ORDINANCE NO. 2382
AN URGENCY ORDINANCE OF THE CITY OF CHULA VISTA
PROHIBITING THE ISSUANCE OF ANY BUILDING PERMIT FOR A
SPECIFIED PARCEL TO ALLOW A STUDY OF THE PROPER
DEVELOPMENT OF THE SITE
WHEREAS, on June 5, 1990, the City Council of the City of Chula Vista
(City Council) considered the development potential of that certain property
more particularly defined in Exhibit "A" attached to this Ordinance
("Property"), and
WHEREAS, the Property is located adjacent to an existing Metropolitan
Transit Development Board (MTDB) station that serves numerous people within
the City of Chula Vista, and
WHEREAS, the City Council desires to consider a proposal for the
development of the Property in a manner so as to complement and augment the
benefits of the existing MTDB station, and
WHEREAS, the Chula Vista Municipal Code I19.12.130 provides authority for
the City Council to adopt an Urgency Ordinance when the safety, health or
welfare of the people is threatened, and
WHEREAS, the development of the Property without the participation of the
community, San Diego Gas & Electric and MTDB will adversely impact the safety
and welfare of the people due to issues of community visibility, traffic,
aesthetics and services, and
WHEREAS, the City Council finds that any bull ding permit that may issue
prior to the completion of a site plan for the development of the Property may
jeopardize the use of the Property for the benefit of the safety, heal th and
welfare of the people of Chula Vista.
NOW, THEREFORE, the City Council of the City of Chula Vista ordains as
follows:
SECTION 1. Based on the Recitals set forth above, no building permit of
any nature shall be issued within ninety {90) days after the adoption of the
Ordinance for any construction on the Property.
SECTION 2. This Ordinance shall take effect and be in full force
immediately after having received the number of votes by the City Council
necessary for its passage.

SECTION 3. This Ordinance shall not be in effect for longer than ninety
(90) days unless extended in compliance with Chula Vista Municipal Code
~19.12.130.
