ITEM TITLE:
Public Hearing: Conditional Use Pennit PCC-04-051, proposal to allow a
church and a daycare facility located in an existing building at 990 Lane
Ave in the Eastlake Business Center District, BC-l Manufacturing
Service Zone.
The Eastlake Community Church proposes to occupy an existing 44,953 square foot office
building located within the Eastlake Business Center District to provide additional seryices and
amenities. This would be an expansion of the church use currently located on an adjacent parcel
at 2351 Otay Lakes Road.
The Environmental Review Coordinator, in compliance with the California Environmental
Quality Act (CEQA) has concluded that this project is a Class 1 categorical exemption from
environmental review (CEQA Section 15301, existing facilities) pursuant to the State CEQA
guidelines.
RECOMMENDATION: That the Planning Commission adopt the attached Resolution
PCC-04-051, based on the findings and conditions contained therein to allow a church and a
daycare facility located at 990 Lane Ave.
DISCUSSION:
I. Site Characteristics
The property is 169,884 square-feet in size, essentially flat and contains an existing 44,953
square-foot office building with 182 parking spaces and established landscaping. The building
was previously occupied by Kaiser Permanente within the Eastlake Business Center District,
BC-I Manufacturing Service Zone.

3. Propo sal
The project is located at the corner of Otay Lakes Road and Lane Ave within the Eastlake
Business Center District, BC-I Manufacturing Service Zone. The existing building is currently
separated into three different areas with no interior connection between the three areas. Area I is
occupied by a computer room, storage, staff lounge, office spaces, and a Sunday school

classroom for the 3rd, 4th, and 5th graders during church services. Area 2 is occupied by a meeting
room, storage, office space, classrooms for the high school students and toddlers during church
services, and several rooms for the daycare facility during the week. Area 3 is occupied by the
sanctuary, several kindergarten and preschool classrooms, storage, and a reading loungelbook
storage/cafe cart during church services. A total of 215 children along with 26 daycare staff and
24 office staff members wi]] occupy this building.
In addition, a new wrought iron fence and gate will be constructed in the rear of the property to
enclose the proposed outdoor playground area. This area wi]] consist of outdoor play equipment
that will be stored inside the building and brought out each day for the children. During the
weekends, this area will be used as additional parking spaces for the church services, meetings,
and events.
The fo]]owing outlines the different uses proposed on this site:
Church
A total of three church services will be conducted at 8:00a.m., 10:00 a.m., and 12:00 p.m.. A
5,223 square foot room is provided for the sanctuary in Area 3, with supportive Sunday school
daycare rooms provided in Area 1 and Area 2, and a parents sitting room for newborns in Area 3.
A]] church services or meetings will be conducted in the weekday evenings and weekends. The
hours of operation of the church are Sunday from 9 a.m. to 2 p.m.
Daycare Facility
The daycare facility has three different components outlined below conslstmg of a regular
daycare program, Home Base program, which is a before and after school enrichment program,
and preschool and kindergarten classes. A total of 110 students wi]] be emo]]ed in the different
daycare programs with a total of26 staff members.
Daycare
The daycare is available for non-school aged children. The rooms are provided in Area 2 of the
existing building with a joint use with the Home Base Program. Since the children wi1l be there
a]] day, unlike the Horne Base program, the different age groups wi1l be staggered throughout the
rooms. The hours of operation are from 8:00a.m.- 6:00p.m. Monday-Friday.
Home Base
The Home Base Program is available for a]] school aged children. The program is a before and
after school enrichment program that provides morning care from 6:30 a.m. until the start of
school, Monday through Friday. The children are kept on the site until school starts. The children
are then transported to local elementary schools (Arroyo Vista, Eastlake, Liberty, Olympic View
and Thurgood Marsha]]). After school is over, the children are picked up and brought back to
Home Base and are kept until the parents pick them up no later then 6:00 p.m. There are four
rooms within Area 2 designated for the Home Base program. These rooms contains several
games for a]] ages, indoor basketba]] court, a snack shop, homework areas, lounge, stage area,
and several open play areas.

