ORDINANCE NO. 2212
AN ORDINANCE OF THE CITY OF CHULA VISTA ADDING
CHAPTER 3.18 TO THE CHULA VISTA MUNICIPAL CODE
RELATING TO A SEWERAGE FACILITIES REPLACEMENT FUND
The City Council of the City of Chula Vista does hereby
ordain as follows:
SECTION I: That Chapter 3.18 is hereby added to the
Chula Vista Municipal Code to read as follows:
CHAPTER 3.18
SEWERAGE FACILITIES REPLACEMENT FUND
Sec. 3.18.010
Established-Disposition of revenue-
Expenditures permitted.
There is established a fund to be designated as the
"Sewerage Facilities Replacement Fund."
From the revenue derived from the monthly sewer
service charge set forth in Chapter 13.20 the
following amounts shall be deposited into such
sewerage facilities replacement fund:
Domestic: For each single family dwelling
unit serviced by a separate water meter
seventy cents ($0.70) per month.
Domestic: For other parcels of real property
used for domestic purposes and serviced by a
water meter an amount calculated at the rate
of $0.06 per each one hundred cubic feet of
water usage by such parcel, but in no case
less than seventy cents ($0.70) per month, nor
more than seventy cents per dwelling unit per
month.
Commercial and industrial: For premises used
for other than domestic purposes an amount
calculated at the rate of ~0.06 per each one
hundred cubic feet of water usage by such
premises but in no case less than seventy
cents (~0.70) per month.
Nothing herein shall be construed as superseding or
conflicting with the existing sewer fund, sewer
service revenue fund, or the Trunk Sewer Capital
Reserve Fund.

The fund shall be used solely for the purpose of
paying the cost of refurbishment and/or replacement
in connection with the CIP Program and with Council
approval of structurally deficient sewerage
facilities including related evaluation,
engineering, and utility modification costs unless
the City Council shall by four-fifths vote
appropriate such funds for another purpose provided
such purpose shall be for the construction,
maintenance or operation of sewers or incidental
thereto, including any charge for its collection.
