HomeMy WebLinkAboutReso 2009-208RESOLUTION 2009-208 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AUTHORIZING THE SUBMITTAL OF APPLICATION(S) TO THE CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD FOR ALL ELIGIBLE USED OIL AND HOUSEHOLD HAZARDOUS WASTE GRANTS THROUGH JUNE 30, 2012, AND AUTHORIZING AND EMPOWERING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE ALL GRANT DOCUMENTS NECESSARY TO SECURE USED OIL AND HOUSEHOLD HAZARDOUS WASTE GRANT FUNDS AND IMPLEMENT THE APPROVED GRANT PROJECTS WHEREAS, the people of the State of California have enacted the California Oil Recycling Enhancement Act, which provides grant funds to cities and counties for establishing and maintaining local used oil collection programs that encourage recycling or appropriate disposal of used oil (Used Oil Grants); and WHEREAS, the people of the State of California have enacted Assembly Bill 1220 that provides grants to local governments to establish and implement waste diversion and separation programs to prevent disposal of hazardous waste, including household hazardous waste, in solid waste landfills (HHW Grants); and WHEREAS, Public Resources Code sections 40000 et seq. authorize the California Integrated Waste Management Board (CIWMB) to administer various grant programs in furtherance of the State of California's (State) efforts to reduce, recycle and reuse solid waste generated in the State, thereby preserving landfill capacity and protecting public health and safety and the environment; and WHEREAS, in furtherance of this authority the CIWMB is required to establish procedures governing the application, awarding, and management of the grants; and WHEREAS, grant application procedures require an applicants' governing body to authorize by resolution its approval for submittal of the grant application(s) identified below, and the designation by job title of the individual authorized to execute all grant documents on behalf of the City of Chula Vista; and WHEREAS, if awazded, the City of Chula Vista will enter into a grant agreement with the CIWMB for implementation of said grant(s). NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista authorizes the submittal of application(s) to the CIWMB for all used oil and household hazardous waste grants for which Chula Vista is eligible. Resolution No. 2009-208 Page 2 BE IT FURTHER RESOLVED that the City Manager or his designee is hereby authorized and empowered to execute in the name of the City of Chula Vista all grant documents, including but not limited to, applications, agreements, amendments and requests for payment, necessary to secure grant funds and implement the approved grant project(s).
