RESOLUTION NO, 576
RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE
CITY COUNCIL THE ADOPTION OF AN AMENDMENT TO THE ZONING ORDINANCE
ESTABLISHING A PROCEDURE FOR CHANGING SETBACK LINES
WHEREAS, it has come to the attention of the Planning Commission that there
is no clearly delineated procedure in the Zoning Ordinance for establishing or
changing setbacks, and
WHEREAS, the Commission desired to consider an amendment which would
provide a procedure to establish setback lines, and
WHEREAS, the Planning Commission set the time and place for a hearing on
said application, and notice of said hearing, together with its purpose, was
given by the publication in a newspaper of general circulation in the City at
least 10 days prior to the date of said hearing, and
WHEREAS, a hearing was held at said time and place, namely Monday, June 16,
1969, at 7 p,m" in the Council Chamber, Civic Center, 276 Guava Avenue, before
the Planning Commission, and said hearing was thereafter closed,
NOW THEREFORE BE IT RESOLVED AS FOLLOWS:
1. From facts presented to the Commission, the Commission finds that
public necessity, convenience, general welfare and good zoning practice require
the adopti on of the amendment to the zoni ng ordi nance for the estab 1 i shment and
change of setback lines, as follows:
SECTION 33.71 D - Establishment and Change of Setback Lines
In those cases where setback lines have not been established or where
they are established by subdivision maps or regulations of a particular
zone or as shown on the official line map, may be so established or
changed by the adoption of an ordinance in accordance with the
procedures set forth herein for a change of zoning,
2, The finding of fact in support of said determination is as follows:
The matter of changing setbacks is a legislative process and
should be handled in the same manner as requests for rezoning,
3, The Planning Commission recommends to the City Council that said
amendment to the zoning ordinance be adopted,
4, That this resolution be transmitted to the City Council,
