HomeMy WebLinkAboutOrd 1992-2525 ORDINANCE NO. 2525 ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA ZONING CERTAIN DESIGNATED PROPERTY ON THE WESTERLY SHORE OF LOWER OTAY LAKE AS AGRICULTURAL-IO0, AND FINDING THAT SUCH ZONING ACTIVITY IS EXEMPT FROM THE REQUIREMENTS OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT WHEREAS, property consisting of approximately 100 acres located in the City of Chula Vista generally located between Wueste Road and the 480 foot contour level of the Lower Otay Lake Reservoir bounded on the south by the territorial boundary of the City of Chula Vista and on the north by a hypothetical extension of Otay Lakes Road, diagrammatically presented on the small area map attached hereto as Exhibit A, ("Property") is currently not zoned by the City; and, WHEREAS, the Property is currently owned by the City of San Diego; and, WHEREAS, a duly verified application for a zoning action was filed with the Planning Department of the City of Chula Vista on May 21, 1992, by the City of Chula Vista; and, WHEREAS, said application requested the zoning of approximately 100 acres constituting most of the westerly shore of Lower Otay Lake to A-IO0 (Agricultural Zone, lO0-acre minimum parcel size); and, WHEREAS, the Planning Commission set the time and place for a hearing on said zoning application and notice of said hearing, together with its purpose, was given by its publication in a newspaper of general circulation in the city and its mailing to property owners within 1,000 feet of the exterior boundaries of the proper{y! at least ten days prior to the hearing; and, WHEREAS, the hearing by the Planning Commission was held at the time and place as advertised, namely 7:00 p.m., July 8, 1992, in the Council Chambers, 276 Fourth Avenue, before the Planning Commission and said hearing was thereafter closed; and, WHEREAS, from the facts presented to the Planning Commission, the Commission has determined that the zoning is consistent with the City of Chula Vista General Plan and that public necessity, convenience, general welfare and good zoning practice support the zoning to A-iO0; and, WHEREAS, the Planning Commission passes and approved this application on July 8, 1992. NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Chula Vista does hereby find, determine, resolve and order as follows: SECTION 1. Exempt as Minor Alteration in Land Use. This particular zoning activity is an activity exempt from environmental review under Section 15305 of the CEQA Ordinance No. 2525 Page 2 Guidelines on the basis of the fact that the impression of an A-IO0 zone will constitute a minor alteration in land use inasmuch as the only permissible use under the County's pre- existing zoning scheme was agricultural, and inasmuch as the actual use thereof was and continues to be a less environmentally intense use; and, SECTION 2. Exempt as Permitting Limited Numbers of New Small Structures. This particular rezoning activity is an activity exempt from environmental review under Section 15303, Class 3, of the CEQA Guidelines on the basis of the fact that the impression of an A-IO0 zone will permit the construction of only a limited numbers of new, small facilities or structures such as the construction of not more than three single-family residences. SECTION 3. Zoning. The Property is hereby zoned Agricultural with a lO0-acre minimum parcel size, to wit: A-IO0. Presented by Approved as to form ~ Robert A.
