HomeMy WebLinkAboutOrd 1987-2181ORDINANCE NO. 2181 AN ORDINANCE OF THE CITY OF CHULA VISTA ESTABLISHING A SPECIAL SEWER SERVICE RATE AREA FOR CHULA VISTA WOODS The City Council of the City of Chula Vista does ordain as follows: WHEREAS, the City of Chula Vista provides sewer service within the boundaries of the City, and WHEREAS, the Chula Vista Woods subdivision requires a temporary pump station which should not be maintained or operated at City expense, and WHEREAS, Gardner Investment Properties, the owner of Chula Vista Woods has entered into an agreement consenting to the imposition of a special fee to cover the costs of operating and maintaining the temporary sewer pump station serving the area of Final Map Nos. 11566 and 11576 and certain other costs, and WHEREAS, the City of Chula Vista has the authority to impose special rates and charges by ordinance pursuant to Health and Safety Code Section 5471. NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS: 1. The City Council of the City of Chula Vista hereby establishes a special rate zone within the boundaries of Final Map Nos. 11566 and 11576 of the City of Chula Vista, Exhibit A attached hereto, for the purpose of providing special sewer services to said area through a temporary sewer pump station, and to subsequently provide customary service through a gravity-flow system. Said sewer services shall be provided by the City of Chula Vista in conformance with the contract between the City of Chula Vista and Gardner Investment Properties, dated December 11, 1986. The name of the proposed special zone is "Chula Vista Woods Special Rate Zone". 2. The domestic sewer service charge for each single-family dwelling unit within the Chula Vista Woods Special Rate Zone shall be equal to the amount charged other similarly situated customers within the service area of the City, except as hereinafter provided. -1- 3. A special operations and maintenance surcharge shall ~e assessed for each single-family dwelling unit serviced within the Chula Vista Woods Special Rate Zone at the rate of ~4.50 per unit per month, or ~54 per year. This special rate is equal to the actual cost of operating and maintaining the temporary sewer pump station located within and serving the Chula Vista Woods Special Rate Zone. The surcharge shall be billed to customers, or to a homeowners association, approved by the City, which has responsibility for common water meters. 4. In the event such temporary sewer pump station is taken out of service as a result of the development of gravity-flow sewer lines external to and adjacent to the Zone, the operations and maintenance charge shall be discontinued; provided, however, that (a) such surcharge may be continued for not longer than three years after the temporary pump station is taken out of service; (b) the surcharge shall not exceed the average such assessment in prior years; and (c) such surcharges shall be used solely for the actual connection of the Chula Vista Woods' collection system to the new trunk line or force main which rendered the temporary sewer pump station unnecessary. 5. All surcharge collections shall be placed in a separate fund established for the purpose of administering this ordinance. All interest accruing in such account shall remain therein. 6. This ordinance shall continue in full force and effect until repealed. It is the intent of the City to repeal this ordinance upon termination of the December 11, 1986 "Agreement to Provide Sewer Service to the Chula Vista Woods zone of the City of Chula Vista," in accordance with its terms. 7. The City Clerk of the City of Chula Vista is hereby directed to publish this ordinance within fifteen (15) days after its passage in the Chula Vista Star News, a newspaper of general circulation published in the City of Chula Vista. 8. This ordinance shall take effect and be in full force on the thirty-first day from and after its adoption. The purpose of the ordinance is to provide special sewer services through a temporary sewer pump station and to subsequently provide customary service through a gravity-flow system. The domestic sewer service charge for each single-family dwelling unit within Chula Vista Woods Special Rate Zone shall be equal to the amount charged other similary situated customers with the service area of the City, except a special operations and maintenance surcharge shall be assessed for each single-family dwelling unit serviced with the area at the rate of $4.50 per unit per month or $54 per year. Regulations are also defined in the ordinance in the event such temporary sewer pump station is taken out of service as a result of the development of the operations and maintenance charge being discontinued.