The hours of operation are from 6:30a.m.- 6:00p.m. Monday-Friday. The children are dropped
off between 6:30 a.m. and 8:30 a.m. and pick up at various times with the last pick up at
6:00 p.m. The children that are enrolled in the before and after school enrichment program called
"Home Base" are kept on the site between 6:30 a.m. until the start of school. The children are
then transported to local elementary schools (Arroyo Vista, Eastlake, Liberty, Olympic View and
Thurgood Marshall). In the afternoon, the children are picked up and brought back to Home Base
and are kept until the parents pick them up no later then 6:00 p.m.
Preschool and Kindergarten classes
A total of 11 0 students will be enrolled in the preschool and kindergarten classrooms. The
preschool will be available to children ages 2-kindergaten. The classrooms are provided in
Area 3 with a total of three preschool classrooms with 30 students each, and one kindergarten
classroom with 20 students. The hours of operation are from 8:45a.m.- 2:45p.m. Monday-Friday
with extended hours available from 7:30a.m.-5:30p.m.in which the children can be placed within
the daycare or Home Base program.
Shared ParkinglPlayground Area
The shared parking/playground area is located in the rear of the building. The total of 182
parking spaces are provided on the site. A new wrought iron fence and gate will be constructed
in the rear of the property to enclose the rear parking lot area in order to provided the proposed
outdoor playground area for the daycare facility. The outdoor playground area will consist of
outdoor play equipment that will be stored inside the building and brought out each day for the
children. This area consists of 20,240 square feet and will encompass 69 parking spaces that will
not be available during the daycare facility hours. Therefore, only 113 parking spaces wi1l
remain for the public and staff member. During the weekends, the gate wi11 be open and will
allow parking throughout the site for the church services, meetings, and events, for a total of 182
parking spaces. The following table shows the breakdown of the parking spaces per the proposed

ANALYSIS:
The Chula Vista Municipal Code defines a church as an unclassified use and the daycare facility
as a public and semi-public use within the Eastlake Business Center District, BC-I
Manufacturing Service Zone. The proposed site is surrounded by three retail shopping centers
and the existing Eastlake Community Church to the west, multi-family and single-family homes

to the south, Kindercare Daycare center to the northwest, Fire Station No. 6 to the east, and a
storage unit facility to the north. The site is located on a visible comer at the edge of the
industrial zone. The proposed uses will not interfere with the surrounding commercial or
industrial businesses, since most of the uses are compatible with the church and daycare facility,
or has the same proposed use on their uses.
The lot has sufficient size to accommodate the proposed uses as well as outdoor activities for the
children. No existing changes will occur to the exterior of the building, which is visibly
compatible with the surrounding office and industrial buildings to the north and east of the
subj ect site.
This project is consistent with the General Plan and the Eastlake Business Center District, BC-I
Manufacturing Service Zone. Approval of the project requires compliance with the applicable
codes and regulations, and all conditions must be satisfied prior to the final building inspection
or occupancy.
Church
The church services conducted during the weekends shall provide a need for the growing
population in the eastern portion of the city. The three church services in addition to the existing
three church services conducted on the adj acent lot will provide a total of six seryices rrom
8:00 a.m.-12:00 p.m. providing a variety oftime for the public. Since the church services will be
conducted in the evening and weekends, it will not interfere with the surrounding uses on
adj acent lots.
Daycare Facility
The daycare facility programs meet the need of the growing population in the eastern portion of
the city. Over 100 children are on the waiting list for the daycare facility programs of the existing
church located on the adjacent lot. By occupying this building, it will help to expand their
existing daycare facility programs. There is adequate drop off area designated for the children in
the parking lot in rront of the main entrances.
The Home Base program helps to address the needs of working parents with grade school age
children by providing a before and after school care. By utilizing the carpool vans to transport
the children to and rrom school helps to reduce traffic within the area. The pick up time for
parents are staggered between a four hour time rrame as to not increase additional traffic.
The preschool and kindergarten classes provide an alternative to public schools and could help to
reduce the traffic within the area of the public schools.
Shared Parking/Playground Area
The total number of parking spaces provided on the site is adequate for all of the proposed uses.
The 182 parking spaces meets the minirnum requirements in order to have a maximum 637
persons occupancy within the sanctuary for the church seryices during the weekends.
During the weekdays, when the daycare facility is operating, the outdoor playground area will
isolate up to 69 parking spaces during the week, which still leaves 113 parking spaces for the

