HomeMy WebLinkAboutReso 2008-174 RESOLUTION NO. 2008-174 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CHULA VISTA LEVYING THE ASSESSMENTS AND COLLECTIBLES FOR THE TOWN CENTRE MAINTENANCE DISTRICT WHEREAS, prior to the adoption of this Resolution, the City Council caused the formation of various districts under and pursuant to state law; and WHEREAS, pursuant to Article 4, Chapter 1, part 2 of Division 15 of the California Streets and Highways Code, also known as "Landscaping and Lighting Act of 1972" and Chula Vista Municipal Code Chapter 17.07, NBS Government Finance Group dba NBS has prepared and filed, on behalf of and under the direction of the City Engineer, the annual Engineer's Report for the Town Centre Maintenance District; and WHEREAS, on June 17,2008, Council approved this annual Report and set July 8, 2008 as the date for the public hearing; and WHEREAS, the proposed assessment for fiscal year 2008/2009 is as follows: "Ai.s.~sm.o",,,,,,,~..'.. .....:..con~"""EOU ...""......ment""::COl~.... > Open Space District or Proposed FY Proposed FY Projected Zone FY 07/08 08/09 FY 07/08 08/09 Variance C$l Variance l%l Revenue Town Centre (1' 0.1 1 o. 1 2 - 0.00 - - 0.00 Total Projected Revenue $0.0 (1) Town Centre rates have been based on parcel square footage since FY 2001/02. However, a Downtown PBID replaced this District in 2001, but the City determined that there was some potential long-term exposure for the City based on the remote potential that the current PBID might not receive sufficient support for re-approval in the future. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Chula Vista, as to the Town Centre Maintenance District, as follows: 1. That it finds that written protests against the proposed assessment have not been made by owners representing more than one-half of the area of land to be assessed. 2. That it confirms the diagram and assessment contained in the Engineer's Report. 3. That it orders that the open space and maintenance facilities be maintained. Resolution No. 2008-174 Page 2 BE IT FURTHER RESOLVED by the City Council of the City of Chula Vista that the adoption of this Resolution constitutes the levy of assessments and collectibles as proposed in the Engineer's Report for the 2008/2009 fiscal year for the Town Centre Maintenance District.
