MEMBERS PRESENT: Richard Schulman, Joanne Carson, Jean Rogers Juan Gonzales, Chet DeVore and Susan Herney (arrived at 4:00 p.m.) MEMBERS ABSENT: Billy Kelley OTHERS PRESENT: Assistant city Attorney Fritsch John Goss, City Manager Toni McKean, Ethics Program Staff Frank and Colleen Scott The meeting was called to order at 3:50 p.m. Approval of Minutes. MSUC (DeVore/Carson) to approve the minutes of August 26, 1996. Introduction: New Board Member Juan Gonzales. Juan Gonzalez introduced himself and gave a brief autobiography. Consideration of Letter from Frank Scott The Chairman introduced Mr. Frank Scott who discussed his September 4, 1996 letter to the Chairman concerning four "incidents" involving city officials which he felt should have warranted action by the Board of Ethics. Mr. Scott, city Manager Goss and member of the Board discussed the incidents. Mr. Scott stated his intent was not to make a formal complaint since the time limit for Board action on these matters had passed. However, he stated that the Ethics Program would not be effective if the Board did not take some action to look into such matters in the future. Members of the Board thanked Mr. Scott for raising this issue and discussed the desirability of having a workshop on the handing of reports of possible future inappropriate actions regardless of whether a formal complaint has not been filed. Members Gonzales and DeVore recommended that a letter be sent to Mr. Scott expressing our appreciation and indicating the Board's response to allegations raised in Mr. Scott's letter. Board of Ethics Minutes September 16, 1996 Page Two The City Manager agreed with the summary of the meeting in the Chairman's letter to him of September 3, 1996. He stated that he had made Toni McKean's supervisors aware of the need to allow her work time to support the Ethics Program. He indicated that he anticipated that normally she would be able to work on the program every week. Also, the City Manager stated that he thought that it was a good idea to have someone in each department with special responsibilities in the implementation of the Ethics Program. The Chairman suggested that the City Manager consider having the Building and Housing Director present a training program which he had done for Building Officials to the City department heads. Also, that the Planning Director and Ms. McKean share with the department heads their experience in preparing the ethics statement for the Planning Department. Member Herney asked about a response to a letter she had sent to the city Manager when she was Chairman inquiring about the status of the Ethics statements from the departments. Toni McKean said she had a list which she would provide to the Board. Also, Toni McKean stated that she would meet with the Chairman to discuss a work plan for her activities for the current fiscal year. Complaint: Port Commissioner Attorney Fritsch explained that she has conflict of interest since she represented the Port Commissioner who is subject of this matter. Ms. Fritsch stated she will see if another attorney can be assigned to advise the Board on this matter who has no conflict. This item trailed to the next meeting. Time Limitation Individual Complaints. Trailed to next meeting. Billv Kellev Leave of Absence Request The Chairman reported that Armando Buelna, Assistant to the Mayor and Council indicated to him that a Subcommittee of the Council was meeting on this matter on September 17, 1996. He anticipated that they would recommend that Mr. Kelley be appointed to the first vacancy on the Board after Mr. Kelley indicated his availability.