public and staff member. This adequately meets the minimum requirements of providing at least
99 parking spaces for the daycare uses.
The new six foot wrought iron fence and gate will properly close off the playground area to
provide security for the children. During the weekends, the gate will be open and will allow
parking throughout the site for the church services.
The plans shall also cornply with the Fire Department requirements of providing proper access
through the gated playground area.
CONCLUSION:
Staff recommends approval of the application for a Conditional Use Permit to al10w a church and
daycare facility located at 990 Lane Ave, in accordance with the findings and conditions of
approval in the attached Planning Commission Ordinance PCC-04-051.

RESOLUTION OF THE CITY OF CHULA VISTA PLANNING
COMMISSION APPROVING CONDITIONAL USE PERMIT,
PCC-04-051, TO ALLOW A CHURCH AND A DAYCARE
FACILITY LOCATED IN AN EXISTING BUILDING AT 900
LANE AVE IN THE EASTLAKE BUSINESS CENTER
DISTRICT, BC-1 MANUFACTURING SERVICE ZONE.
WHEREAS, a duly verified application for a conditional use permit was filed with the
City of Chula Vista Planning Department on March 22, 2004, by Audrey Ruland on behalf of the
Eastlake Community Church; and
WHEREAS, said applicant requests permission to allow a church and a daycare facility
in an existing building and associated parking lot located in the Eastlake Business Center
District, BC-1 Manufacturing Service Zone; and
WHEREAS, the Environmental Review Coordinator has reviewed the proposed project
for compliance with the California Environmental Quality Act (CEQA) and has determined that
the project qualifies for a Class 1, Section 15301, existing facilities, pursuant to the State CEQA
guidelines and no further environmental review is necessary; and
WHEREAS, the Planning Director set the time and place for a hearing on said
Conditional Use Permit and notice of said hearing, together with its purpose, was given by its
publication in a newspaper of general circulation in the city and its mailing to property owners
and residents within 500 feet of the exterior boundaries of the property at least 10 days prior to
the hearing; and
WHEREAS, the hearing was held at the time and place as advertised, namely June 16,
2004, at 6:00 p.m. in Council Chambers, 276 Fourth Avenue, before the Planning Commission
and said hearing was thereafter closed; and
WHEREAS, after considering all reports, evidence, and testimony presented at said
public hearing with respect to the conditional use permit application, the Planning Commission
voted to approve the conditional use permit; and
WHEREAS, the Planning Commission of the City of Chula Vista does hereby make the
findings required by the City's rules and regulations for the issuance of conditional use permits,
as herein below set forth, and sets forth, there under, the evidentiary basis that permits the stated
finding to be made.
1. That the proposed use at this location is necessary or desirable to provide a service
or facility which will contribute to the general well being of the neighborhood or the
community.
The requested uses will take place within an existing office building and associated
parking lot surrounded by commercial and residential uses. This proposal will provide
additional services and amenities for the existing Eastlake Community Church located on
the adjacent parcel at 2351 Otay Lakes Road. With the daily increase of homes being
constructed within the Eastlake area, further expansion of the chW'ch and daycare facility
is necessary to meet the growing need of the community. Currently there are over 100
students on the waiting list to enroll in the school and programs. By occupying this
building, the chW'ch will be able to provide service for 105 children for the daycare and
Home Base program, and 110 children for the preschool and kindergarten schoo1. The
proposed church and daycare facility uses will not adversely impact the uses in the
Eastlake Business Center District, BC-l Manufacturing Service.
2. That such use will not under the circumstances of the particular case be detrimental
to the health, safety or general welfare of persons residing or working in the vicinity
or injurious to property or improvements in the vicinity.
The church and daycare facility will not have a detrimental impact upon the surrounding
business or residential neighborhoods. The existing building was used as an office for
medical and dental professionals. The environmental review detennined that traffic
generated by the facility would be significantly less than that generated by the previous
tenant of the building (Kaiser Medical). Trips generated by the proposed chW'ch and
daycare facility would not warrant the completion of a traffic impact report. Therefore
the project qualifies for a Class 1, categorical exemption pursuant to Section 15301
