RESOLUTION NO. 2008-273
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHULA VISTA RECITING THE FACT OF THE SPECIAL
MUNICIPAL ELECTION HELD IN THIS CITY ON
NOVEMBER 4. 2008, DECLARING THE RESULTS THEREOF,
AND SUCH OTHER MA TIERS AS ARE PROVIDED BY LAW
WHEREAS, a special municipal election was held and conducted in the City of Chula
Vista, California, on Tuesday, November 4, 2008, as required by law, for the purpose of electing
two (2) members of the City Council to Seats 3 and 4 for full terms of four years each, and for
submitting one citizen-initiated ballot measure (Proposition Q) to the electorate; and
WHEREAS, notice of said election was duly and regularly given in the time, form, and
manner as provided by law; and in all respects said election was held and conducted, and the
votes cast at the election received and canvassed, and the returns made and declared, in the time,
form, and manner as required by the provisions of the Elections Code of the State of California
for the holding of elections in charter cities; and
WHEREAS, pursuant to Resolution No. 2008-016 adopted January 15, 2008 and
Resolution 2008-161 adopted July 8, 2008, the election was consolidated with the statewide
general election, and the Registrar of Voters canvassed the returns of said election and has
certified the results. The results are received and made a part hereof, attached as Exhibit A.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City ofChula Vista
as follows:
SECTION I. There were 123 voting precincts established for the purpose of holding said
election consisting of the regular election precincts in Chula Vista as established
for the holding of state and county elections.
SECTION 2. The number of votes cast in the precincts was 46,385, and the number of vote- by-
mail ballots cast was 35,915 making the whole number of votes cast in the City
82,300.
SECTION 3. The names of the nominees for Seat 3 were Russ Hall and Pamela Bensoussan.
SECTION 4. The names of the nominees for Seat 4 were Scott Vinson and Steve Castaneda.
SECTION 5. The City Council does hereby declare Pamela Bensoussan as elected to the office
of Member of the City Council, Seat 3, to be sworn into office at the first meeting
of the City Council held in December 2008.
SECTION 6. The City Council does hereby declare Steve Castaneda as elected to the office of
Member of the City Council, Seat 4, to be sworn into office at the first meeting of
the City Council held in December 2008.

SECTION 7. The City Council does hereby declare that a maJonty of voters voting on
Proposition Q, relating to a Charter amendment to make the City Attorney an
elected position, voted in favor of it, and that the measure was carried and shall be
deemed adopted.
SECTION 8. The number of votes given at each precinct and the number of votes given in the
City to each of the persons above named for the respective offices for which the
persons were candidates, and for and against Proposition Q are listed in Exhibit
A, attached.
SECTION 9. The City Clerk shall enter on the records of the City Council of the City of Chula
Vista a statement of the results of the election, showing the whole number of
votes cast in the City, the names of the persons voted for, for what office each
person was voted for, and the number of votes given in the City to each person,
and for and against Proposition Q.
