(Unocal), has appealed the Chief of Police's finding that an alcoholic beverage license would not serve Public Convenience or Necessity. ENVIRONMENTAL REVIEW This proposed activity has been reviewed for compliance with the California Environmental Quality Act (CEQA) and it has been determined that the activity is not a "Project" as defined under Section 15378 of the State CEQA Guidelines because it will not result in a physical change in the environment; therefore, pursuant to Section 15060(c)(3) of the State CEQA Guidelines, the activity is not subject to CEQA. Thus, no environmental review is necessary. RECOMMENDATION That Council adopt Resolution A BOARDS/COMMISSION RECOMMENDATION Not applicable 5-1 08/12/2008, Item 5: Page 2 of6 DISCUSSION The Department of Alcoholic Beverage Control (ABC) is responsible for the issuance of licenses for the sale of alcoholic beverages in the State of California. Section 23958 of the Business and Professions Code gives ABC the authority to deny an application for a license if such a license would result in an over-concentration of licenses and/or a higher than average crime rate in the area. The Business and Professions Code requires the local governing body to determine if a public convenience or necessity is served by the issuance of the alcoholic beverage license given ABC's initial determination of over-concentration and/or high crime rate. The local governing body must affirmatively sign a "Public Convenience or Necessity" form in order for the business to obtain an alcoholic beverage license. Process for Public Convenience and Necessity (PCN) Once ABC has determined that there is over-concentration and/or high crime in the census tract where the application is submitted, the applicant must submit a "Public Convenience or Necessity" form to the Chief of Police. Once the Chief of Police receives the form from the applicant, a determination hearing is scheduled. The determination hearing is an open meeting and the Police Department solicits responses from the community by sending a letter to all business owners and residents within 500 feet of the applicant premises notifying them of the determination hearing; they can also leave a telephone message with a detective to voice their support for or protest of the license. The business must also post a notice of the application on the premises. The Chief of Police then determines whether a public convenience or necessity exists. The decision is based on the following criteria: the convenience or necessity of alcohol sales to the citizens in the area, the history of the subject business and/or owner, existing conditions at the site or in the vicinity (e.g., potential' for creation of a police problem or aggravation of an existing problem), and the crime rate within the vicinity of the application. If the Chief finds that there is no public convenience or necessity, the applicant may appeal the decision to the City Council. Upon the filing of the appeal with the City Clerks Office, the matter is set for a public hearing before the full City Council. The process of determining public convenience or necessity is found in Chula Vista Municipal Code Chapter 5.09. (See Attachment 1) Unocal 76 Appeal Kamal Habib Nona, owner of Melrose Orange Unocal 76, Inc. (Unocal), started the application process for an off-sale beer and wine license (ABC License Type 20) with ABC on April 11 t\ 2008. ABC made the determination that there is an over concentration of alcohol sales in the same census tract. The applicant then filed a "Public Convenience or Necessity" form with the Chula Vista Police Department per ABC requirements (see Attachment 2). On May 14th, 2008, the Chula Vista Police Department held a determination meeting to gather input on Public Convenience or Necessity for Unocal. On June 9'\ 2008, the Chief of Police notified Mr. Nona and the City Clerk of Chula Vista, that the alcoholic beverage license did not meet Public Convenience or Necessity (see Attachment 3). On June 17ili, 2008, Mr. Nona appealed the Chief of Police's finding that an alcoholic beverage license would not serve Public Convenience or Necessity (see Attachment 4). 5-2 08/12/2008, Item 5 Page 3 of6 The Chief of Police based the finding and denial on the following criteria: 1) A public hearing was held on May l4t\ 2008 at the Chula Vista Police Department regarding the public convenience or necessity of an alcoholic beverage license for Unocal. Detective Mike Varga recorded responses at the hearing, as well as responses via telephone and letter. A total of one hundred ten (110) people voiced opinions on the alcoholic beverage license for Unocal; one hundred eight (108) in opposition and two (2) in support of the issuance of an ABC license at 1495 Melrose Avenue. Five individuals sent letters to the police department during the open comment period, stating their opposition to the issuance of an ABC license for Unocal; no one sent a letter in support of the license (see Attachment 5), A petition signed by eighty-four (84) individuals was received by the police department, which stated their opposition to the issuance of an ABC license for Unocal (see Attachment 6). Ten individuals attended the Public Convenience or Necessity hearing on May 14th, 2008 and stated their opposition to the issuance of an ABC license for Unocal. One individual, the owner of Unocal, attended the PCN hearing and stated his support of the license (see Attachment 7). Nine individuals called during the open protest and either spoke directly with Detective Mike Varga or Analyst Kristen Miggans or left voicemails stating their opposition to the issuance of an ABC license for Unocal; one individual called to support the issuance of a license (see Attachment 8). ABC limits the number of off-sale beer licenses in a city. The number of beer and wine licenses allowed in a city or county in combination with off-sale general licenses is set at one for every 1,250 people. The ratio of off-sale retail licenses to population in UNOCAL's census tract exceeds the ratio of off-sale retail licenses to population in the city. ABC calculates that three off-sale licenses are permitted in tract 13306 and currently three businesses have off-sale licenses in the census tract. Figure 1 (page 4) identifies the high concentration of alcoholic beverage license locations near Unocal. There are two type 21 ABC licenses (Bobar Liquor at 1459 Melrose Avenue and Albertsons at 285 East Orange Avenue) within 500 and 250 feet of 1495 Melrose Avenue that serve liquor, wine, and beer. There is another type 20 ABC license (7 Eleven at 1475 Melrose Avenue) which is adjacent to 1495 Melrose Avenue that serves beer and wine. Several studies show that increasing the number of alcoholic beverage licenses is related to increased violence in that area.2 One research study found that in a typical Los Angeles County city, one alcohol outlet was associated with 3.4 additional violent assault offenses in one year.3 A six-year study of 551 urban and rural zip codes in California found that an increase in the number of bars and off-sale stores -- such as liquor stores, convenience stores, and grocery stores -- was related to an increase in the rate of violence. 