( existing facilities) pW'suant to the State CEQA guidelines. So, the proposed use will not
be detrimental to the heath, safety or general welfare of persons residing or working in
the vicinity or injurious to property or improvements in the vicinity.
The site is located on a visible corner at the edge of the Business District and is
surrounded by three retail shopping centers and the existing Eastlake Community Church
to the west, multi-family and single-family homes to the south, Kindercare Daycare
center to the northwest, Fire Station No.6 to the east, and a storage unit facility to the
north. The site is located on a visible corner at the edge of the industrial zone. The
proposed uses will not interfere with the surrounding commercial or industrial
businesses, since most of the uses are compatible with the chW'ch and daycare facility, or
has the same proposed use on their uses. All church services shall be conducted in the
evening and weekends. The daycare facility shall operation during the specified time
frame per Condition No.7.
3. That the proposed use will comply with the regulations and conditions specified in
the code for such use.
The conditional approval ofPCC-04-051 requires compliance with all conditions, codes
and regulations, as applicable, prior to the final issuance of any permit for or occupancy
of any new building on the property.
The Planning Commission finds that the request meets the code requirements as follows:
(A) The Chula Vista Municipal Code defines a church as an unc1assified use.
(B) The Eastlake Business Center District, BC-l Manufacturing Service Zone defines a
daycare facility as a public and semi-public use.
(C) The number of parking spaces provided are adequate for the proposed uses.
(D) There is adequate drop off area designated for the daycare facility.
(E) The lot has sufficient size to accommodate the proposed as well as outdoor activities
for the children.
(F) There is adequate on-site play area both inside and outside of the building for the
daycare facility.
(G) No existing changes will occur to the exterior of the building, which is visibly
compatible with the surrounding office and industrial buildings to the north and east
of the subject site.
4. That the granting of this Conditional Use Permit will not adversely affect the
General Plan of the City or the adopted plan of any government agency.
This Conditional Use Permit is in compliance with the General Plan of the City to
provide adequate public and semi-public uses within all areas of the city.
WHEREAS, the Planning Commission of the City ofChula Vista grants Conditional Use
Permit PCC-04-051 subject to the following conditions required to be satisfied by the applicant
and/or property owner(s):
PLANNING & BUILDING DEPARTMENT
I. A Building Permit is required for the proposed change of occupancy from the existing
office use to the proposed church and daycare facility. Plans shall cornply with 2001
Handicapped Accessibility requirements, Energy Requirements, 2001 CBC, CMC, CPC
and CEC.
2. The site shall be developed and maintained in accordance with the approved plans, dated
April 29, 2004, which include site plans and floor plans, on file in the Planning Division,
the conditions contained herein, Title 19, and the Eastlake Business Center District.
3. Maximum sanctuary seating shall not exceed 637 persons.
4. The rear parking lot area shall be devoted to the outdoor playground area and shall be
fully enclosed during the operation hours of the daycare facility. During the evening and
weekend meetings and services, this area shall be open during church services in order to
provide additional required parking spaces.
5. Special events shall include only activities associated with the church and daycare
facility, and shall take place entirely within the building, unless a Special Event Permit is
approved by the Planning Division.
6. The Daycare facility capacity for the project shall not exceed 250 children on site at any
one time.
7. The hours of operation for the daycare facility shall be Monday through Friday from 6:30
a.m. to 6:00 p.m. The hours of operation of the church shall be Sunday from 9 a.m. to
2p.m.
8. All community service uses to be held on site shall take place entirely within the building
and shall be coordinated by the church. Periodic meetings for civic groups shall not
require individual review, however, meeting sizes shall not exceed the stated sanctuary
occupancy.
9. Family counseling activities may be conducted by the church and shall be considered as
an accessory activity to the church services. Outside providers shall not be used to
conduct these services, and counseling shall take place on an individual (family) basis.
10. Any other Conditional Use permit proposed on this property shall be consistent with this
