HomeMy WebLinkAboutOrd 1967-1056ORDINANCE NO. 1056 AN ORDINANCE AMENDING CHAPTER 2 OF THE CHULA VISTA CITY CODE BY ADDING THERETO A NEW ARTICLE XI, ESTABLISHING THE CHULA VISTA SAFETY COMMISSION TO PROVIDE FOR THE CONSIDERATION OF ALL MATTERS RELATING TO TRAFFIC SAFETY AND OTHER SAFETY PROBLEMS INCLUDING SCHOOL, HOME AND INDUSTRIAL SAFETY PROBLEMS The City Council of the City of Chula Vista does ordain as follows: SECTION I: That Chapter 2 of the Chula Vista City Code be, and the same is hereby amended by adding thereto a new Article XI, to read as follows: ARTICLE XI. CHULA VISTA SAFETY COMMISSION. Section 2.92. Creation and Membership. There is hereby created and established the Chula Vista Safety Commission, which shall consist of seven (7) members to be appointed by the City Council and to hold office at the pleasure of the Council pursuant to the requirements of Article VI of the Charter of the City of Chula Vista. All of said members shall be qualified electors of the City of Chula Vista. No members shall hold any paid office or employment in the City government. The members shall serve for a term of four (4) years; provided, however, that those members presently appointed to the Safety Council shall continue to serve as members of the Safety Commission, and the terms of said members shall be staggered in .accordance with the existing terms expiring on June 30th of the fourth year of said terms, provided further, that any of said members who may not be qualified electors of the City may continue to serve and the City Council may consider the reappointment of such members for not more than one four-year term. Each member shall serve until his successor is duly appointed and qualified and all vacancies shall be filled for the unexpired term. of the member whose place has become vacant. The Chief of Police and the Traffic Engineer of the City of Chula Vista shall be ex officio members of the Commission but they shall have no vote. The Chief of Police or his appointed representative shall act as Secretary to the Commission. The Commission shall select a chairman from its membership annually. Four members shall constitute a quorum for the transaction of business and the affirmative votes of a majority of the members ~~~~~ present shall be necessary to pass on any recommendations. The Commission shall adopt reasonable rules and regulations for conduct- ing its inquiries and shall render its findings and recommendations in writing to the City Council. Section 2.93. Powers and Duties. The duties of the Safety Commission shall be to conceive and to develop ideas or suggestions which would specifically or gen- erally contribute to the improvement of personal or property safety within the Chula Vista City area, and to receive and process such ideas from any individual or groups of individuals, and, after such suggestions have been given careful consideration and study by members, both individually and collectively, the Safety Commission shall make appropriate recommendations, by resolution, to the Chula Vista City Council. All recommendations shall be considered and acted upon favorably or unfavorably. The scope of the operations of the Safety Commission may embrace any hazardous condition, whether it be physical or material, which would jeopardize human safety, or cause damage to property both within and outside the home or industry; provided, however, that the basic function of the Commission shall be related to matters of vehicular or pedestrian traffic safety within the public rights-of-way in the City of Chula Vista and safety hazards which may exist on or about publicly owned land and facilities. All of the provisions of Sections 600 through 606 of Article VI of the Charter shall control as to the conduct and operation of such commission and its members. Section 2.94. Meetings. Such commission shall hold at least one regular meeting each month on the day and at the same time and in the place that it shall designate by resolution, and such special meetings as such commission may require. Said meetings shall be subject to all requirements of State and local laws governing notice and open meetings. SECTION II: This ordinance shall take effect and be in full force on the thirty-fir•~t day from and after its passage and approval. Presented by ~~ ' Fred A.
