CALL TO ORDER
1. ROlL CALIt.: Present were: Councilmembers Malcolm, Nader, Rindone, and Mayor Pro Tempore
Moore.
Also present were: City Manager Goss, City Attorney Boogaard, and City Clerk Authelet.
BUSINESS
2. CONSIDERATION OF FILLING MAYOR VACANCY
Mayor Pro Tempore Moore opened the mee6ng for public input. Addressing Council were the following who
encouraged Council to call a special election to fill the vacancy:

Martin Altbaum, 581 "C" Street, Chula Vista
Others addressing Council expressing neither support or opposition, but addressed other issues relating to
the Mayor's vacancy:
Joseph W. Garcia, 484 5th Avenue, Chula Vista expressed that the City was in a fiscal mess, and
that something needed to be done.

Elliot Blair Smith, 4380 Arizona Street, Chula Vista, a former reporter for the San Diego Union, who
felt the Council had suppressed his articles.
Councilman Malcolm responded that he had called the Editor because Mayor McCandliss was reading the
articles and felt it served no purpose while she was fighting for her life.
There being no further input from the public, Mayor Pro Tempore Moore closed the public portion of the
meeting.
Council deliberated over an hour whether to fill the Mayor's vacant seat by appointment or special election.
MOTION: Moved by Malcolm to appoint Mayor Pro Tempore Moore to Fill the Mayor's vacancy. Motion
died for lack of a second.
MOTION: Moved by Malcolm, seconded by Nader to appoint Councilman Nader to fill the Mayor's vacancy.
Motion failed 2-2. (AYES: Malcolm and Nader. NOES: Moore and Rindone).
MOTION: Moved by Malcolm, seconded by Moore to appoint Mayor Pro Tempore Moore to f~l the Mayor's
vacancy.
Council deliberated on the motion. A recess was called at 11:30 a.m. and reconvened at 11:50 a.m.
SUBSTITUTE MOTION: Moved by Nader to extend to Planning Commission Canon an invitation to ~l the
balance of the Mayor's term until the next election. Motion failed for lack of second.
FINAL VOTE ON MOTION: After further deliberation regarding who would fill the Council seat if an
appointment for Mayor was made from the Council, a call was made to vote on the motion on the floor to
appoint Mayor Pro Tempore Moore. Motion failed 2-2 (AYES: Malcolm and Moore. NOES: Nader and
Rindone).
MOTION: Moved by Rindone, seconded liy Nader to continue the discussion to Wednesday, January 30,
at 7:00 p.m. in the Council Chambers. Motion carried 3-0-1 (Councilman Malcolm left the Council
Chambers).
3. FBJ.ING OF VACANT COUNCIL SEAT. IF (I~,EATED (part of the discussion above)
4. ORAL COMMUNICATIONS: Addressing Council were:
4a. Fred Drew, 1275 Banner Avenue, Chula Vista, stated it will not possible to done Gayle McCandiiss,
and we should not ~ry.
4b. Robert Piantedosi, 2060 Crosscreek Road, Chula Vista, requested Council to answer his question
whether Council helped to cover up the seriousness of Gayle McCandiiss' iliness. Councilman Nader
responded that he was probably the only Councilmember who knew, and he did not f'md out until
after the election.

ADJOURNMENT
The City Council adjourned at 8:30 p.m. to a joint City Council/Redevelopment Agency meeting to discuss:
1.A. RESOLUTION 16083 APPROPRIATINGFUNDS,TRANSFERRINGFUNDS, ACCEpTINGBIDSAND
AWARDING CONTRACT FOR THE PARKWAY SWIMMING POOL REHABILITATION IN THE CrFY OF (fftrl. A
VISTA (City Council) - On 1/9/91, bids were received for the rehabilitation of Parkway swimming pool in
the City of Chula Vista. The project includes the installation of new mechanical and chemical systems
including filters, pumps and necessary piping; replastering of swimming pool; installation of new waterline
title racing lanes, and turn targets; replacement of existing underwater lights; installation of new main drains
and piping; and the installation of new deck equipment. Staff recommends approval of the resolutions and
the appropriation of $36,920 from the unappropriated balance of the Residential Construction Tax (RCI')
fund, transfer $10,000 from Tennis Court Relighting Project (PR138), transfer $5,930 from the Redcarpet
Recreation Center (PR147), accept bids and award contract to Mission Pools of San Diego in the amount
of $191,160, also that the Redevelopment Agency appropriate $36,920 from the unappropriated balance of
the Town Centre Redevelopment Fund to the Parkway Pool Rehabilitation Project. 4/S's vote required.
RESOLUTIONS 16083 AND 1157 OFFERED BY COLIN CILMAN/MEMBER MALCOLM, reading of the text was
waived.
Councihnan Rindone questioned the liability to the City regarding the incoffect installation of the
underwater lights and whether there was a possibility of the City retrieving costs.
John Gates, Senior Recreation Supervisor, responded that there was an accident approximately two years
ago in which a swimmer cut the bottom of a foot while exiting the pool. A small settlement was made at
that time with no other accidents. There had been minor renovations since that time to try to alleviate some
of the liability.

2.A. RESOLUTION 16084 AC(~JrrlNG BIDS AND AWARDING CONTRACT FOR THE DEMOLITION
AND SITE CI.F. ARANCE OF A BUILDING (CABI~II.! .O LANES) AND OTHER IMPROVEMENTS ON A PARCEL
OF LAND LOCATED AT 740 'E' SI'REET IN THE CITY OF (~IULA VISTA (City Council) - On 2/6/90, sealed
bids were received for the demolition and site clearance of a site building located at 740 "E" Street in Chula
Vista. The project involves the demolition and site clearance of the Cabrillo Lanes building located at 740
"E" Street. The work includes asbestos abatement, demolition, and grading of the site which is adjacent to
the "E" Street Transit Center. Future plans call for expanding the transit center's parking lot, Staff
recomm ends approval of the resolutions and accept bids and award contract to Diamond Pacific of San Diego
for $72,100, and appropriate $109,000 from the unappropriated balance of the Bayfront/Town Centre
Redevelopment Fund to the Cabrillo Lanes Demolition Project. 4/5's vote required.

City Attorney Boogaard stated Closed Session was not necessary to discuss pending litigation pursuant to
Government Code Section 54956.9 - Hall versus the City of Chula Vista and Bayscene Resident Negotiators
ADJOURNMENT AT 8:40 P.M. to the Regular City Council Meeting on March 5, 1991 at 4:00 p.m. in the
City Council Chambers.