permit and shall not interfere with the operation of the proposed uses and outdoor
playground area.
11. Prior to issuance of building permits for modifications to the existing building, a sign
permit shall be approved by the Planning Division for all wall and monument signs.
12. All portable canopies placed within the outdoor playground area shall be located at least
50-ft. away from the rear west property line to minimize their visibility form properties
and streets to the west.
13. No gates shall be located on the northwest comer of the playground area unless a proper
connection is made between the two lots. In order to have a proper connection, you will
have to apply for a lot consolidation with the Engineering Division, provide an ADA
ramp, and upgrade the existing stairway to meet the Building Code standards.
ENGINEERING DIVISION
14. Pay all associated sewer capacity, traffic signal, and development impact fee based on the
final building permit plans submitted.
FIRE DEPARTMENT
15. The owner shall comply with the plan check review comments on the current building
permit, B04-0836 comments provided by Garry Edmonds on June 8, 2004.
16. The project shall comply with the 2001 California Fire and Building Code.
CHULA VISTA ELEMENTARY SCHOOL DISTRlCT/ OTAY WATER DISTRlCT
17. The applicant shall pay all associated fees of the Chula Vista Elementary School District
and the Otay Water District.
STANDARD CONDITIONS
18. The conditions of approval for this permit shall be applied to the subject property until
such time that the conditional use permit is modified or revoked, and the existence of this
use permit with approved conditions shall be recorded with the title of the property. Prior
to the issuance of the building permits for the proposed unit, the applicant/property
owner shall provide the Planning Division with a recorded copy of said document.
19. This permit shall be subject to any and all new, modified or deleted conditions imposed
after approval of this permit to advance a legitimate governmental interest related to
health, safety or welfare which the City shall impose after advance written notice to the
Permittee and after the City has given to the Permittee the right to be heard with regard
thereto. However, the City, in exercising this reserved right/condition, may not impose a
substantial expense or deprive Permittee of a substantial revenue source which the
Permittee cannot, in the normal operation of the use permitted, be expected to
economically recover.
20. This permit shall become void and ineffective if not utilized within one year from the
effective date thereof, in accordance with Section 19.14.260 of the Municipal Code.
Failure to comply with any conditions of approval shall cause this permit to be reviewed
by the City for additional conditions or revocation.
21. Any deviation from the above noted conditions of approval shall require the approval of a
modified conditional use permit.
22. The applicant/owner shall and does hereby agree to indemnify, protect, defend and hold
harmless City, its City Council members, officers, employees and representatives, from
and against any and all liabilities, losses, damages, demands, clainns and costs, including
court costs and attorney's fess (collectively, liabilities) incurred by the City arising,
directly or indirectly, from (a) City's approval and issuance of this Conditional Use
Permit, (b) City's approval or issuance of any other permit or action, whether
discretionary or non-discretionary, in connection with the use contemplated herein, and
(c) Applicant's installation and operation of the facility permitted hereby, including
without limitation, ant and all liabilities arising from the emission by the facility of
electromagnetic fields or other energy waves or emissions. Applicant/operator shall
acknowledge their agreement to this provision by executing a copy of this Conditional
Use Permit where indicated below. Applicant's/operator's compliance with this
provision is an express condition of this Conditional Use Permit and this provision shall
be binding on any and all of applicant's/operator's successors and assigns.
23. Execute this document by making a true copy of this letter of conditional approval and
signing both this original letter and the copy on the lines provided below, said execution
indicating that the property owner and applicant have each read, understood and agreed to
the conditions contained herein, and will implement same. Upon execution, the true copy
with original signatures shall be returned to the Planning Department. Failure to return
the signed true copy of this document shall indicate the property owner/applicant's
desire that the project, and the corresponding application for building permits and/or a
business license, be held in abeyance without approvaL

