CITY OF --- (HUlA VlSfA DECEMBER 2, 2008, ITEM --1- ITEM TITLE: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA RECITING THE FACT OF THE SPECIAL MUNICIPAL ELECTION HELD IN THIS CITY ON NOVEMBER 4, 2008, DECLARING THE RESULTS THEREOF, AND SUCH OTHER MATTERS AS ARE PROVIDED BY LAW SUBMITTED BY: Donna Norris, City Clerk J::te~ 'tJ77. 4/STHS VOTE: YES D NO 0 SUMMARY On December 2, 2008, the Registrar of Voters is expected to transmit the results of the Special Municipal Election held on November 4, 2008. Elections Code Section 10262(b) requires the City Clerk, as the City elections official, to certify the results of the election to the City Council, which shall adopt a resolution reciting the fact of the election. Charter section 3 OO( c) provides that the term of an elected member of the Council shall commence on the first Tuesday of December of the election year. Adoption of the resolution declares the results of the Special Municipal election. ENVIRONMENTAL REVIEW The Environmental Review Coordinator has reviewed the proposed actJvlty for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a "Project" as defmed under Section 15378 of the State CEQA Guidelines because it does not involve physical changes to the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is necessary. RECOMMENDATION Council adopt the resolution. BOARDS/COMMISSION RECOMMEl'<l)ATION Not Applicable. 1-1 DECEMBER 2, 2008, Item~ Page 2 of2 DISCUSSION A Special Municipal Election was held on November 4, 2008 to select two members of the City Council to fill Seats 3 and 4, for full terms co=encing on the first Tuesday of December 2008, and to submit a citizen-initiated ballot measure (Proposition Q) to the electorate. The certified results of the November 4, 2008 election are expected to be received December 2, 2008, and an updated report will be provided at that time. FISCAL IMP ACT $120,000 was budgeted in the 2008/2009 budget for the election. It is anticipated that the amount budgeted is sufficient. The results are received and made a part hereof, attached as Exhibit A. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City ofChula Vista as follows: SECTION 1. There were 123 voting precincts established for the purpose of holding said election consisting of the regular election precincts in Chula Vista as established for the holding of state and county elections. SECTION 2. The number of votes cast in the precincts was ,and the number of vote- by-mail ballots cast was , making the whole number of votes cast in the City SECTION 3. The names of the nominees for Seat 3 were Russ Hall and Pamela Bensoussan. SECTION 4. The names of the nominees for Seat 4 were Scott Vinson and Steve Castaneda. SECTION 5. The City Council does hereby declare Pamela Bensoussan as elected to the office of Member of the City Council, Seat 3, to be sworn into office at the fITst meeting of the City Council held in December 2008. SECTION 6. The City Council does hereby declare Steve Castaneda as elected to the office of Member of the City Council, Seat 4, to be sworn into office at the first meeting of the City Council held in December 2008. The City Council does hereby declare that a maJonty of voters voting on Proposition Q, relating to a Charter amendment to make the City Attorney an elected position, voted in favor of it, and that the measure was carried and shall be deemed adopted. SECTION 7. The number of votes given at each precinct and the number of votes given in the City to each of the persons above named for the respective offices for which the persons were candidates, and for and against Proposition Q are listed in Exhibit A, attached. SECTION 8. The City Clerk shall enter on the records of the City Council of the City of Chula Vista a statement of the results of the election, showing the whole number of votes cast in the City, the names of the persons voted for, for what office each person was voted for, and the number of votes given in the City to each person, and for and against Proposition Q.
