The goal of the DOR's program is to reach and maintain an 80 percent recycling rate for all California Redemption Value (CRV) beverage containers - aluminum, glass, plastic and bi-metal. Projects implemented by cities and counties assist the DOR in reaching and maintaining that goal. Each city is eligible to receive a minimum of $5,000 or an amount calculated by the DOR, on a per capita basis, whichever is greater. Chula Vista received $59,740 for Fiscal Year 2008/2009. ENVIRONMENTAL REVIEW The Environmental Review Coordinator has reviewed the proposed activity for compliance with the California Environmental Quality Act (CEQA) and has determined that the activity is not a "Project" as defined under Section 15378 of the State CEQA Guidelines; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines the activity is not subject to CEQA. Thus, no environmental review is necessary. RECOMMENDATION That Council adopt the resolution. BOARDS/COM1VIISSION RECOMMENDA nON Not applicable. 3-1 09/16/08, Item~ Page 2 of2 DISCUSSION The Beverage Container and Litter Reduction Act (Section 14581 (a)(5)(A)) requires that the Department of Conservation - Division of Recycling (DOR) distribute approximately $10.5 million per year to eligible cities and counties for beverage container and litter reduction activities. Chula Vista has been awarded $59,740 as calculated on a per capita basis. These funds assist the City of Chula Vista in meeting and maintaining the State mandated landfill diversion goal (AB 939, the California Integrated Waste Management Act) by funding program activities to increase the City's diversion of rigid containers: glass, aluminum, steel and plastic food and beverage containers. DECISION MAKER CONFLICT Staff has reviewed the decision contemplated by this action and has determined that it is not site specific and consequently the 500 foot rule found in California Code of Regulations section 18704.2(a)(I) is not applicable to this decision. FISCAL IMPACT The funds are awarded upon request and are directed to beverage container and litter reduction programs. There is no impact to the General Fund as a result of accepting these funds or implementing the program described. ATTACHMENTS A. Online Grant Application B. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Chula Vista authorizes the submittal of the annual application for funds to the California Department of Conservation, Division of Recycling - Beverage Container and Litter Reduction Act - City and County Payment Program for all available funding. BE IT FURTHER RESOLVED, that the City Council of the City of Chula Vista authorizes the City Manager or Designee to execute all documents associated with application and acceptance of the funds through June 30, 2012.