designer. Show existing fire alarm devices currently insta11ed and new devices which are to be
insta11ed. Entire system must be tested as a whole for final approval.
6. Separate inspection required by Department of Social Seryices - Community Care Licensing for
Day Care Facility. Permit was forwarded to Planning Dept. for approval. Inspection can be
conducted at time of Fire Sprinkler, Fire Alarm and Final Building approvals.

It is the policy of the Chula Vista Fire Prevention Bureau to require Knox key switch and
Opticom opening devices on all new motorized gate-opening devices.
During the plan check phase, the inspector will document that the minimum clear gate
width of the gate is 20 feet. He/She will fill-out a Plan Correction Sheet requiring both
types of devices. The FD will have the ability to use both devices.
All gate plans shall be routed and/or submitted to the Fire Prevention Bureau for approval.
There shall be a Fire Prevention plan check stamp on all approved plans.
When the inspector does the final inspection, he/she shall review the stamped approved
plan and make sure the gate was installed per the approved plan.

CHULA VISTA FIRE DEPARTMENT REQUIREMENTS FOR
SPRINKLER CONTRACTORS
BEFORE START OF JOB
Submit plans for review/approval.
NOTE - All CHANGES IN PLANS AFTER INITIAL APPROVAL MUST BE
RESUBMITTED TO THE FIRE DEPARTMENT FOR APPROVAL.
10 or more sprinkler heads require plans submittal and pressure testing.
100 or more sprinkler heads require to be centrally monitored.
Permanent / dedicated phone lines must be in place for fire alarm, must be
on separate zone from burglar.
INSPECTIONS REQUIRED BY FIRE DEPARTMENT
I. UNDERGROUND.
A. Thrust blocks.
8. Pressure Test - 200 PSI for 2 hours.
C. System flush until water is clear.
II. OVERHEAD PIPING.
A. Overhead Pressure - 200 PSI for 2 hours.
B. Visual inspection. (leaks) - (coverage)
C. Hangers / Braces.
NOTE Sprinkler head may be omitted from the electrical room, if room has a
smoke detector and has 1 hour construction with no openings to the interior of
building.
III. (FDC) -FIRE DEPARTMENT CONNECTION / (PIV) -POST INDICATOR VALVE.
A. Contact fire department to set FDC / PIV. (front of the building)
B. 3 feet minimum distance between FDC / PIV.
C. FDC required to be set between PIV and building.
NOTE FDC's shall be separate from the backflow device, and shall not be located on
the building. PIV's are required as a separate control device from the backflow
device.
IV. TAMPER SWITCHES - Required for all valves controlling water supply when the
number of sprinklers are 20 or more in Group I, 1.1, 1.2 occupancies. 100 or more
in all other occupancies
A. PIV required to have lock.
B. Backflow preventer required to be chained and locked.
V. FINAL.
A. Water flow test, bell location on building. (street side)
B. Alarm test - monitoring, tamper devices.
C. Building inspection card to be initialed.
D. Inspection notice with any changes of correction will be issued at this time
by fire department.

FIRE ALARM INSTALLATION REQUIREMENTS
The following information is required for review and approval of fire alarm installations.
Plans must be approved by this department before the start of installation.
1. Plot Plan - Showing the location of all devices, path and size of wiring, location of
junction and terminal boxes, whether Class A or B loops, end of line resistors.
2. Power Supplv Connection - Shall conform with following:
a. Provide overcurrent protection in separate, locked, labeled box.
3. Wirinq Diaqram - For all equipment and devices.
4. Specifications - For all equipment/devices including:
a. Manufacturer & model.
b. Serial.
c. State Fire Marshal listing documentation.
5. Installation Data Guides - For all components.
6. Zoninq/Annunciation -Indicates area subdivisions of protected premises that each
zone covers, or type of detection equipment each indicates. Also show on plot plan
where annunciatiors are located.
7. Identify Central Station - Providing monitoring, including type of line connecting,
type of transmitter and receiver.
A letter of transmittal should accompany the above items, including:
1. Name and address of person requesting review.
2. Name and address of project.
3. Name and phone number of person in charge of installation.
