CALL TO ORDER
1. ROLL CALL:
PRESENT: Councilmembers Malcolm, Nader, Rindone, and Mayor Pro Tempore Moore
ALSO PRESENT: John D. Goss, City Manager; Bruce M. Boogaard, City Attorney; and Vicki
C. Soderquist, Deputy City Clerk
BUSINESS
2. Special meeting for Tuesday night m deliberate on canoeling the Wednesday night meeting for
selection of Mayor or continuing said meeting, without resolving the issue, to another date.
3. Call a special meeting for the purpose of selecting mayor for Monday night, February 4, 1991, at
6:00 p.m.
Mayor Pro Tempore Moore informed the public that due to scheduling problems, staff recommended that
the meeting of 1/30/91 be canoeled and a Special Meeting be called for 2/4/91 at 6:00 p.m.

Councilman Malcolm stated that the Saturday meeting had been an embarrassment to the City and Council
He felt they had worked hard to build a reputation of having a solid Council that could make rational and
difficult decisions. The Council is at an impasse and he did not see any reason for canecling the Wednesday
meeting due to his absence. He stated that the remainder of the Council could vote for a special election
in June. He felt the City needed to continue on with a healing process and the only way to do this would
be to put this behind them. The Charter is very clear that Council should try to appoint and if unable to
do so, then call a special election.
City Attorney Boogaard responded that it was alright to declare an impasse if Council could not come to
agreement sooner than the 30 days, then agree upon a special election. The Charter states the Council
"shall" appoint, it also says that if there is no agreement in 30 days, Council "shall" call a special election.
If an impasse is reached before that thirty days, he felt the Charter would recognize the right to call for a
special election before that period. The press has been notified that the Wednesday night meeting was to
be canceled and a special meeting called for 2/4/91. They have agreed to publish this information. He had
also instructed the Clerk to mail notices of the Monday meeting to the public that spoke at the Saturday
meeting.
Councilman Rindone stated it was his understanding, when contacted by the City Attorney, that the meeting
was being postponed at the request of Councilman Malcolm due to a scheduling conflict. He concurred with
the City Attorney that there was an obligation to the public and if it was the consensus of the Council, the
meeting should be held on Monday to provide for public input and make a decision.

Mayor Pro Tempore Moore stated he did not have an objection to meeting either day. He felt it appropriate
to have the entire Council present for the decision. The meeting could be held Monday, in what he felt
would be a short period of time, and then the City could move on. He wanted to avoid the situation created
Saturday.
VOTE ON MOTION: approved unanimously.
4. ORAL COIVIMIJNICATIONS
4a. Kay Evefitt, 469 Emerson Street, Chula Vista, California, questioned the estimated completion date
for Phase [ of the 5th Avenue/Orange Avenue improvement project and if there was a time schedule for
completion of Phase II and III.
Roberto Saucedo, Associate Civil Engineer, responded that the utility companies are scheduled to have their
relocations completed by the end of February. Southland Paving will then be brought back in the beginning
of March with 120 work days until completion. The second phase, Naples to Orange, is under design and
will go to bid within the next several months.
4b. Fred Drew, 1275 Banner Avenue, Chula Vista, Califomia, felt citizen's rights were denied with the
limitation to three minutes for public participation at the Saturday meeting. He also expressed his concern
over: 1) uncontrolled audience conduct during the Council meetings; 2) censure of members leaving the dias
during a meeting when upset and the recording of subsequent votes as abstentions; and 3) belief that none
of the experienced Councilmembers were qualified for the position of Mayor.
Mayor Pro Tempore Moore responded that the Saturday meeting was for Council deliberation and the Chair
took the prerogative of the three minute rule over the five minute rule. He did not feel the audience was
uncontrolled and that several of the speakers did go over the alloted time.
