ROLL CALL: Present: Councilmembers Moore and Rindone and Mayor Nader. Absent: Councilmember Malcolm who had faxed a waiver of notice of special council meeting from Cancun dated 6/21/91. 2. NOTICE OF SPECIAL MEETING: The City Clerk stated that the Notice and Call of Special Meeting was posted in a location that was freely accessible to members of the public Cner GC §S4956) in the manner required by law; was telecopied to the newspapers of general circulation, radio, and television stations requesting wri~en notice of same twenty-four hours in advance, and was personally delivered to the members of the Council twenty-four hours in advance, or a waiver of notice from such Councilmember is on file in the Office of the City Clerk. 3. WAIVEROFNOTICEFORABSENTCOUNCILMEMBERS: Speci~cally, CouncilmanMalcolmhas~led, by telecopier, with my office a Waiver of Notice and Call of Special Meeting. The presence of the remaining councilmembers waives any potential defect as to the timing and content of the notice and call of the special meeting. BUSINESS 4. PIJRPOSE OF MEETING: Mayor Nader stated the purpose of the meeting was to consider, deliberate, and act upon the granting of salary increases to all employees, included Council-appointed employees, without regard to whether they are represented or unrepresented, to further deliberate upon whether and in what manner said increase should be condition upon the passage of AB 1040 (Mays), to further deliberate and act upon accepting a waiver of the duties imposed under the Meyers-Millias-Brown Act, and if possible, to deliberate and act upon required appropriation for same. City Manager Goss presented a staff report and background information. He stated that the city;s lobbyist informed the City that AB 1040 has gone to the governors desk for signature. They expect it will be signed early next week. Staff is requesting that Council approve file Resolution in case AB 1040 goes into affect. The goal is to protect us from revenue losses and protect the employees from internal inequities. A 5% amount is being recommended which ties into what CVEA and POA will be receiving under their contracts. Mr. Goss stated that he felt this action would protect the city's most valuable asset -- our employees. He stared we would be going into the new budget year with a $7.2 million surplus. Although he did not have all the figures worked out, he presented some general figures as follows: MINUTES -2- JUNE 22, 1991 is to protect us from revenue losses and protect the employees from internal inequities. Although he did not have all the figures worked out, he presented some general figures as follows: Project Surplus (,projected in $ 600,000 Loss 1/2 fines & 7% motor $ 552,000 the budget) vehicle fees Property Tax (was not in $ 150,000 Salary Increases (money State $ 824,250 budget) would ~ake away if we keep contracts) Other Income (was not $ 300,000 Total $1,376,250 included in revenue projections) Reduce Public Liability Trust $ 526,400 Fund Total $1,576,400 Othe~ Transfers: GolfCours~ $ 300,000 CIP $ 158,316 Total $ 458,316 GRAND TOTAL $2,034,716 Councilman Moore asked if the City Manager had some tentative form of action if the State took too much money. City Manager Goss responded that all of the contracts have a clause which allows renegotiation by mutual consent if there is a substantial revenue loss. Councilman Rindone asked that if there is an assumption made and AB 1040 does not pass, how does this return to the beginning'? City Attorney Boogaard responded by quoting Section 4 and 5 on page 2 and 3 of the resolution which stabs as follows: MINUTES -3- JUNE 22, 1991 "Section 4...subject to the right of the City to reduce future payrolls, pro rata, in the 1991-92, and/or the 1992-93 fiscal years, by the mount, if any, that the amount of such increase as may be negotiated based on the terms and conditions as are set forth in the POA-MOU exceeds the cost of the increase herein granted to such employees to the City, which right may be exercised only upon the failure of the State Legislature to enact, during its current session, into law, Assembly Bill 1040..." "Section 5...subject to the City's right of termination upon the failure of the State Legislature to enact, during its current session, into law, Assembly Bill 1040..." Mayor Nader op~ned the meeting for public comments. Addressing Council was: Eliseo Medina, 244 Palomar, Executive Director of San Diego Employees Association and representing CVEA. He commended Council for the action they arc taking. City Attorney Boogaard stated there is an amendment to the resolution. The following to be added just before the "NOW THEREFORE": "WHEREAS, the City Council has resolved that all other employees ("Unrepresented Employees"), categorized by the following negotiating groups, not officially recognized bargaining units, to wit: Middle Management (consisting of approximately 60 employees) ("MM'), Executive Group (consisting of approximately 26 employees) ("EG"), and all other employees which are unrepresented and undassi~ed including all hourly employees -- are and will be entitled to compensation for the 1991-92 City fiscal year, commencing June 28, 1991 in an amount which is currently unfLxed and uncertain; and" Also to be added at the end of Sections 3, 4, 5, and 6 the following: "...or if enacted, upon a final judicial determination of its invalidity." RESOLUTION 16229 GENERALLY AUTHOR/ZING CERTAIN SALARY INCREASES FOR ALL CITY EMPLOYEES. Resolution offered by Mayor Nader as amended, reading of the text was waived, and passed 3-0-1 (Malcolm absent). 5. OTHER BUSINESS: There was none 6.
