HomeMy WebLinkAboutPlanning Comm Rpts./1996/09/25 (10) PLANNING COMMISSION AGENDA STATEMENT Item 4 Meeting Date 9/25/96 ITEM TITLE: Public Hearing: Conditional Use Permit PCC-96-39; request for an automotive oil change service facility at 1550 East nHn Street, within the C-C-P (Central Commercial/Precise Plan) zone - Valvoline Instant Oil Change The proposal is to construct a new automotive oil change service facility on a pad within the existing Otay Lakes Plaza commercial center located at the southeast comer of East nHn Street and Otay Lakes Road, within the C-C-P zone. Minor automotive maintenance facilities may be considered in the C-C zone through the conditional use permit process. The subject pad is located at the southwest corner of the shopping center. The Environmental Review Coordinator has determined that this project IS exempt from environmental review under CEQA as a Class 5 exemption. RECOMMENDATION: That the Planning Commission adopt attached Resolution PCC-96- 39 approving the project in accordance with the findings and subject to the conditions contained therein, BOARDS/COMMISSIONS RECOMMENDATION: At its August 12, 1996 meeting, the Design Review Committee voted unanimously (5-0) to approve the project subject to conditions. DISCUSSION: Site Characteristics The project site is a 5,850 sq,ft, lease area within a larger (23,549 sq.ft.) subparcel of the existing shopping center. The driveway and parking depicted at the north of the site are existing; the remainder of the site is undeveloped, This property is at a slightly higher elevation than Otay Lakes Road and slopes up from west to east, with a level pad area created by previous grading. The existing shopping center surrounding the pad to the north and east consists primarily of small retail uses and services within the main building and three freestanding pad buildings Page 2, Item~ Meeting Date 9/25/96 housing fast food uses and a Hollywood Video store, The shopping center was developed in 1992, at which time the subject pad was depicted as a single user, Zoning and Land Use Zone Land Use Site North South East West C-C-P (Central Commercial/Precise Plan) C-C-P (Central Commercial/Precise Plan) R-1 (Single Family Residential) R-1 (Single Family Residential) R-1 (Single Family Residential) Commercial Center Fire Station Commercial Center Community College Proposal The proposed project consists of the construction of a 3,162 sq, ft. automotive oil change facility; approximately one-half of the square footage would be sub-grade, The proposal includes three service bays, indoor and outdoor waiting areas, and 10 parking spaces. Services provided include oil and filter changes and replacement of certain fluids (e.g. windshield fluid). No tune- ups or other engine maintenance services are provided, Proposed hours of operation would be from 8:00 a,m. to 6:00 p,m. Monday through Friday, and 8:00 a.m, to 2:00 p.m. Saturday. ANALYSIS Few automotive service uses exist in the easterly areas of the city; the use proposed would provide a needed and convenient service for residents within the area as well as within the community. Oil change facilities tend to be fairly "clean" as automotive maintenance services go; work is conducted within the service bays and outside work rarely occurs due to the methods by which the work is accomplished (i.e. fluids are removed and refilled by vacuum hoses attached to holding tanks), Traffic/Site Circulation The existing driveway which leads through this site to the commercial center features a significant offset between the driveway location and the entry to the center at the east side of this pad. While this may not have been at issue with the original construction when a single user was envisioned, staff has some concern regarding site circulation due to the combined factors of the driveway offset, the drive-through nature of the proposed use, and the intention to place a second user in this area. The offset between the driveway and the opening into the commercial center creates a sight-distance problem for both vehicles leaving the southerly user area and vehicles exiting the oil change building as the building blocks drivers' views of oncoming vehicles. Page 3, Item~ Meeting Date 9/25/96 One way of addressing this concern would be the relocation of the existing driveway to minimize confusion, While relocating the driveway to the south would in staff's opinion be ideal for on- site circulation, it creates problems off-site due to the location of an existing driveway directly across the street at Southwestern College and the potential for people to attempt to drive straight across four lanes of traffic to get from the college to the commercial center or vice-versa. Because of this, the Engineering Division has concerns regarding this alignment and therefore is not in favor of this solution unless the existing median is extended to the south to create a barrier between the two openings. Plans for street improvements expected to be undertaken early next year would include such a median. Further, plans to accommodate a second user have not been received. Therefore, staff is comfortable accepting the current driveway situation until the street improvements dealing with the segment of Otay Lakes Road in front of the site are completed, A condition has been included which would require that prior to the approval of any building pennits for a second user within the site area, the existing driveway serving this use will be relocated to the south, Staff has met with the applicant regarding this issue, and the applicant concurs with this solution. Parking This use requires only six parking spaces, and ten spaces are provided including the existing parking at the northerly portion of the site, Parking availability may be an issue for the future second use; however, at this point in time staff believes that it is sufficient to condition this project to explicitly state that any approval for this project confers no rights for future development. Design Review Committee Consideration It should be noted that the Design Review Committee's approval of this project was given with the driveway shown relocated to the south with the construction of this building, rather than in the future. Staff believes that as conditioned, the existing driveway location will be acceptable and the change is therefore not significant. However, an infonnation item will be sent to the Design Review Committee advising them of this change. CONCLUSION Few automotive service facilities exist in the easterly areas of the city and the proposed service facility will therefore provide a convenient and needed automotive service (oil change and minor maintenance), to residents in the surrounding area as well as to those of the larger community, The site plan provides adequate parking and as conditioned, circulation should not be a problem. Based upon this, and on the previous discussion, staff recommends approval subject to the conditions contained