AN ORDINANCE OF THE CITY OF CHULA VISTA REZONING CERTAIN
TERRITORY, GENERALLY BOUNDED BY MAIN STREET, RIOS AVENUE,
AGRICULTURE LANDS ADJACENT TO THE OTAY RIVER VALLEY AT
THE SOUTHERN BOUNDARY OF THE CITY AND A LINE 310 FEET
WEST OF DATE STREET FROM ITS CITY-ADOPTED COUNTY ZONE
CLASSIFICATIONS TO CITY CLASSIFICATIONS UTILIZED
THROUGHOUT CHULA VISTA
WHEREAS, this proposal involves the rezoning of the Broderick's Otay
Acres Subcommunity of the Montgomery Specific Plan, which is generally bounded
by Main Street to the north, Rios Avenue to the east and vacant and industrial
land to the west; and
WHEREAS, this request will convert the existing City-adopted County
zoning to City zoning classifications as follows:
C36 to R-1-5-P
RV15 to R-1-5-P
A70 {No change proposed at this time)
WHEREAS, the Environmental Review Coordinator conducted Initial Studies,
IS-88-4M and IS-88-65M, of potential environmental impacts associated with the
Montgomery Specific Plan and has concluded that this reclassification would
cause no significant environmental impacts as per the previously adopted
Negative Declarations issued on IS-88-4M and IS-88-65, and
WHEREAS, on March 7, 1990, the Montgomery Planning Committee unanimously
recommended reclassification from R-2-P to R-1-5-P for the areas that are
zoned RV15 and C36, and
WHEREAS, on May 9, 1990, the City Planning Commission voted 3-2 to
support the recommendation of the Montgomery Planning Committee, but since a
fourth vote was not received, it was deemed that no action was taken on the
project and PCZ-90-KM was forwarded to the City Council for public hearing and
action.
The City Council of the City of Chula Vista does ordain as follows:
SECTION I: That that certain territory, generally bounded by Main
Street, Rios Avenue and agriculture lands adjacent to the Otay River Valley at
the southern boundary of the City and a line 310 feet west of Date Street, is
hereby rezoned from its City-adopted County zone classifications to the City
classifications utilized throughout Chula Vista and more specifically depicted
on Exhibit "A", attached hereto and incorporated herein by reference as if set
forth in full.

SECTION II: This ordinance shall take effect and be in full force on the
thirtieth day from and after its adoption.
