AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA AUTHORIZING AN AMENDMENT TO THE CONTRACT
BETWEEN THE CITY COUNCIL OF THE CITY OF CHULA VISTA
AND THE BOARD OF ADMINISTRATION OF CALIFORNIA PUBLIC
EMPLOYEES' RETIREMENT SYSTEM
The City Council of the City of Chula Vista does hereby
resolve as follows:
SECTION I: That an amendment to the contract between
the City Council of the City of Chula Vista and the Board of
Administration of the California Public Employees' Retirement
System is hereby authorized, a copy of said amendment being
attached hereto, marked "Exhibit A", and by such reference made a
part hereof as though herein set out in full.
SECTION II: The Mayor of the City of Chula Vista is
hereby authorized, empowered, and directed to execute said
amendment for and on behalf of said Agency.
SECTION III: This ordinance shall take effect thirty
Jays after the date of its adoption, and prior to the expiration
= ten days from the passage thereof shall be published at least
~nce in the Chula Vista Star News, a newspaper of general
circulation, published and circulated in the City of Chula Vista
and thenceforth and thereafter the same shall be in full force
and effect.

AMENDMENT TO CONTRACT

OF THE
CITY OF CHULA VISTA
T~e Board of Administration, Public Employees' Retirement System, heroinafter
referred to as Board, end the governing body of above public agency, herein-
after referred to as Public Agency, having entered into a contract effective
October 1, 1948, and wttl]essed August 31, 1948, and as amended effective
October 1, 1951, November 1, 1955, January 1, 1960, January 1, 1961, September
1, 1967, September 28, 1973, October q, 1973, October 8, 1976, April 16, 1981,
January 8, 1982 and September 28, 1984, which provides for participation of
Public Agency in said System, Board and Public Agency hereby agree as follows:
Paragraphs 1 through 12 are hereby stricken from said contract as executed
effective September 28, 1984, and hereby replaced by the following
paragraphs numbered 1 through 12 inclusive:
All words and terms used herein which are defined in the Public
Employees' Retirement Law shall have the meaning as defined therein
unless otherwise specifically provided. "Normal retirement age"
shall mean age 60 for local miscellaneous members and age 50 for local
safety members.
Public Agency shell participate in the Public Employees' Retirement
System from and after October 1, 19~8 making its employees as
heroinafter provided, members of said System subject to all provisions
of t~e Public Employees' Retirement Law except such as apply only on
election of e contracting agency ~nd are not provided for heroin and
to all amendments to said Law hereafter enacted except those, which by
express provisions thereof, apply only on the election of a contrac-
ting ~Eency.
Employees of Public Agency in the following classes shall become
members of said Retirement System except such in each such class as
~re excluded by law or this agrnement~
a. Local Fire Fighters (heroin referred to as local safety members);
Local Police Officers (heroin referred to as local safety
members);
(1). Local Police Officers shell include individuals defined by
Section 20030 of the Government Cede prior to its amendment
at the 1975-76 Regular Legislative Session, effective
January 1, 1976, employed by Public Agency prior to such
a~ndment;
Employees other than local safety members (heroin referred to as
local miscellaneous members).
In addition to the classes of employees excluded from membership by
said Retirement Law, the following classes of employees shall not
become members of said Retirement System:
ADDITIONAL EXCLUSIONS
Effective October ~, 1973 and prior to J~nu~ry 1, 1975, those members
who were hired by Public Agency on a temporary and/or seasonal basis
not to exceed 6 months were excluded from PERS membership by contract·
Government Code Section 20336 supersedes this contract provision by
providing that any such temporary ~nd/or seasonal employees are
excluded from PERS membership subsequent to January 1, 1975.
This contract shall be the continuation of the benefits of the
contract of the Montgomery Fire Protection District, harelnafter
referred to as "Former Agency", pursuant to Section 20567.1 of tile
Government Code, Former Agency having ceased to exist and been
succeeded by Public Agency on January 1, 1986. Public Agency, by this
contract, assumes the accun~:lated contributions and assets derived
therefrom and liability for prior and current service under the Former
Agency's contract with respect to the Former Agency's employees·
Service performed for the former agency prior to January 1, 1986
shell be computed separately from service performed on and after
January I, 1986, pursuant to Government Code Section 20567.8.
All benefits except Section 21382.2 (Increased Level of 1959
Survivor Benefits), provided under the contract of the City of
Chula ViSta shall apply to all pest service for former employees
of the Montgomery Fire Protection District.
The fraction of final compensation to be provided for e~eh year of
credited prior and current service as a looal miscellaneous member
Sh~ll be determined in accordance with Section 21251.13 of said
Retirement Law (~ at age 60 Full).
The fraction of final compensation to be provided for each year of
credited prior and current service as a local safety member shall be
determined in accordance with Section 21252.01 of said R~cirement Law
(~ at age 50 Full).