in the attached draft Planning Commission resolution. PCC-96-39 RESOLUTION OF THE CITY OF CHULA VISTA PLANNING COMMISSION GRANTING A CONDITIONAL USE PERMIT FOR AN AUTOMOTIVE OIL CHANGE FACILITY AT 1550 EAST H STREET, WITHIN THE C-C-P CENTRAL COMMERCIAL! PRECISE PLAN ZONE. WHEREAS, a duly verified conditional use permit application was filed with the City of Chula Vista Planning Department on May 15, 1996 by Valvoline Instant Oil Change, and; WHEREAS, said application requests approval to construct an automotive oil change (minor automotive maintenance) facility at 1550 East H Street, within the C-C-P Central Commercial/Precise Plan zone, and; WHEREAS, the Environmental Review Coordinator has determined that this proposal is exempt from environmental review under CEQA as a Class 5 exemption, and; WHEREAS, the Planning Director set the time and place for a hearing on said application and notice of said hearing, together with its purpose, was given by its publication in a newspaper of general circulation in the city and its mailing to property owners within 500 feet of the exterior boundaries of the property at least 10 days prior to the hearing, and; WHEREAS, the hearing was held at the time and place as advertised, namely September 25, 1996 at 7:00 p,m. in the Council Chambers, 276 Fourth Avenue, before the Planning Commission and said hearing was thereafter closed, and; WHEREAS, the Planning Commission considered all reports, evidence, and testimony presented at the public hearing with respect to the application, NOW, THEREFORE BE IT RESOLVED THAT THE PLANNING COMMISSION DOES hereby find, determine, resolve, and order as follows: I. Findings. 1. That the proposed use at the particular location is necessary or desirable to provide a service or facility which will contribute to the general well being of the neighborhood or the community. The proposed use at this particular location is desirable in that it will provide a necessary automotive service in an area of the city in which there are currently few oil change and minor maintenance services available. The location is convenient for residents in the surrounding area as well as residents of the greater community, The proposed use will therefore contribute to the general well being of residents from the neighborhood and the community at large, 2. That such use will not, under the circumstances of the particular case, be detrimental to the health, safety or general welfare of persons residing or working in the vicinity, or injurious to property or improvements in the vicinity. The minor automotive maintenance work conducted is limited in scope and will take place completely within the building. Additionally, the proposed use has been conditioned to ensure that potential circulation impacts are addressed. Therefore, the use should not, under these circumstances, be detrimental to the health, safety, or general welfare of persons residing or working in the vicinity, 3. That the proposed use will comply with the regulations and conditions specified in the code for such use. There are no specific regulations or conditions specified in the code for this type of use, The use will be required to comply with all City performance standards under CVMC 19,68 and conditions of approval contained herein prior to issuance of a business license as well as throughout the duration of the use, 4. That the granting of this conditional use will not adversely affect the general plan of the city or the adopted plan of any governmental agency. The granting of this permit would not adversely affect the General Plan or the adopted plan of any governmental agency, II. Conditional Grant of Permit; Conditions In light of the findings above, the Planning Commission hereby grants approval of the permit subject to the following conditions: A. Operations shall be restricted to oil, filter, and fluid changes. Any other automotive maintenance services shall require prior approval of a modification to this permit. B, No automotive work shall occur outside of the building. C. The applicant shall remove the most southerly driveway on Otay Lakes Road and construct a new driveway to the satisfaction of the City Engineer prior to the issuance of building permits for any future uses on this site or concurrent with City improvements to Otay Lakes Road, whichever occurs first. D, The applicant shall enter into an agreement with the City and provide surety to guarantee the removal of the existing southerly-most driveway on Otay Lakes Road and construction of a new driveway to the south prior to issuance of building permits for this use. Said surety shall be cash, bonds, or other methods satisfactory to the City Engineer. E. The project shall comply with the plan conditionally approved by the Design Review Committee, with the exception that the existing driveway depicted shall be accepted. F, Business hours shall be limited to those stated in the application submitted for PCC-96-39, namely Monday through Friday from 8:00 a,m. to 6:00 p,m" and Saturday from 8:00 a.m, to 2:00 p.m, Any change to these hours shall require prior approval by the Zoning Administrator. G. The applicant's employees shall exclusively drive the vehicles into and out of the service bays and to the designated staging or parking areas. H. One 40 BC fire extinguisher shall be provided for the service area, and one 2AlOBC fire extinguisher shall be provided for the office/waiting area. 1. The project shall comply with all other requirements of the Uniform Fire Code, as well as to all requirements of the Uniform Building Code, to the satisfaction of the Fire Marshal and the Director of Building and Housing, respectively. J. The applicant shall obtain and remain in compliance with all applicable licenses and governmental regulations, including those of the Bureau of Automotive Repair and County Hazardous Materials. III. Additional Terms and Provisions of Grant. A. Post-Approval Conditions, This approval shall be subject to any and all new, modified, or deleted conditions imposed after adoption of this resolution to advance a legitimate governmental interest related to health, safety or welfare which City shall impose after advance written notice to the grantee and after the City has given to the grantee the right to be heard with regard thereto. However, the City, in exercising this reserved right/condition, may not impose a substantial expense or deprive Grantee of a substantial revenue source which the Grantee can not, in the normal operation of the approval granted, be expected to economically recover. B. Time to Commence Use, This approval shall become void and ineffective if not utilized within one year from the effective date thereof. C. A copy of this resolution shall be recorded against the property, known as 1550 East "H" Street. D. Any violation of the terms or conditions of this permit shall be grounds for revocation or modification of the permit. IV. A copy of this resolution shall be transmitted to the applicant.
