HomeMy WebLinkAboutOrd 1990-2362 ORDINANCE NO. 2362 AN ORDINANCE OF THE CITY OF CHULA VISTA ADDING CHAPTER 2.33 TO THE CHULA VISTA MUNICIPAL CODE ESTABLISHING A CULTURAL ARTS COMMISSION The City Council of the City of Chula Vista does ordain as follows: SECTION I: That the Chula Vista Municipal Code is hereby amended by adding a new Chapter 2.33 to read as follows: CHAPTER 2.33 CULTURAL ARTS COMMISSION. Sec. 2.33.010 Purpose and Intent. It is the purpose and intent of the City Council, in establishing the Cultural Arts Commission to create an advisory body which would serve as a resource, to advise and to make recommendations to the City Council and the City Manager on cultural arts issues affecting the citizens of the City. The focused efforts of the Cultural Arts Commission will work to identify cultural arts needs and issues. The purpose of the commission is to focus community energies and resources on developing a highly visible city with a cultural arts personality and to develop, support, and nurture those ideas which expand and enrich arts and cultural opportunities for the entire community. Sec. 2.33.020 Functions and Duties. The functions and duties of the Cultural Arts Commission shall be as follows: A. Encourage the preservation of Chula Vista's cultural heritage and the creation of an atmosphere - a Chula Vista image - in which our citizens could take pride and have increased stature. B. Help coordinate and marshal support for the arts. C. Encourage the provision of cultural and artistic facilities and features in public and commercial construction. D. Formulate recommendations for a City arts program, including funding mechanisms, criteria for the selection and placement of public art, procedures for reviewing plans, and guidelines to carry out a City arts program. Ordinance No. 2362 Page 2 E. Regularly assess, review and update recommended goals and long range plans for the City; and regularly solicit public input on the arts. F. Encourage the development of arts and cultural programs for the youth of Chula Vista. G. Promote the creation of a cultural environment which would attract visitors and income. H. Advise the Redevelopment Agency regarding the expenditure of fine arts in-lieu fees. I. Make recommendations to the Redevelopment Agency on fine arts features within Redevelopment districts. The Commission, by having a definite focus and by demonstrating a high degree of commitment to the arts, can conduct strategic longorange planning to help reach these goals. Sec. 2.33.030 Created-Appointment of Members-Term- Rules and Regulations-Appointments. A. There is created a Cultural Arts Commission consistin9 of nine members appointed by the City Council from the qualified electors of the City in accordance with the provisions of Section 600 et seq. of the Charter. B. The members shall serve for a term of four years, except that the initial appointment of two members shall be for a term of one year, two members shall be for a term of two years, two members shall be for a term of three years, and three members shall be for a term of four years. Each member shall serve until his/her successor is duly appointed and qualified and all vacancies shall be filled for the unexpired term of the member whose place has become vacant. C. The City Manager or his/her designated representative shall be an ex-officio member of the commission, but shall have no vote. D. The City Council, or its designee, may appoint additional ex-officio members of the commission, but any such ex-officio members shall have no vote. E. The commission shall select a chairperson and vice-chairperson from its membership annually, at the July meeting. F. The commission shall adopt reasonable rules and regulations for carrying out the functions and duties of the commission and the Ordinance No. 2362 Page 3 governing of its meetings. All reports and recommendations shall be made in writing. Sec. 2.33.040 Meetings and Quorum. The Cultural Arts Commission shall hold at least one regular meeting each month on the day and at the time and in the place that it shall designate by resolution and such special meetings as the commission may require. Said meetings shall be subject to all requirements of state and local laws governing notice and open meetings. Five members shall constitute a quorum for the transaction of business. Sec. 2.33.050 Ad hoc Committee. The commission may appoint, at its discretion, committees to concern themselves with specific cultural arts issues. These committees may be composed of citizens who are not members of the commission, except that the chairman of each such committee must be a member of the Cultural Arts Commission. Sec. 2.33.060 Staff Assistance and Funding. A. The City Manager may make available staff and clerical support to the commission to fulfill its functions and duties, provided such staff and clerical support is available. B. Subject to the approval of the City Council, the commission may accept gifts and grants from any source to assist it in the performance of its functions. C. In the event such funds become available, the City Manager is authorized, upon recommendation of the commission and approval of the Council, to enter into appropriate contracts for the utilization of such funds in furtherance of the purposes and intent of, and the duties and functions of, the commission. SECTION II: This ordinance shall take effect and be in full force on the thirtieth day from and after its adoption.
