HomeMy WebLinkAboutPC Reso 1969-571 II - - RESOLUTION NO, 571 RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO CITY COUNCIL THE ESTABLISHMENT OF A 20' SETBACK FOR THE NORTHEAST CORNER OF CORTE MARIA AND "E" STREET WHEREAS, the existing setbacks in this area along "E" Street are all at 25', and WHEREAS, at the time "E" Street was realigned, the setback was reduced on the lot at the northeast corner of Corte Maria and "E" Street which varies from about 17' on the west to 0 on the east, and WHEREAS, the setback map shows an existing 25' on "E" Street, and when setbacks are established by map, they do not move with the right-of-way line; they remain stationary, and WHEREAS, the Commission, upon the recommendation of the Planning staff, determined that the setback on this particular lot should be established in order to make it a buildable lot, and WHEREAS, the Planning Commission set the time and place for a hearing on said application, and notice of said hearing, together with its purpose, was given by the publication in a newspaper of general circulation in the City at least 10 days prior to the date of said hearing, and WHEREAS, a hearing was held at said tillle and place, namely 7 p,m" 110nday, April 28, 1969, Council Chamber, Civic Center, 276 Guava Avenue, before the Planning Commission, and said hearing was thereafter closed. NOW THEREFORE BE IT RESOLVED AS FOllOWS: 1, From facts presented to the Commission, the Commission finds that public necessity, convenience, general welfare and good 20ni"g practice require the estab- 1 i shment of a 20' setback for the northeast corner of Corte Mari a and" E" Street (on "E" Street), 2, The findings of fact in support of said determination are as follows: a, At present a portion of the property has no setback because of the realignment of "E" Street. This action will serve to establish a setback on the "E" Street si de of the property. b, Good planning practice dictates that building setbacks be established on arterial streets, c. Any proposed construction should be oriented toward Corte Maria.
