RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA RECITING THE FACT OF THE MUNICIPAL
ELECTION HELD IN THIS CITY ON MAY 5, 2009,
DECLARING THE RESULTS THEREOF, AND SUCH OTHER
MATTERS AS ARE PROVIDED BY LAW
WHEREAS, a Municipal Mail Ballot Election was held and conducted in the City of
Chula Vista, California, on Tuesday, May 5, 2009, as required by law, for the purpose of
submitting one ballot measure, the proposed Transaction and Use Tax (Sales Tax) (Proposition
A) to the electorate; and
WHEREAS, notice of said election was duly and regulazly given in the time, form, and
manner as provided by law; and in all respects said election was held and conducted, and the
votes cast at the election received and canvassed, and the returns made and declared, in the time,
form, and manner as required by the provisions of the Elections Code of the State of California
for the holding of elections in charter cities; and
WHEREAS, A Notice of Exemption was filed with the County Clerk of the County of
San Diego on Januazy 26, 2009 concerning Proposition A; and
WHEREAS, pursuant to Resolution No. 2009-012, adopted January 20, 2009, the
election was conducted wholly by mail, and the San Diego Registrar of Voters canvassed the
returns of said election and has certified the results; and
WHEREAS, the results aze received and made a part hereof, attached hereto as Exhibit
A.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista
as follows:
SECTION 1. The Municipal Election was held for the purpose of submitting to the voters of the
City the following question:
To prevent further cuts and preserve general city services, YES
including public safety staffing for emergency response,
reducing crime and criminal gang/drug activity, maintaining
city streets/parks, and preserving library services and
youth/after-school programs; shall the City of Chula Vista NO
adopt an ordinance enacting a one cent transactions and use
(sales) tax, expiring in ten yeazs, with mandatory audits,
quarterly reports to Mayor and City Council, and a citizens'
review committee?

SECTION 2. This election was conducted wholly by mail.
SECTION 3. The number of ballots cast by mail was 29,704.
SECTION 4. The City Council does hereby declaze that a majority of voters voting on
Proposition A, relating to a local one-percent transactions and use (sales) tax, did
not vote in favor of it, and that the measure was not carried, and shall not be
deemed adopted.
SECTION 5. The number of votes cast in the City for and against Proposition A aze listed in
Exhibit A, attached hereto and made a part hereof.
SECTION 6. The City Clerk shall enter on the records of the City Council of the City of Chula
Vista a statement of the results of the election, showing the whole number of
ballots cast in the City and the number of votes given in the City for and against
Proposition A.
