Further traffic studies by staff revealed the need to also construct improvements on East H, between the Southwestern College and Bonita Vista High School entrances to achieve the stated project objectives. With the additional scope and the complexity of this project with regard to right-of-way acquisition and utility coordination, additional funds are required to continue the critical design, right-of-way acquisition, and environmental stages of the project, as well as develop phased constmction plans. ENVIRONMENTAL REVIEW The Environmental Review Coordinator has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the proposed action is not a "Project" as defined under Section [5378 (b)(4) of the State CEQA Guidelines because the proposed action seeks only to appropriate funds to an investigative process that seeks to define the scope of street improvements related to mitigatIOn measures cited by previously certified environmental impact reports. Once the scope of street improvements is defined the appropriate environmental determination will be made. Therefore, pursuant to Section [5060(c)(3) of the State CEQA Guidelines the activity is not subject to CEQA. Thus, no environmental review is necessary at this time. DISCUSSION At the time this project was first proposed, its scope was limited to completing the widening of OLR to six-lane major standards between Canyon Drive to Telegraph Canyon Road. As this segment of OLR is included in the Transportation Development Impact Fund (TDIF) program, staff performed additional traffic studies of the project area and all intersections to determine the best use of limited TDIF funds and to develop a construction-phasing plan. The traffic studies included safety considerations and vehicle volume data for pre-SRl25 and post-SRl25 conditions, as well as Traffic Monitoring Program (TMP) Runs to determine segment average speed and travel time. These studies determined that the area of highest priority is the intersection ofOLR and East H Street. Therefore, Construction Phase I of this project will involve constmcting the intersection and approach legs of OLR and East H Street to their ultimate configurations, including the reduction of crosswalk lengths and the installation of additional, highly-visible signage. The shldies also determined that the current configurations of the entrances to Southwestern College along OLR contribute significantly to overall traffic congestion within the project area. Therefore, Construction Phase 2 of this project would improve the college entrances along Otay Lakes Road. Finally, Construction Phase 3 would be comprised of the addition of the third lane in each direction from the college to the intersection ofOLR and Telegraph Canyon Road. Tentatively, each phase of constmction is anticipated to occur on the following schedule, but is dependent upon the availability ofTDIF funds: Construction Phase I Spring 2010 Construction Phase 2 * Spring 2012 Construction Phase 3 * Spring 2014 * Phases 2 & 3 may be built as a single project if adequate funding is available Right-of-way acquisition is also a significant and complex task on this project. Each of the property owners has its own land sale procedures, with different levels of complexity. Among the more complex are the Navy, the Church of Latter Day Saints, a shopping center, and a Homeowner's Association (HOA). Along with the common right-of-way issues a typical project would present, this project also includes the obligation that the City obtain new easements for the relocation of San Diego Gas and Electric (SDG&E) facilities within the project limits. In this case, SDG&E has senior rights to the City, which means that the City's franchise agreement does not apply and the City will have to pay for the relocation of SDG&E's existing facilities and new easements. Therefore, due to the increased degree of complexity of this project beyond that originally anticipated in the early project planning stages, it is necessary to appropriate additional TDIF funds in the amount of S500,000 to complete design (primarily along East H Street) and to facilitate right-of-way acquisition, including legal descriptions, appraisals, and negotiations. DECISION MAKER CONFLICT Staff has reviewed the property holdings of the City Council and has found a conflict exists, in that Councilmember McCann has property holdings within 500 feet of the boundaries of the property which is the subject of this action. CURRENT FISCAL IMPACT The total project estimate, including all three phases of work, is S12.5 million. The design of the total project is about 85% complete. The budget to date is 5900,000 of Transportation Development Impact funds (TDIF). Staff is requesting an additional a.ppropriation of S500,000 to complete the design and to negotiate utility relocation and easement acquisition, as well as right of way acquisition for the total project. There is no impact to the General Fund, as there are sufficient funds in the TDIF balance for this project. Staff will request funding in the amount of $2.5 million for Construction Phase 1 through the Fiscal Year 2009/2010 CIP Budget Process. ONGOING FISCAL IMPACT Landscaping maintenance and irrigation costs of $1,500 to $2,500 upon completion of all Construction Phases. MAGBUHAT APPROVED BY: ROBERTO YANO RESOLUTION NO. 2009- RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA APPROPRIATING ADDITIONAL FUNDS TO THE "OTA Y LAKES ROAD WIDENING IMPROVEMENTS FROM CANYON DRIVE TO TELEGRAPH CANYON ROAD / LA MEDIA (STM-355)" PROJECT FROM THE AVAILABLE TRANSPORTATION DEVELOPMENT IMPACT FUNDS BALANCE WHEREAS, during Fiscal Year 2004/2005, City Council approved the appropriation of $900,000 to begin the preliminary design and investigation work for the Otay Lakes Road (OLR) Widening from Canyon Drive to the intersection of Telegraph Canyon Road to ease traffic congestion and meet the City's GMOC thresholds; and WHEREAS, with further traffic studies, City staff discovered the need for additional improvements on East H from the Southwestern College entrance to the Bonita Vista High school entrance (Baron Way) to achieve the project objective; and WHEREAS, right-of-way is a formidable task within this project because it requires acquisitions from Bonita Vista High School Unified School District, Southwestern College, Church of Latter Day Saints, College Plaza - Retail Center, US Department of Defense, Navy Housing and Charter Point Homeowner's Association; and WHEREAS, this project has the added issue of San Diego Gas and Electric (SDG&E) easements within the project .limits with prior rights and this means that the City's franchise agreement does not apply and that the City will have to pay for the relocation of SDG&E's existing facilities and new easements; and WHEREAS, the total project estimate, including all three phases of work, IS $12.5 million; and WHEREAS, the design of the total project is about 80% done. The budget to date is $900,000 of Transportation Development Impact funds (TDIF); and WHEREAS, staff is requesting an additional appropriation of $500,000 to complete the design and to initiate negotiations for utility and right-of-way of the total project: and WHEREAS, the project is proposed to be broken into three phases in order to comply with the TDIF cash flow requirements and urgency of improvements; and WHEREAS, there is no impact to the General Fund, as there are sufficient funds in the TDlF balance for this project.
