CVRC RESOLUTION NO. 2008-006
RESOLUTION OF THE CHULA VISTA REDEVELOPMENT
CORPORATION ADOPTING A MITIGATED NEGATIVE
DECLARATION (IS-08-0ID), AND APPROVING A DESIGN
REVIEW PERMIT (DRC-08-023), TO ALLOW THE
CONSTRUCTION OF A 5,242 SQ. FT. BRANCH BANK
BUILDING ON THE SITE LOCATED AT 1232 BROADWAY
IN THE CITY OF CHULA VISTA
WHEREAS, the parcel, which is the subject matter of this resolution, is represented in
Exhibit A attached hereto and incorporated herein by this reference, and for the purpose of
general description is located at 1232 Broadway, Chula Vista; and
WHEREAS, on January 15,2008, duly verified applications for a Design Review Permit
(DRC-08-023) and Initial Study (IS-08-0ID) were filed with the City ofChula Vista on behalf of
the Wells Fargo Bank (Applicant) to enable the demolition of an existing 4,100 sq. ft. Brake
Depot building and construction of a 5,242 sq. ft. branch bank building with a drive-through
automated teller, 39 parking spaces, landscaping and associated signage, located at 1232
Broadway (Project); and
WHEREAS, the Project has been reviewed for compliance with the California
Environmental Quality Act (CEQA) and based on this review the Environmental Review
Coordinator determined that, although the proposed project could have a significant effect on the
environment, there will not be a significant effect in this case because mitigation measures have
been incorporated and agreed to by the proj ect applicant; and
WHEREAS, a hearing time and place was set by the Chula Vista Redevelopment
Corporation (CVRe) for consideration of the Project and notice of said hearing, together with its
purpose, was given by its publication in a newspaper of general circulation in the City, and its
mailing to property owners and residents within 500 feet of the exterior boundaries of the
property, at least ten (10) days prior to the hearing; and
WHEREAS, the Chula Vista Redevelopment Corporation held a duly noticed public
hearing to consider said application at the time and place as advertised, namely August 28, 2008
at 6:00 p.m. in the Council Chambers, 276 Fourth Avenue, before the Chula Vista
Redevelopment Corporation and said hearing was thereafter closed; and
WHEREAS, the Project is in conformance with the requirements of the City of Chula
Vista Zoning Ordinance, Design Manual, Landscape Manual and staff has developed Design
Review Conditions, provided as Exhibit B, to ensure the Project is developed and maintained
subject to certain criteria.
NOW, THEREFORE, BE IT RESOLVED that the Chula Vista Redevelopment
Corporation does hereby find, determine, and resolve as follows:

A. ENVIRONMENTAL DETERMINATION
The Environmental Review Coordinator has reviewed the proposed project for
compliance with the California Environmental Quality Act and has conducted an Initial Study,
IS-06-008, in accordance wjth the California Environmental Quality Act. Based upon results of
the Initial Study, the Environmental Review Coordinator determined that the project could result
in effects on the environment. However, revisions to the project made by or agreed to by the
applicant would avoid the effects or mitigate the effects to a point where clearly no significant
effects would occur; therefore, the Environmental Review Coordinator prepared a Mitigated
Negative Declaration, IS-08-0 10.
The Chula Vista Redevelopment Corporation finds that, in the exercise of its independent
judgment, as set forth in the record of its proceedings, the Mitigated Negative Declaration and
Mitigation Monitoring and Reporting Program (lS-08-010), which is on file in the Plarming and
Building Department, has been prepared in accordance with the requirements of the California
Environmental Quality Act (CEQA), and the Environmental Review Procedures of the City of
Chula Vista; and that the Project's environmental impacts will be mitigated by adoption of the
Mitigation Measures described in the Mitigated Negative Declaration, and contained in the
Mitigation Monitoring and Reporting Program, and that the Mitigation Monitoring and
Reporting Program is designed to ensure that during Project implementation, the
permittee/Project applicant, and any other responsible parties implement the project components
and comply with the Mitigation Monitoring Program.
B. CONFORMANCE WITH CITY DESIGN MANUAL
The Chula Vista Redevelopment Corporation does hereby find that the Project is in conformance
wjth the City of Chula Vista Zoning Ordinance, Design Manual, and Landscape Manual and
hereby approves the Design Review Permit (DRC-08-023), subject to conditions of Exhibit B,
attached hereto and incorporated herein by this reference.