4 Therefore, based on the findings listed above, the Chief of Police determined that public convenience or necessity does not exist for the issuance of an alcoholic beverage license at 1495 Melrose Avenue (Unocal). 2 Roncek, D. & Maier, P. Chuld Vista Police Department 5-6 ATTACHMENT 1 Chula Vista Municipal Code Chapter 5.09 ALCOHOLIC BEVERAGE LICENSES 5.09.010 Determination of public convenience or necessity- Purpose and intent State law requires that applicants for certain types of alcoholic beverage licenses obtain from local jurisdictions a determination that public convenience or necessity is served by the issuance of said license, if the subject premises is not located in an area which has an overconcentration of alcoholic beverage licenses and/or a higher than average crime rate as defined in Section 23958.4 of the Business and Professions Code Where the State Department of Alcoholic Beverage Control requires a determination of public convenience or necessity, the chief of police is authorized to consider and approve, disapprove, or modify applications for this determination (Ord. 2705 S 2, 1997). 5.09.020 Determination of public convenience or necessity - Application - Fee. Applications for a determination of public convenience or necessity shall be made to the chief of police in writing on a form prescribed by the chief of police and shall be accompanied by data sufficient to describe the proposed operations for which the alcoholic beverage license and the determination of public convenience or necessity is required. The application shall be accompanied by a deposit as presently designated, or as may in the future be amended, in the master fee schedule (Ord. 2705 S 2, 1997). 5.09.030 Determination of public convenience or necessity- Procedure - Notice required. The chief of police shall post (or shall require the applicant to post) a notice of the application on the premises which is the subject of the application. The chief of police shall further provide notice of the public hearing by mailing to property owners of record and residents within 500 feet of the site which is the subject of the application. (Ord. 2705 S 2, 1997) 5.09.040 Determination of public convenience or necessity - Criteria for consideration. Upon the conclusion of the public hearing, the chief of police may make a determination that public convenience or necessity is or is 5-7 not served by the issuance of an alcoholic beverage license. The chief of police may condition a determination of public convenience or necessity. This decision may be based upon, but not limited to, the following factors: A History of the subject business and/or owner. B. Existing conditions at the site or in the vicinity (e.g., potential for creation of a police problem or aggravation of an existing problem). C The crime rate within the vicinity of the application (Ord. 2705 S 2, 1997) 5.09.050 Determination of public convenience or necessity- Appeals. The applicant or other interested party may appeal the decision of the chief of police to the city council within 10 days after said decision is filed with the city clerk. Said appeal shall be in writing and filed with the city clerk upon forms provided by the police department, and shall specify the reasons the appellant believes there was an error in the decision of the chief of police. If an appeal is filed within the time limit specified, it automatically stays proceedings in the matter until a determination is made by the city council (Ord 2705 S 2, 1997) 5.09.060 Determination of public convenience or necessity - Appeals - City clerk duties. .1 Upon the filing of the appeal, the city clerk shall set the matter for public hearing, giving the same notice as required in CVMC 5.09.030. The city clerk shall send the chief of police a duplicate copy of the appeal and request the chief of police to transmit to the city council a copy of his decision and findings, minutes of any hearings, and all other evidence, maps, papers, and exhibits upon which the chief of police made his decision. This form is necessary in order for the business to obtain an ABC license. The Chula Vista Police Department has found that an ABC license at 1495 , Melrose will NOT serve PC or N (Public Convenience or Necessity). The Chula Vista Police Department bases this finding on the following: 1. The addition of another Alcoholic Beverage Control (ABC) License would cause the area to become over-concentrated. Currently there are only three licenses authorized for that area, and there are three licenses in existence. 2. Opinions from public expressed during the 30 day public comment period and at the public hearing: 108 individuals opposed issuance of the ABC license, and 2 individuals did not oppose issuance of the license. Members of the public expressed the following concerns: a. Over concentration of alcohol licenses already in existence (3 alcohol outlets within a 100 yard radius); b. The first issue is whether or not thc subject premises are located in an area which has an overconcentration of alcoholic beveragc licenscs. Hele, there are currently thrce licenses, all ofwhich are at allegedly about 300 feet away from the subject premises One license (Type 20) belongs to 7-] I which is next to the subject premises and happens to be one of the objecting parties who appeared at the hearing.. The second license (Type 11) belongs to a liquor store in the area who was also an objecting parly at the hearing. Thc third license (Type 21) belongs to Albertson's supemJatket which is further down the road. Although there are only Ihree licenses authorized for this area, only one Type 20 license exists in this district.
