this code, the Chief may order the said material removed from the site or the work stopped by notice in writing served on the owner or agent, and any such persons shall forthwith comply with said notice until authorized by the Chief to proceed. Sec. 15.36.60. Section 10.307(e) added - Sale or Installation. ARTICLE 10, SECTION 10.307 IS AMENDED BY ADDING A NEW SUBSECTION (e) TO READ AS FOLLOWS: Sec. 10.307(e). Sale or Installation. No person shall sell, offer for sale or install any fire alarm signaling device or system without first having obtained a permit from the Bureau of Fire Prevention. Such device or system shall be approved by a nationally recognized testing laboratory having reexamination and labeling service and bears the label Decalcamania, or other evidence of approval by such testing authority. Sec. 15.36.70. Section 10.307(f) added - Bond Required. ARTICLE 10, SECTION 10.307 IS AMENDED BY ADDING A NEW SUBSECTION (f) TO READ AS FOLLOWS: Sec. 10.307(f). Bond Required. No person shall sell or solicit the sale or installation of any fire alarm signaling system or device designated or intended to indicate a fire emergency without first having filed with the Finance Officer of the City a surety bond in favor of the City in the amount of $1,000, which bond shall be approved as to form by the City Attorney. The condition of said bond shall be that any person injured by any misrepresentation or fraud or breach of contract of the principal acting in the course and scope of his occupation or business, or by any officer, agency or employee of said principal acting in the course and scope of his employment or agency, may recover against said bonds damages occasioned by such injury. Said bond shall be held for a period of one year following notification to the Finance Director of the City of Chula Vista that Seller is no longer engaged in the sale of any fire alarm signaling device or system. Sec. 15.36.80 Section 10.307(g) added - Applicability. ARTICLE lO, SECTION 10.307 IS AMENDED BY ADDING A NEW SUBSECTION (g) TO READ AS FOLLOWS: Sec. 10.307(g). Applicability. The provisions of this section shall not apply to fire alarm signaling systems installed as an integral part of any approved automatic fire extinguishing system or any approved fire alarm signaling system designed or installed as required by the building laws of the City and the Health and Safety Code of the State or which are otherwise specifically authorized by a building permit. SECTION III: This ordinance shall take effect and be in full force on the thirty-first day from and after its passage and approval. The 1982 Edition presents 9reater clarification with signi. fi~cant changes in Article 85 which applies to the permanent or temporary use of electrical appliances, fixtures, motors or wiring. Further changes are made in Article 86 as it applies to both inside and outside storage of all pesticides in portable containers and in Appendix III-C which governs the requirements for the installation, use and maintenance of all fire alarm systems in all occupancies.
