MEtCf, ADOPTING MITIGATION MONITORING AND REPORTING PROGRAM AND STATEMENT OF OVERRIDING CONSIDERATION FOR SEIR-92-O2 (second reading and adoDtion) - The applicant is requesting approval of an amendment to the General Plan and the E1 Rancho del Rey Specific Plan to redesignate the westerly 55 acres of the existing Rancho del Rey Employment Park from Light Industrial/Employment Park designation to Retail Commercial/Commercial Center. The proposed amendment also involves modification to the Employment Park Design Guidelines, Planned Community District Regulations, Public Facilities Financing Plan, New Air Quality Improvement Plan, and Water Conservation Plan. Staff recommends Council place ordinance on second reading and adoption. (Director of Planning) Tom Davis, 1657 Gotham Street, Chula Vista, CA, spoke in opposition to the staff recommendation. He stated the issue of a previous agreement for density transfers with the original developer had not been addressed. There had been a lot of public participation at the Planning Commission and City Council level but he did not feel tile public had been given any compromises or anything; the developer got everything. He didn't feel the system was working tight. 7, RESOLUTION 16912 APPROVING COMPENSATION AND FRINGE BENEFITS FOR THE MAYOR/COUNCIL SECRETARY FOR FISCAL YEAR 1992-93 Minutes November 30, 1992 Page 2 Councilman Rindone informed Council that the resolution included a $265 increase in the market basket which had not been included in the recommendation. It was an omission in the recommendation and was consistent with the increase given to unrepresented employees. * * END OF CONSENT CALENDAR * * PUBLIC HEARINGS AND BRLATED RESOLUTIONS AND ORDINANCES None submitted. ORAL COMMUNICATIONS Tom Davis, 16S7 Gotham Street, Chula Vista, CA, expressed his concern that the recommendation to the Southwestern College Board for the transit center was the original recommendation to Council, i.e. the front lawn of the College. He felt Council's direction in June to staff had been very clear in that they did not want it placed in that location. He felt the citizens were right back where they had started. The minutes will reflect the published agenda order. OTHER BUSINESS 9. CITY MANAGER'S ~RT(S) - None. 10. MAYOR'S REPORTfS) · Mayor Pro Temp Malcolm stated he had voted for the "power center" on "H" Street and felt it would be a good addition to the City. The citizens would receive $2.7 million in revenues, $1.2 - $1.7 million in Minutes November 30, 1992 Page 3 net revenues. The developer also gave away his rights to develop some projects in the development agreement whereby there would be a reduction in the tTaffiC trips during the rush hours. The project would use 35% less water than the existing zoned project and it was well designed. He did not feel that the citizens went unheard. · Mayor Pro Temp Malcolm stated the Council had been clear in their direction regarding the Transit Center in that they did not want the grass disturbed. Mr. Morris stated there had been a number of meetings as well as a presentation to the Southwestern College Board of Directors. Staff would be coming back with further cost items and recommendations on the three top choices of the group. One of the options did take away a portion of the grass but the Governing Board of the College asked for further information on that recommendation. Mayor Pro Temp Malcolm stated that the City Council had not committed or appropriated funds until the Council voted on the item. 11. COUNCIL COMMENTS Councilman Moore: · Councilman Moore referred to the public hearing for Rancho del Rey and felt the City had a good system. If staff and the boards/commissions did their jobs it should be a "slam dunk" by the time it went to Council. It was a good project but he would be looking for an answer as to whether the City had given a density bonus for the industrial park. Councilman Rindone: · Councilman Rindone stated he was concerned in how the Transit Center was developing. There had been increased public participation on the issue and a number of plans examined by everyone. There were three plans that were favored over the others but Plan 6B (6.1) was the first choice. Mr. Davis was addressing a concern that some of the College officials were focusing on Plan 1B.1. The concern expressed by the community to the Council was heard loud and clear and received a unanimous vote by the Council for not placing the Center on the lawn and to find alternatives. Council could not direct the College where to place the Center as it was their land but he encouraged the Board of Trustees to listen to public input on the issue. He encouraged the public to transmit their concerns to the College Board. Staff also needed to make the Council position clear in their presentation to the Board. City Attorney Boogaard informed Council that the Transit Center was not an agendized item and questioned whether Council wanted the item placed on a future agenda. Counc~man Rindone felt it was important that all possible transit stops be available and not be eliminated by any choices. · Councilman Rindone offered congratulations to Councilman Malcolm for his excellent senrice to the community. ADJOURNMENT City Attorney Boogaard informed Council that there was no need to discuss the institution of litigation regarding acquisition by eminent domain. The City Council met in a closed session at 4:35 p.m. to discuss: Minutes November 30, 1992 Page 4 Pending litigation against City of San Diego vis-a-vis Cost Allocable to Chula Vista under Clean Water Program - pursuant to Government Code Section 54956.9(a) Institution of litigation regarding acquisition by eminent domain of certain real properties located in public fights-of-way throughout the City - pursuant to Government Code Sections 54956.8 and 54956.9(c) ADJOURNMENT AT 4:45 P.M. to the Regular City Council Meeting on December 8, 1992 at 6:00 p.m. in the City Council Chambers.
