HomeMy WebLinkAboutOrd 1986-2148 ORDINANCE NO. 2148 AN EMERGENCY ORDINANCE OF THE CITY OF CHULA VISTA ADDING SECTION 19.24.030H TO THE CHULA VISTA MUNICIPAL CODE ALLOWING DESIGNER SHOWCASE 1986 TO BE CONDUCTED AS AN ACCESSORY USE IN AN R-1 RESIDENTIAL ZONE. FROM APRIL 24 TO MAY 26, 1986 WHEREAS, in accordance with Section 200 of the Charter of the City of Chula Vista, the City Council shall have the power to make and enforce all laws and regulations in respect to municipal affairs, and WHEREAS, the City Council may pursuant to Section 311(d) of the City Charter declare an emergency ordinance for preserving the public peace, health, safety or welfare of the public, and WHEREAS, the proposed Designer Showcase would preserve the general welfare of the public by bringing prestige to the community, favorable publicity to the City, and open historical homes for public viewing, and WHEREAS, Designer Showcase 1986 is an event currently not specifically regulated by the City of Chula Vista's Municipal Code, and WHEREAS, an emergency ordinance is required to authorize the Historical Society's Designer Showcase from April 24 to May 26, 1986, and would provide adequate control mechanisms to be imposed, and WHEREAS, the Environmental Review Coordinator has determined that the proposed amendment to the Chula Vista Municipal Code is exempt from environmental review as Class 4(e) exemption. The City Council of the City of Chula Vista does hereby ordain as follows: SECTION I: That subsection H is added to Section 19.24.030 of the Chula Vista Municipal Code to read as follows: Sec. 19.24.030 Accessory Uses and Buildings. H. The Designer Showcase 1986 shall be permitted at 642 and 644 Second Avenue from April 24 to May 26, 1986 subject to the issuance of a zoning permit by the zoning administrator and the following conditions: -1- 1. The organizer of the Designer Showcase 1986 shall provide shuttle bus service from the Showcase to a reasonably convenient location within a one mile radius from the Showcase parking facility. Prior to commencement of the Showcase, the organizer shall submit to the zoning administrator for consideration, approval, conditional approval or denial a description of the vehicles to be used and a schedule for the operation of these vehicles. The organizer shall comply with applicable health and safety standards. 2. The organizer shall provide traffic control personnel and devices to direct and assist any vehicular traffic to and from the events scheduled at the Showcase. 3. The organizer shall provide evidence to the zoning administrator showing compliance with the above mentioned conditions prior to the issuance of the zoning permit and commencement of the Showcase. 4. Signs shall be provided to direct patrons to the offsite parking areas. The signs shall be adequate in size and number to direct patrons but not in conflict with the residential character of the neighborhood. All signs shall require a sign permit issued by the zoning administrator. 5. The applicant shall demonstrate to the zoning administrator compliance with all other provisions of the Municipal Code which are applicable to the operation of the Showcase. 6. Failure of the Showcase to operate in accordance with its schedule of events, hours of operation, regulations herein prescribed or any other provisions of the Municipal Code shall result in the review of the operation by the zoning administrator. The zoning administrator may revoke the zoning permit or impose additional conditions if there is any violation to this section. SECTION II: Pursuant to Section 311 of the Chula Vista City Charter, the City Council hereby declares that this ordinance shall be effective immediately as an emergency ordinance. The City Council hereby declares that it is necessary · for this ordinance to take effect immediately to preserve the public peace, health safety or general welfare for the following reasons: 1. Designer Showcase 1986 would benefit the general welfare of the public by bringing prestige to the community, favorable publicity to the City and would open historical homes to the public. 2. Designer Showcase 1986 is an event currently not regulated by the City of Chula Vista's Municipal Code and the emergency ordinance would allow the City to impose conditions on the operation of this event to protect the public health and safety. 3. The financial expense and commitment incurred by Designer Showcase requires the event to take place at the specified date and if the ordinance is not passed, the event would be prohibited from occurring and would be detrimental to the public welfare because the community would not receive the favorable exposure or prestige from the event and the historical homes would not be open for public viewing. DATED (s~ City Clerk CIIY OF - 'CHUIA VISTA ORDINANCE NO. 2148 AN EMERGENCY ORDINANCE OF THE CITY OF CHULA VISTA ADDING SECTION 19.24.030H TO THE CHULA VISTA MUNICIPAL CODE ALLOWING DESIGNER SHOWCASE 1986 TO BE CONDUCTED AS AN ACCESSORY USE IN AN R-1 RESIDENTIAL ZONE FROM APRIL 24 TO MAY 26, 1986 By a unanimous vote on April 15, 1986 (Mayor Cox was absent), the City Council placed the ordinance on first reading and adoption as an emergency measure. The ordinance allows the erection of a tent for 2 days at 642-644 Second Avenue for the Designers Showcase. The Showcase will also involve various other activities at this location extending for about a month from late April to late May, such as patrons dinner, cocktail party with music furnished by a small combo band and group tours. The Showcase previews remodeling of selected historic houses with the proceeds from the events used to support historic restoration projects of the San Diego Historical Society.
