RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO THE
CITY COUNCIL THE ADOPTION OF AN AMENDMENT TO SECTION 33.52
OF THE ZONING ORDINANCE
WHEREAS, Section 33,52 - Regulations for Supplemental "B" Zones, as presently
written, states: "......lot areas designated B-20, B-25, B-30 and B-la inclusive,
may be calculated on a gross area basis where land is in acreage and a subdivision map
is submitted for planning commission and city council approval," and
WHEREAS, this provision, as interpreted by the City Attorney, is permissive
rather than discretionary on the part of the Commission, and
WHEREAS, the Commission desired to modify this amendment, by eliminating the
automatic gross density provision, but retaining the flexible lot-size provision, and
WHEREAS, the Planning Commission set the time and place for a hearing on said
application, and notice of said hearing, together with its purpose, was given by the
publication in a newspaper of general circulation in the City at least 10 days prior
to the date of said hearing, and
WHEREAS, a hearing was held at said time and place, namely Monday, April 7,
1969, in the Council Chamber, Civic Center, 276 Guava Avenue, before the Planning
Commission, and said hearing was thereafter closed.
NOW THEREFORE BE IT RESOLVED AS FOllOWS:
1. From facts presented to the Commission, the Commission finds that public
necessity, convenience, general welfare and good zoning practice require the amendment
to Section 33.52 of the Zoning Ordinance (fourth paragraph):
"The above minimum lot areas designated B-20, B-25, B-30 and B-la may be
reduced to 75% of that required in the zone, provided that the overall net density of
the subdivision is in accordance with the density provisions of the underlying zoning
and all lots created are part of a subdivision map approved by the City of Chula Vista."
2, The findings of fact in support of said determination are as follows:
a. If this amendment is approved, it will remove the existing loophole
in the Ordinance which now permits development of properties zoned

for 20,000 square foot lots or larger into lots up to 25% smaller than
required by the zone by using the gross density calculations now
permitted without any discretion on the part of the Planning Commission
or City Council,
