RESOLUTION NO. 607
RESOLUTION OF THE CITY PLANNING COMMISSION RECOMMENDING TO
CITY COUNCIL AN AMENDMENT TO THE ZONING ORDINANCE, SECTION
33.505 G RELATING TO SETBACKS ALONG MAJOR AND COLLECTOR STREETS
WHEREAS, a request has been made to reconsider the requirement of 25' front
yard on property zoned R-3 which fronts on streets designated as major or secondary
thoroughfares on the General Plan, and
WHEREAS, a 15' front yard is the standard for R-3 property on local streets,
and
WHEREAS, the Commission now desires to amend these requirements making more
flexible front yard requirements for the major or secondary thoroughfares, and
WHEREAS, the Planning Commission set the time and place for a hearing on
said application, and notice of said hearing, together with its purpose, was given
by the publication in a newspaper of general circulation in the City at least 10
days prior to the date of said hearing, and
WHEREAS, a hearing was held at said time and place, namely 7 p.m., Monday,
December 15, 1969, Civic Center, 276 Guava Avenue, Council Chamber, before the
P1~nning Commission, and said hearing was thereafter closed,
NOW THEREFORE BE IT RESOLVED AS FOLLOWS:
1. From facts presented to the Commi ss i on, the Commi ss i on fi nds that pub 1 i c
necessity, convenience, general welfare and good zoning practice require the amend-
ment to the Zoning Ordinance, Section 33.505 G, as follows:
*** A front yard of twenty-five feet (25') shall be required for all
parcels fronting upon streets designated as major or secondary thorough-
fares on the adopted Chu1a Vista General Plan. The front yard shall be
increased an additional five feet (5') for each story in excess of
three (3). The front 15' of this required yard shall be reserved for
screening and landscaping. Private patios, and one-story portions of main
buildings not to exceed 15' in height, shall be permitted within the
required front yard exclusive of the front 15'.
2. The findings of fact in support of said determination are as follows:
a. For visual effect on arterials and to create a more open feeling
in areas of high density residential development, the 25' yard is
appropriate, at least for two-story structures,
b. The additional 10' should be available for use for fenced patios
or one-story portions of structures with the remaining 15' retained
for screening and landscaping. This would promote varied-level