Design Review 08-023 Conditions of Approval

The Chula Vista Redevelopment Corporation does hereby approve Design Review Permit DRC-
08-023 subject to the following conditions of approval. Unless otherwise specified, these
conditions of approval shall be implemented by the Applicant to the satisfaction of the Director
of Planning and Building, prior to the issuance of building permits:
PLANNING AND BUILDING DEPARTMENT CONDITIONS
The following conditions of approval shall be implemented to the satisfaction of the Director of
Planning and Building:
1. Applicant shall pay in full any unpaid balance for the Project, including Deposit Account No.
DQ1498.
2. The subject property shall be developed and maintained in substantial conformance with the
approved application, plans, and color and material board, except as modified herein.
3. Prior to the issuance of any permits required by the City of Chula Vista for the use of the
subject property in reliance upon this approval, the Applicant/Representative and property
owner shall execute this document by making a true copy of this letter of conditional
approval and signing both this original letter and the true copy on the lines provided below,
said execution indicating that the ApplicantlRepresentative and Property Owner have each
read, understood and agreed to the conditions contained herein, and will implement the same.
Upon execution, the true copy with original signatures shall be returned to the Project
Planner in the Planning and Building Department. Failure to return the signed copy of this
document within thirty days of the effective date hereof shall indicate the
Applicant's/Representative's or Property Owner's desire that the project, and the
corresponding application for building permits and/or a business license, be held in abeyance
without approval.

4. The proposed trash enclosures shall have a solid roof that is consistent with the colors and
materials of the rest of the enclosure. The trash enclosure site shall be graded in such a way
as to prevent run-on into the trash enclosure area.

5. All utility meters and closets shall be painted to match the colors of the building elevations or
shall be screened appropriately from public view.
6. The Applicant/Owner shall comply with all applicable federal, state, and local requirements,
and in any case where it does not comply, this permit is subject to modification or revocation.
7. This permit shall become void and ineffective if not used or extended within otie year from
the effective date thereof, in accordance with Section] 9. ]4.600 of the Municipal Code.
8. This permit shall be subject to any and all new, modified, or deleted conditions imposed after
approval of this permit to protect the public from a specific condition dangerous to its health
or safety or both due to the project, which condition(s) the City shall impose after advance
written notice to the permittee and after the City has given the permittee the right to be heard
with regard thereto. However, the City in exercising this reserved right/condition, may not
impose a substantial expense or deprive permittee of a substantial revenue source which the
permittee cannot, in the normal operation of the use permitted, be expected to economically
recover.
9. All ground mounted utility appurtenances, such as transformers, AC condensers, etc., shall
be located out of public view and adequately screened using a combination of concrete or
masonry walls, grade contouring (berming), and landscaping to the satisfaction of the Zoning
Administrator.
] O. Applicant shall provide precise grading plans with the submittal for building permits that
shall contain on and off-site spot elevations and grading/drainage information. A compaction
report and pad certification shall be required.
] I. Applicant shall provide a detailed landscape plan for review and approval with the building
permit submittal per Municipal code and Landscape Manual requirements. The detailed
landscape plans shall substantially conform to the approved concept landscape plan.
Landscape Plans shall show landscape irrigation and drainage within required planter areas.
] 2. Pedestrian walkways shall be constructed of decorative material such as a smooth salt-
textured finish with colors to be determined prior to approval of detailed landscape plans.
13. Plans submitted to the Building Division for building permits shall comply with applicable
codes and requirements, including but not limited to the 2007 Ca. Building Code (CBC) and
Ca. Handicapped Accessibility requirements, 2007 California Mechanical Code, 2007
California Plumbing Code, 2007 California Electrical Code, and 2005 California Energy
Code. Applicant shall complete and submit the "Building Code Summary Worksheet" for
commercial occupancies with submittal of the building permit application(s).
14. Applicant shall indicate on the building plans the type of occupancy and the type of
construction.
] 5. Curbs shall be used as wheel stops in the parking lot. Separate wheel stops are not permitted.