The following additional provisions of the Public Employees'
Retirement Law, which apply only upon election of a contracting
agency, shall apply to the Public Agency and its employees:
Sections 21380 - 21387 (1959 Survivor Program) excluding Section
21382.2 (Increased 1959 Survivor Benefits) and Section 21382.~
(Third Level of 1959 Survivor Benefits).
b. Section 20862.8 (Unused Sick Leave Credit).
Section 20020 ("Local Police Officer" shall include persons
assigned to identification and communication duties in the Police
Department who were not classified as local safety members and
who were in such employment on or prior to August 4, 1972, and
who elected to be local safety members on or before September
28, 1973.
Section 21222.85 (Special 36 - 15~ Increase) for or on behalf of
those local miscellaneous and those local safety members who
retired or died prior tO January 1,197~.
Sections 21263/21263.1 (Post-Retirement Survivor Allowance) for
local safety embers only.
Section 20500 (Cost ShefinS) Public Agency and ~%s employees have
aS?reed to share the cost of the following benefit applicable to
Section 21252.01.
From and After September 28, 198~ the local safety employees of
Public Agency shall be assessed an additional 0.3~1~ of their
compensation - for a total contribution rate of 9-3q1% pursuant
to Government Code Section 20500.
Section 20500 (Cost Sharing) Public Agency and its employees have
agreed to remove the cost sharing of the benefit applicable to
Section 21252.01.
From and Afher July 1, 1985 the local safety employees of Public
Agency Shall. be assessed an additional 0.000~ of their compen-
sation for a ~otal contribution rate of 9.000~ pursuant to
Government Code Section 2~500.
Public Agency, in accordance with Government Code Section 207q0,
ceased to be an "employer" for purposes of Section 20759 effective on
October 8, 1976. Accumulated contributions of Public Agency shall be
fixed and determined as provided in Government Code Section 20759, and
accumulated contributions thereafter Shall be held by the Board as
provided ~n Government Code Section 20759.
11. Public AEeney shall contribute to said Retirement System as follows:
With respect to local miscellaneous members, the agency shall
contribute the following percentages of salaries earned aa
members of said Retirement System:
(1)
0.039 percent until June 30, 2000 on account of the
llability for prior service benefits. (Subject to annual
change.)
8-937 percent until June 30, 2011 on account of the
liability for ourrent service benefits. (Subject to annual
ehange.)
(3)
0.082 percent until June 30, 1996 on account of the
liability for the benefits provided under Section 21222.85
of said Retirement Law. (Subject to annual change.)

With respect to local safety members, the agency shall contribute
the following percentages of salaries earned as members of said
Retirement Systems'
0.492 perneat until June 30, 2000 ca account of the
liability for prior service benefits. (Subject to annual
change.)
~5.364 percent until June 30, 2011 on account of the
liability for ourrent service benefits. (Subject to annual
change.)
(3)
0.016 percent until June 30, 2011 on account Of the
liability for the ~59 Survivor Program. (Subject to annual
change.)
A reasonable amount, as fixed by the Board, payable in one in-
stallment within 60 days of date of contract to cover the costs
of administering said System as it affects the employees of
Public Agency, not including the costs of special valuations or
of the periodic investigation and valuations required by law.
A reasonable amount, as fixed by the Board, payable in one in-
stallment as the occasions arise, to cover the coats of special
valuations on account of employees of Public Agency, and costs of
the periodic investigation and valuations required by law.
Contributions required of Public Agency and its employees shall be
subject to adjustment by Bo~rd on account of amendments to the Public
Employees' Retirement Law, and on acaount of the experience under the
Retirement System as determined by the periodic investigation and
valuation required by said Retirement Law.
