RESOLUTION NO, 575
RESOLUTION OF THE CITY PLANNIliG COMI~ISSION RECO~1MEliDING TO THE
CITY COUliCIL THE CHANGE OF FRONT YARD SETBACK ON THE 200 BLOCK
OF E STREET AliO TWIii OAKS AVENUE
WHEREAS, a duly verified application for a change of setback was filed with
the City Clerk on the 15th day of May, 1969, Application No. 69-M, and
WHEREAS, said application requested that the front yard setbacks on property
located at 226-244 E Street and 202-223 Twin Oaks Avenue, more particularly described
in said application, be changed to 15 feet, and
WHEREAS, the Planning Commission set the time and place for a hearing on
said application, and notice of said hearing, together with its purpose, was given
by the publication in a newspaper of general circulation in the City at least 10 days
prior to the date of said hearing, and
WHEREAS, a hearing was held at said time and place, namely 7 p.m., Monday,
June 2, 1969, Council Chamber, 276 Guava Avenue, before the Planning Commission, and
sa i d heari ng was thereafter closed,
i,OW THEREFORE BE IT RESOLVED AS FOLLOWS:
1, From facts presented to the Commission finds that public necessity,
convenience, general welfare and good zoning practice require the change of front
yard setback from 25 feet to 15 feet for 226-244 E Street and from 20 feet to 15 feet
for 202-223 Twin Oaks Avenue,
2, The findings of fact in support of said determination are as follows:
Concerning E Street --
a, The setback immediately to the west of the subject property is
10 feet while the setback on the block east is 15 feet,
b. The uniform 25 foot setback for arterials abutting R-3 zones is
impractical in this area due to the already existing conflicting
zones and setbacks.
Concerning Twin Oaks Avenue
a. 15 feet is the setback established by the new zoning ordinance for
R-3 development on local streets,
b. The Commission and Council have, in the past, consistently set 15
feet as the front setback standard on 1 oca 1 streets,