16. Parking spaces shall be 10 feet wide when located adjacent to vertical obstructions such as
walls or utilities and when space is located along the side of a pedestrian walkway.
17. Applicant shall obtain approval of sign permits from the Zoning Administrator for all signs
shown on approved DRC-08-023 signage plans. Sign permits shall comply with Section
19.60.540 of the Chula Yista Municipal Code (CYMe).
18. Applicant shall submit a revised colored building elevation showing that the utility door(s)
will be painted to match or blend with color scheme of the rear (west) elevation, to the
satisfaction of the Zoning Administrator.
19. The Applicant shall implement to the satisfaction of the City Environmental Review
Coordinator and the City Engineer the mitigation measures identified in the Mitigated
Negative Declaration (lS-08-0 10) and associated Mitigation Monitoring and Reporting
Program for the Project.
20. Prior to issuance of the building permit, a composite lighting plan shall be submitted and
approved to the satisfaction of the Planning & Building Department and Chula Yista Police
Department (CYPD). The lighting plan shall include:
a) A photometric lighting plan of outdoor areas such as walkways and building entries,
including lighting levels of 1.0 candlepower in parking lots and 0.5 candlepower in
other outdoor public areas.
b) Details such as location, design and elevations oflight fixtures.
c) Design, location and spacing oflight pole and fixtures shall meet the City standards.
d) Lighting shall be directed and shielded to minimize spillover onto streets or adjacent
properties.
e) Lighting shall comply with State of California (AB244) requirements in regards to
A TM security lighting.
ENGINEERING AND PUBLIC WORKS DEPARTMENT CONDITIONS
The following conditions of approval shall be implemented prior to the issuance of the building,
grading or improvement plans, to the satisfaction of the City Engineer:
21. The following fees shall be required based on the final building plans submitted:
a) Sewer Connection and Capacity Fees
b) Public Facilities DIF
c) Traffic Signal Fees
22. Additional deposits and fees in accordance with the City Subdivision Manual will be
required for the submittal of the following items:
a. Improvement Plans/Construction Permit (for Driveway removal)

23. Any private facilities within the public right-of-way or City's easement will reqUire an
encroachment permit.
24. The applicant shall obtain construction permits from the Engineering Department to perform
the following work in City's right-of-way. An approved construction permit is required prior
to Engineering releasing the Building Permit:
a. Applicant shall close northerly existing driveway to Broadway by removing curb cut and
installing parking spaces and landscaping to match existing lOft landscape buffer along
Broadway as shown on DRC plans.
b. Sewer lateral connections to existing public utilities. The Public Works Operations Sewer
Section will need to inspect any existing sewer laterals that are to remain to determine if
they require replacement.
c. Construction of non-monolithic curb, gutter, and sidewalk with proper transitions to
existing conditions.
d. Installation of driveways meeting design standards as shown in Chula Vista standard
detail CVCS-IA.
e. All utilities serving the proposed proj ect shall be underground.
f. Installation of pedestrian ramps meeting ADA standards.
25. Any onsite sewer and storm drain system shall be private. All sewer laterals and storm drains
shall be privately maintained from each building to the City maintained public facilities.
26. All proposed sidewalks and walkways, including those within or outside the public ROW,
pedestrian ramps, and disabled parking shall be designed to meet ADA standards.
27. The applicant shall complete the applicable Storm Water Compliance Form 5504 and comply
with the City of Chula Vista's Storm Water Management Standards Requirements Manual.
These forms shall be submitted with the building plans, to the satisfaction of the City
Engineer.
28. The applicant is required to implement Best Management Practices as identified in the
approved IS-08-0lO Mitigated Negative Declaration and Mitigation Monitoring and
Reporting Program to prevent pollution of storm drainage systems during the demolition
phase of the project.
FIRE DEPARTMENT CONDITIONS
The following conditions of approval shall be implemented to the satisfaction of the Chula Vista
Fire Marshall, prior to the issuance of the building permit:
29. Fire Lane/Signs shall be placed around the complex.
30. The building shall be provided with one Knox vault at the main entrance to the building.
31. Fire extinguishers shall be provided in the building as required by the Fire Code.

32. The building shall be addressed in accordance with the following criteria:
. 0-50 ft. from building to face of the curb = 6 inches in height with a I inch stroke.
. 51-150 ft. from the building to the face of the curb = 10 inches in height with a 1-
1/2 inch stroke.
. 151 + ft. from the building to the face of the curb = 16 inches in height with a 2
inch stroke.
GENERAL SERVICES DEPARTMENT CONDITIONS
33. Each applicant shall develop, submit and obtain approval of a "Recycling and Solid Waste
Management Plan" to the Environmental Services Program Manager for review and
approval, prior to issuance of the building permit. A synopsis of the plan shall be included in
the notes on the Building Plans. The plan shall demonstrate those steps that the applicant will
take to comply with Sections 8.24 and 8.25 of the Municipal Code, to meet the State mandate
to reduce or divert 50% of the waste generated by commercial, residential and industrial
developments. The applicant shall contract with the City's franchise hauler throughout the
construction and occupancy phase of the project.
OTHER CONDITIONS
Sweetwater Authority
34. Existing water services for commercial, landscape and fire protection use will be utilized for
the project. Should the driveway closure and re-design work conflict with any Authority
water facilities, submit improvement plans to the satisfaction of the District showing that the
water service facilities will be relocated at the applicant's expense.
Chula Vista Elementary School District
35. State law currently provides for a developer fee of $0.42 per square feet for non-residential
construction, for school facilities, payable at the time of application for building permits.
