ORDINANCE NO. 2146
ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA
LIMITING AMOUNT OF TAX INCREMENT PAYABLE FROM
THE BAYFRONT/TOWN CENTRE REDEVELOPMENT PROJECT AREAS,
LIMITING TIME FOR ESTABLISHING LOANS, ADVANCES AND
INDEBTEDNESS TO FINANCE SAID PROJECT AREAS, AND LIMITING
TIME FOR COMMENCING EMINENT DOMAIN PROCEEDINGS
WITHIN SAID PROJECT AREAS
WHEREAS, the City Council of the City of Chula Vista (the "City") has
1 o Redevelopment Plan for the Bayfront
Redevelopment Project and the Redevelopment Plan for the Town Centre
Redevelopment Project, respectively (the "Redevelopment Plans"), pursuant
the California Community Redevelopment Law (the "Law") consisting of Part 1
of Division 24 of the Health and Safety Code of the State of California; and
WHEREAS, the Project Areas described in each of the Redevelopment Plans
(the "Project Areas") have been merged pursuant to Ordinance No. 1872
enacted by the City Council on July 17, 1979; and
WHEREAS, each of the Redevelopment Plans contain the provisions set
forth in Section 33670 of the Law respecting the allocation to the
Redevelopment Agency of the City of Chula Vista (the "Agency") of a portion
of the taxes levied upon taxable property in the respective Project Areas
(the "Tax Revenues"), but do not contain any of the limitations required by
Section 33333.2 of the Law because such limitations were not required to be
included therein at the time of adoption of the Redevelopment Plans; and
WHEREAS, the Legislature of the State of California has recently
amended the Law by adding thereto Section 33333.4 of the Law, which requires
that the City Council adopt an ordinance on or before December 31, 1986,
which contains certain additional limitations applicable to the
Redevelopment Plans, and said Section 33333.4 provides further that such
limitations shall apply to the each of Redevelopment Plans as if each of the
Redevelopment Plans had been amended to include such limitations;
THE CITY COUNCIL OF THE CITY OF CHULA VISTA DOES ORDAIN AS FOLLOWS:
Section 1. Limitation on Total Tax Revenues. The aggregate amount of
Tax Revenues which may be divided and allocated to the Agency pursuant to
the Redevelopment Plan for the Bayfront Redevelopment Project shall be
limited to fifty million Dollars ($ 50,000,00~, and the aggregate amount
of Tax Revenues which may be divided and allocated to the Agency pursuant to
the Redevelopment Plan for the Town Centre Redevelopment Project shall be
limited to twenty million Dollars ($20,000,000). Taxes shall not be
divided and shall not be allocated to the Agency in excess of the
limitations established in this Section 1.
Section 2. Time Limit For Establishing Debt. The time limit on the
establishing of loans, advances and indebtedness to finance in whole, or in
part, the Bayfront Redevelopment Project shall be July 16 , 1999 , and
the time limit on the establishing of loans, advances and indebtedness to
finance in whole, or in part, the Town Centre Redevelopment Project shall be
July 28 , 2001. No loans, advances or indebtedness to repaid from the
allocation of taxes with respect to either Project Area shall be established
or incurred by the Agency beyond the time limit established in this Section
2 for such Project Area. Any loans, advances and indebtedness established
prior to such time limit may be repaid over a period of time longer than
such time limit, as shall be specified in the proceedings of the Agency
establishing the same.
Section 3. Time Limit for Commencement of Eminent Domain Proceedinqs.
The time limit for commencement of eminent domain proceedings by the Agency
to acquire property within either or both of the Project Areas shall be the
date which is twelve years following the effective date of this Ordinance.
Section 4. Effect of Ordinance. The limitations established in this
Ordinance shall apply to the each of the Redevelopment Plans as if each of
the Redevelopmerit Plans had been amended to include such limitations. This
Ordinance shall not be construed to all.ow the impairment of any obligation
or indebtedness heretofore incurred by the City Council or the Agency
pursuant to the Law. The limitations established in this Ordinance shall be '
final and conclusive.
Section 5. Amendment of Ordinance. This Ordinance and the limitations
established herein may be amended by the City Council at any time and from
time to time, but only if, to the extent and with the effect permitted by
the Law.
Section 6. Effective Date. This Ordinance shall become effective on
the thirty-first day after the adoption hereof.
