HomeMy WebLinkAboutOrd 1999-2777ORDINANCE NO. 2777 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA AMENDING THE ZONING MAP OR MAPS ESTABLISHED BY SECTION 19.18.010 OF THE CHULA VISTA MUNICIPAL CODE PREZONING 509 ACRES AT THE NORTHERN TERMINUS OF HUNTE PARKWAY A-8, AGRICULTURAL. WHEREAS, the property consists of approximately 509 acres located at the northern terminus of Hunte Parkway (site) and diagrammatically represented in the attached Exhibit A; and WHEREAS, a duly verified application for a prezoning was filed with the Planning Division of the Planning and Building Department on September 14, 1998; and WHEREAS, said application requested to prezone 509 acres A-8, Agricultural; and WHEREAS, the Planning Division of the Planning and Building Department set the time and place for a hearing on said request, together with its purpose was given by its publication in the newspaper of general circulation in the City and its mailing to property owners within 500 feet of the exterior boundaries of property at least ten days prior to the hearing; and WHEREAS, the hearing was held at the time and place as advertised, namely 7:00 p.m., March 10, 1999, in the Council Chambers, 276 Fourth Avenue, Chula Vista, California, before the Planning Commission and said hearing was thereafter closed; and WHEREAS, the Planning Commission found that the project would have no significant environmental impacts and adopted the Mitigated Negative Declaration issued for the project; and WHEREAS, from the facts presented, the Planning Commission has determined that the prezoning is consistent with the City of Chula Vista General Plan and that public necessity, convenience and good zoning practice support the prezoning to A-8, Agricultural; and WHEREAS, the Planning Commission found that the project would have no significant environmental impacts and adopted the Negative Declaration issued on the project, and voted 5-0 to recommend that the City Council approve the prezoning of the project site to A-8, Agricultural. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista does hereby find, determine, and ordain as follows: Section h Based on the findings and recommendation of the Environmental Review Coordinator, the City Council does hereby adopt Negative Declaration issued for the project. Section II: That the proposed prezoning is consistent with the City General Plan, and that public necessity, convenience, general welfare, and good zoning practice support the prezoning to City's Agricultural zone. Ordinance 2777 Page 2 Section IIh Section IV: That the zoning map or maps established by Section 19.18.010 of the Chula Vista Municipal Code are hereby amended to prezone the property Agricultural, as reflected in the Zoning Map, attached hereto and made a part hereof, to become effective only upon annexation of the property to the City of Chula Vista.
