AN ORDINANCE OF THE CITY OF CHULA VISTA ADDING CHAPTER
2.34 TO THE CHULA VISTA MUNICIPAL CODE ESTABLISHING A
CHILD CARE COMMISSION
The City Council of the City of Chula Vista does ordain as follows:
SECTION I: That the Chula Vista Municipal Code is hereby amended
by adding a new Chapter 2.34 to read as follows:
CHAPTER 2.34 CHILD CARE COMMISSION
Sec. 2.34.010 Purpose and Intent.
It is the purpose and intent of the City Council, in
establishing the Child Care Commission to create a special body
which is to serve as a resource, to advise, and to make
recommendations to the City Council and the City Manager on child
care issues affecting children living within the city. The
commission will work to identify child care needs and issues, and
to promote the availability of quality, affordable child care
within the community.
The purpose of the commission is to focus community energies and
resources on child care issues which, as accomplished, will
positively affect the physical, social, and the economic life of
Chula Vista.
Sec. 2.34.020 Functions and Duties.
The functions and duties of the Child Care Commission shall be
as follows:
A. Create a forum for city-wide discussions, research, and
analysis of critical issues of child care.
B. Mobilize agencies to develop resources and share them with
the community in a coordinated fashion.
C. Promote affordable child care within the city by providing
direct communications and recommendations to city
departments, boards and commissions with regard to such
issues as zoning, health, licensing, building codes, and
public safety.
D. Draft a child care policy for consideration and adoption by
the City of Chula Vista.

E. Address child care legislation issues.
F. Encourage cooperative approaches toward the development and
implementation of child care services.
G. Promote the creation of affordable, quality child care for
infants and toddlers.
H. Investigate and recommend sources of public funds for child
care.
I. Promote the creation of programs that are intergenerational.
J. Define the process and advise staff on appropriate procedures
and fees to increase the number of child care spaces
available in the city.
Sec. 2.34.030 Created-Appointment of Members-Term-
Rules and Regulations-Appointments.
A. There is created a Child Care Commission consisting of seven
members appointed by the City Council from the qualified
electors of the city in accordance with the provisions of
Section 600 et seq. of the Charter.
B. The members shall serve for a term of four years, except that
the initial appointment of two members shall be for a term of
one year, two members shall be for a term of two years, two
members shall be for a term of three years and one member
shall be for a term of four years. Each member shall serve
until his/her successor is duly appointed and qualified and
all vacancies shall be filled for the unexpired term of the
member whose place has become vacant.
C. The City Manager or his designated representative shall be an
ex-officio member of the commission, but shall have no vote.
D. The commission shall select a chairperson and
vice-chairperson from its membership annually, at the July
meeting.
E. The commission shall adopt reasonable rules and regulations
for carrying out the functions and duties of the commission
and governing its meetings. All reports and recommendations
shall be made in writing. All officers and department heads
shall cooperate with and render reasonable assistance to the
commission.

Sec. 2.34.040 Meetings-Quorum.
The Child Care Commission shall hold at least one regular
meeting each month on the day and at the time and in the place that
it shall designate by resolution and such special meetings as such
commission may require. Said meetings shall be subject to all
requirements of state and local laws governing notice and open
meetings.
Four members shall constitute a quorum for the transaction of
business.
Sec. 2.34.050 Ad hoc committees.
The commission may appoint, at its discretion, committees to
concern themselves with specific child care issues. These
committees may be composed of persons who are not members of the
commission, except that the chairperson of each such committee must
be a member of the Child Care Commission.
Sec. 2.34.060 Staff Assistance and Funding.
A. The City Manager may make available staff and clerical
support as required by the commission to ful fill its
functions and duties, provided such staff and clerical
support is available.
B. Subject to the approval of the City Council, the commission
may accept gifts and grants from any source to assist it in
the performance of its functions.
C. In the event such funds become available, the City Manager is
authorized, upon recommendation of the commission and
approval of the Council, to enter into appropriate contracts
for the utilization of such funds in furtherance of the
purposes and intent of, and the duties and functions of the
commission.
SECTION II. This ordinance shall take effect and be in full force
on the thirtieth day from and after its adoption.
