HomeMy WebLinkAboutOrd 1999-2782-BORDINANCE NO. 2782 B AN ORDINANCE OF THE CITY OF CHULA VISTA AMENDING CHAPTER 15.16 OF THE CHULA VISTA MUNICIPAL CODE ADOPTING THE CALIFORNIA MECHANICAL CODE, 1998 EDITION AND THE UNIFORM MECHANICAL CODE, 1997 EDITION THE CITY COUNCIL OF THE CITY OF CHULA VISTA DOES ORDAIN AS FOLLOWS: SECTION I. That Chapter 15.16 of the Chula Vista Municipal Code is hereby an3ended to read as follows: Chapter 15.16 MECHANICAL CODE AND REGULATIONS Sections: 15.16.010 California Mechanical Code, 1998 Edition and Uniform Mechanical Code, 1997 Edition, adopted by reference. 15.16.020 Section 108.1 amended [o designate building official. 15.16.040 Section 115 amended to specify h~nal fee structure. 15.16.010 California Mechanical Code, 1998 Edition and Uniform Mechanical Code, 1997 Edition, adopted by reference. There is hereby adopted by reference, that certain document known and designated as the California Mechanical Code, 1998 Edition , known as the California Code of Regulations, Title 24 part 4, and Uniform Mechanical Code, 1997 Edition and Appendix A, Chapter 13 of Appendix B, And Appendix C thereof as copyrighted by the International Conference of Building Officials ("UMC"). Said document is hereby adopted as the Mechanical Code of the City, providing for and regulating tile co~nplete installation and rnaintenance of heating, ventilation, cooling and refrigeration systems, and providing for the issuance of permits therefore, and each and all such regt~lations, provisions, penalties, conditions and terms of the California Mechanical Code, 1998 Edition and Uniform Mechanical Code, 1997 Edition and Appendix A, and Appendix C theleto are hereby referred to, adopted and made a part hereof as though fully set forth herein, except,lg such portions as are hereinafter deleted, modified or amended. 15.16.020 Section 108.1 amended to designate huihlin,q official. Section 108.1 of the UMC as it applies in Chula V~sta shall read as follows: Section 108.1 General, The buildh/g official m hereby authorized and directed to enforce all the provisions of this code. For sul:h rlurposes tile building official shall have the powers of a law enforcement officer. The building official shall have tile power to render ir/terpretations of this code and to adopt and enforce rules and regulations sul/plemen[al to this code as may be deemed necessary in order to clarify the application of the provisions of this code. Such Ordinance 2782-B Page 2 interpretations, rules and regulations shall b~; in conformity with the intent and purpose of this code. The building official, herein referenced, shall be tile assistant director of planning and building. 15.16.030 Section 11 O, 1 alnendnd to confer "suitability of alternate rnaterials" jurisdiction of Board of Appeals. Section 110.1 of tile UMC as ~t apphes in Chula Vista shall read as follows: Section 110.1 Board of Appeals and Advisors. To determine the suitability of alternate materials, methods of construction and to provide for reasonable interpretation of the provisions of this code, tilere shatl be and is hereby created a board of appeals and advisors consisting of seven members who are qualified by experience and training to pass upon matters pertaining to mechanical design, construction and maintenance and the public health aspects of mechanical systems and who are not employees of the jurisdiction, The building official shall be an ex-officio hietuber who shall not be entitled to vote and who shall act as secretary to the board. The beard shall be appointed lay the mayor and confirmed by the city council. The board shall render all decisions and findings in writing to the building official with a duplicate copy to the appellant. Tile decision of the board is final. 15.16.040 Subsection 115.1 amended to specify local fee structure, Subsection 115.1 of Seution 115 of the UMC as it applies in Chula Vista shall read as follows: Fees. Subsectioo 115,1 General, Fees shall be assessed in accordance with the master fee schedule of the city of Chula Vista. SECTION II. FINDINGS AND DECLARATION The City Council of the City of Chula Vista specifically and expressly finds and declares that the nature and uniqueness of the climate, terrain, and location does necessitate and demand specific amendments to the California Mechanical Code, 1998 Edition and the Uniform Mechanical Code, 1997 Edition which are noted in the Chula Vista Municipal Code and restated in this Ordinance. SECTION III. EFFECTIVE DATE. This ordinance will take effect and be in force on July 1, 1999.
