ATIONS: None. 4.A, RESOLUTION 16361 RESCINDINGCITYCOUNCILRESOLUTION16337WI-HCHWAIVEDPUBLIC FAcil.rrll/S DEVELOPMENT IMPACT FRI;_~; FOR SILVERCREST APARTMENTS - On 9/3/91 the Council adopted Resolution 16337 waiving $161,2S0 in Public Facilities Development Impact Fees CPFDIF) for Silvercrest Apartments, a 7S-unit low-income senior project funded by HUD and being developed by the Salvation Army. Additionally, on 9/19/91 the Redevelopment Agency appropriated $114,000 from the Low and Moderate Income Housing Fund to pay the projeet's Sewer Facilities Participation Fee. On 9/24/91 Council asked that Resolution 16377 be returned for Council reconsideration at the 10/1/91 meeting. At the 10/1/91 Council meeting staff was directed to again return to Council for reeonsideration and also to prepare a report to the Agency for consideration. Staff recommends that Council: 1) reconsider Resolution 16337 and accept Alternative 2, and 2) adopt the resolution rescinding Resolution 16337. 156S0 Mayor/Chairman Nader stated that South Bay Community Services had expressed concern that this item could possibly affect a project they are doing regarding affordable housing, Chris Salomone, Director of Community Development, responded that staff was investigating both proposals by that group. Staff did not feel they would suffer any prejudice by taking this action. City Manager/Director Goss stated that the word "prejudice" was a good one as there may be other projects out there, including theirs, competing for that fund. Minutes October 8, 1991 Page 2 B. ORAL COMMUNICATIONS Richard Hermosillo, 3323 Alvoca Street, Chula Vista, CA, representing the Otay Town Committee, invited the Council/Agency to attend the Second Annual Otay Community Fair which will be held on October 19th from 10:00 a.m. to 4:00 p.m. There will be kiddie rides, car show, sky diving demonstration, three live bands, and other activities. He also thanked the Council and staff for their assistance in the organization of the Fair. Councilman Rindone stated the Fair was excellent last year, complimented the Community for banding together, and wished them well this year. ACTION ITEMS None submitted. Informed the Agency that the Scripps project had been scheduled for review at the meeting of 10/17/91. The project will be considered by the Planning Commission on 11/6 and by the Project Area Committee on 10/7. One of the suggestions was to push the review to the first Thursday, Minutes October 8, 1991 Page 3 November 7th. He realized that one member of the Agency had a work commitment on the first Thursday but was not sure how this could be worked out. Chris Salomone, Director of Community Development, responded that it was a tentatively scheduled meeting for the Scripps project. It will not be heard on 10/17 as there are a number of other items that are scheduled for that meeting. At this point staff had encountered some last minute problems with the project and therefore wanted to keep the option of a regularly scheduled Agency meeting the first week of November. Typically, for the last several months, the first Thursday meeting has been moved to Tuesday night. They were asking if it would be appropriate to contemplate having at public hearing at 6:00 p.m. on 11/7/91. City Manager/Director Goss stated that it would appear another option would be one week later or if there was a light agenda on the following Tuesday, pairing it with that meeting. He suggested this in case there was a conflict for Members, and secondly, it would allow time to write up any actions or minutes from the Planning Commission or PAC for Agency review. City/Agency Attorney Boogaard stated that before there was any deliberation on the issue he questioned whether Members were talking about the November 7th meeting. It is one month away and since there has been accusations or considerations of litigation regarding that project, he requested that this item be docketed with agenda notice for the next regularly scheduled Council or Agency meeting. Mayor/Chairman Nader stated that the project was currently on the Agency agenda for October 17th and all that was currently under discussion was whether what was docketed should be considered at some other date. City/Agency Attorney Boogaard responded that there had been a lot of concern by the other parties to the Scripps project that they haven't been given notice of discussions of this proceeding and were assembling a portfolio. It was his recommendation that there be no deliberation, ff at all possible, to delay deliberation on scheduling meetings until it can be done as a regularly docketed item. Mayor/Chairman Nader questioned if scheduling was delayed until the October 17th meeting if it would be more desirable. City Manager/Director Goss stated that the Scripps project was originally scheduled for October 17th. Unless there is some formal notification process, this could be done on a discretionary basis, City/Agency Attorney Boogaard responded that he would prefer that this be done administtatively if possible.
